I would consult an immigration lawyer based in the USA for the best advice because this is a very unusual case.

my advice is if you want to come to the usa quickly legally , I would just get your wife naturalization certificate and submit it to NVC to update your visa category to IR-1 which is faster now where NVC processing time is faster than before . Going and changing citizenship in ds-260 I am not so sure of the timeline for that update with NVC .
sorry that I couldn’t provide any further advice on this matter

Yes it is possible,  For the NVC stages they look at the Dates for filing charts, the second chart, since that is current now for F2A category, you can still submit the Civil documents, DS-260 form through NVC and be DQ. If the PD retrogressed in the second chart, then you cannot submit the documents and be DQ. The dates for final action chart decides when you can get an interview letter. Since the PD retrogressed in that chart, you can still be DQ, but not receive an interview letter until that chart becomes current for our category. I hope you understood my explanation.

No it was Montreal embassy from day 1. Yes hopefully it’s in a month, I have very important travel plans coming up and I’m really hoping it doesn’t overlap with the interview date. 🤞🏽

F21 is spouse of LPR subject to country limitations, whereas FX1 is spouse of LPR exempt from country limitations. Both F21 and FX1 are under F2A category in visa bulletin. So yes, the retrogression applies to both. F21 is normally people born in India, China , Mexico and Philippines. FX1 is other world countries where there is no cap on the number of visas that can be issued per country.  Hope this answers your question

The consulate cannot go against the visa bulletin, regardless of what they may or may not have said in their email.  If your PD is not current, you cannot be issued a visa.  Full stop.

    I think it’s 2022, because DQ 2021 is all done .
you didn’t receive your interview letter because your priority date is not current I assume according to April visa bulletin. They can issue the interview letter only based on the visa bulletin .  Hopefully the dates moves forward soon .

    Hello all,

My kids and I got to the embassy 15mins before our appointment, the security guard let us in immediately. After going through security, they showed me a tiny locker where I can keep my phone (turned off). The locker is really only for phone only and won’t be able to store anything larger.

The interview was straightforward, absolutely nothing out of what had been posted before.

    Original documents:
    passports
    birth certs
    police record
    marriage cert
    passport photos

    questions:
    who is your petitioner
    When did u get marry
    Longest stay in US
Travelled outside us or Canada last 5 years

so like I said, nothing out of the ordinary.

What I want to share is medical experience. for those that don’t have their vaccine record, you can go to your family doctor and ask them for a requisition that checks for the vaccines that you hv no record of - mumps, rubella, varicella, measle, hep a, hep b etc. you can do this before u get your interview letter so you hv the report on hands and ready. it takes about 10 days to get the report back and then u can get the report from your doctor and bring it to the panel physician to show you hv immunity for those listed (if you don’t hv the immunity for any of them you can get your shot before the panel physician appointment and ask ur doc to write u a note to show the panel physician you hv received ur 1st shot).

also, if you hv kids growing up in Canada, they might not be vaccinated against hep a and that is a required vaccine for kids, so check and book ahead for the hep a vaccine.

lastly, as recommended by @ks7608, I also called the panel physician’s office a week after my appointment to ask if our report has been uploaded. They were very nice and checked for me.

    good luck, everyone!

J-1 Visa is a non-immigrant visa, the chances of rejection is almost certain when they apply for it because you are a possible immigrant and will not leave the US, since you already have immigrant visa case waiting for interview.  You can consult an immigration lawyer for better clarity.

@dhruvroom Is the screenshot of the RCMP PCC  posted  earlier by yours ? Did you take your fingerprints for applying for Canadian PCC?
In that screenshot it mentions date fingerprinted .
if you didn’t take your fingerprints, then you might need to obtain a new one
RCMP generates more than one type of police clearance certificate. The fingerprinted PCC, is a more detailed one and US consulate requires a PCC from RCMP that includes your fingerprinted date so that check a wider database. Hope this explanation is clear .

For Indian PCC, they don’t take fingerprints. Each countries PCC has different requirements. In department of state’s website, they mention each country’s police clearance certificate requirements.

    Yes, This one is correct.
Some people do not get the fingerprints for Canada PCC, that's why at the interview they ask to resubmit a new one with fingerprints.
@dhruvroom your RCMP clearance looks good. Just make sure its not more than 1 year old ,before you attend the interview.
I would recommend to get a new PCC from RCMP once you get the interview letter, just to be safe.

Tdap vaccine should be updated every 10 years , so if you don’t have the proof of taking a tetanus shot in last 10 years, then you need to take it and obtain proof of vaccination.  Chickenpox ( varicella vaccine ) the doctor might check for immunity usually ,if they don’t find the chicken pox marks on your body, some cases they take your word for it . To be sure , do a immunity test and then take a vaccine if you don’t have immunity for varicella .

According to the Montreal consulate pre interview checklist, if it’s been more than 12 months after uploading to the NVC , then you need to take a new PCC at the time of the interview . I would say it’s good for a year . But I took a new RCMP PCC since it was easy to obtain , Indian PCC I kept the old one.  It’s upto you basically . It would be nice to keep an updated PCC of the current country of residence.

    Hi all,

My wife had her interview this morning.

Appointment time was at 9:30am. We arrived at 9am but there was a line and they made us wait outside. Waited until 10:25am before they let my wife into the building while others were still waiting outside. Seemed like a particularly busy day with many cases involving family of 3-4 people. They were also trying to prioritize American citizenship and passport renewal services. Recommend you check weather before hand and bring warm clothes as you might have to wait outside for quite some time.

Once inside, someone will check your passport to verify your appointment. Afterwards comes the security screen. You are not allowed to bring any backpack with you so suggest you bring all your documents in a folder when arriving. They will also ask you to turn off your phone and put it in a locker past security clearance.

Once through security, you will go up to the first floor and wait in the waiting area until your number is called. You will then be called to the first counter where they will collect your original documents including birth certificates, marriage certificate and police certificate(s). The person at the first counter was friendly and just asked questions about who the petitioner was, petitioner's address and legal status in the US. Because my wife used to work in the US after her graduation, she got a Social Security Number (SSN) and they asked her for that information as well. She did not have the physical copy of the SSN but they were ok with her writing it down.

My wife was then asked to have a seat and wait to be called to the second counter. The wait was fairly long as it was busy, ~30 min wait before she proceeded to the 2nd counter. There they had her take the oath promising she would answer everything truthfully. The second person at the counter was very chop-chop and business-like. He asked again who the petitioner was and whether my wife had read the pamphlet. She was not sure which pamphlet they were referring to so they gave her a pamphlet about domestic violence and told her to read it as it was an important document. He then proceeded by asking where and how we met, where I lived, if this was our first marriage, if my wife had committed any crime or if she had at any point in the past overstayed in the US. In between the questions, the officer was just busy typing away into the system. At the end, he said: "It looks like your visa has been approved" and gave my wife a piece of information with instructions about checking documents' status and passport delivery options. The officer also said they would contact if they have any further questions.

My wife got out of the building at 11:50am.

We immediately went onto https://ais.usvisa-info.com/en-ca/iv and https://ceac.state.gov/CEACStatTracker/Status.aspx to check for the status but it seems it has yet to be updated yet. We checked again just now at 3:00pm and the status still shows the below:

Based on people's past experience, how long after your interview does the status tracker reflect that your visa has been issued and when you will see the tracking number? Also how long should we expect to receive our passport back. My wife lives in Toronto and we select the premium delivery service.

Thank you very much and good luck to those who are still waiting and scheduled to take the interview.
