  2. I have no idea but I’m certain they hadn’t looked at my new info after my wife submitted it on June 8th because they didn’t hesitate when I resent them the same info for my kids. I sent it on June 20th so I expected to hear one way or the other by tomorrow. I’m just grateful that my wife and I didn’t have to leave them here for a few months while we got jobs. I’m very appreciative of you and everyone else on here for all the help. If I had to do this over again I would still do it myself but depend on the collective experience of this group. Thanks to all.
  3. Mike, no we were waiting to see what happened. I had the new 864’s ready to go just in case. Crazy Cat-Thanks a million, 4 days shy of 1 year when we filed their I-130. Remember I screwed up when I filed for my wife on 06-30-2021. I though that the I-130 that I filed for my wife included the children. When you guys straightened me out I then I filed for the children exactly 1 year later and wrote a cover letter begging them to merge the cases. Regardless, wether they did or didn’t it’s finally done now. My wife is so happy.

  5. Thank you. I’m a bit uncertain what boxes to check on Section 5. There’s me, my wife and 2 children. How do I fill it out? Then I’ll duplicate it for the 2nd child.
  6. Ok, first question. Do I send a new 864 for my wife who already has her Visa? I have 2. Step children so as I understand I will list each child on their own 864 in Section 2. In Section 3, I don’t list either my wife or the 2nd child. Is this correct?
  7. I agree that I completed the I-864 incorrectly and in support of many of you who have made this clear to me I offer supporting documentation (not that you need it) Ie. Notice that the form says, "Do not include any relatives listed on a separate visa petition." This would be the case if they were immediate relatives of the petitioner, in which case each would need a separate I-130 petition and also their own Form I-864, filled out just for them, rather than a photocopy of their mother or father's form. For example, if a U.S. citizen father petitions for his wife and stepchildren, they are all immediate relatives, will all need separate I-130 petitions (which they have) and therefore will all need separate Form I-864s. (This is exactly my situation as published in one of the online instructions website.) As of an hour ago our response to the Children’s denial 2 days ago, WAS RECEIVED by the US Embassy, Manila. It included the incorrect I-864 and my SS Benefit letter showing adequate income for my family. If past history is indicative of what to expect then we will receive a response by Monday, Tuesday at the latest. While it’s indisputable that I filled out the I-864 incorrectly I find it frustrating that no one at US Immigration pointed this out since it was submitted last September. My Wife said the Person at Prescreening actually complemented her for having everything correct and very well organized. Then the CO didn’t say a word about any paperwork errors and just told her we needed a Co Sponsor. Please know I never doubted you guys. I’m just frustrated, mostly with myself but certainly with Immigration. I think that if we are again declined for inadequate income we will go to the US and get jobs AND when we can prove a substantial increase in Income then resubmit the Proper 864 with Proof of higher Income. If however we are declined for screwing up the 864 I’ll immediately courier the corrected one and upload it as well. Unless you guys think differently i think it makes no sense to upload and courier new 864’s with the same income if inadequate income is why we’re denied. We will know for sure in 2 or 3 business days. Thanks again
  8. Because my wife was instructed to upload and send their Passports to the Embassy with the required documentation. I will prepare new 864’s now. That only rakes a few minutes.
  9. Lemon slice-I don’t need the Passports to upload new 864’s but they still haven’t read the ones I uploaded on June 8. They still show “Submitted” but not yet “Accepted”. They approved my Wife with the hard copy that we couriered with her Passport and SS Benefits Letter. When we receive the Passports back on Saturday or Monday I’ll resubmit them and upload the new 864 immediately.
  10. Family-My experience from June 7th shows me that the Embassy will make a decision and forward the Passports back before I can Courier a new 864. They would likely pass each other in the Delivery Service. Last time there was even a Holiday and it was still resolved in just a few days.
  11. Lemon slice- I can’t do it now bc I need the Children’s Passports and they are at the Embassy. If they come back Denied which is what I’m hearing then I’ll immediately resubmit them with corrected 864’s.
  12. I’m not sure what you are speaking about. If it’s resubmitting the 864’s for each child listed as the Principle Immigrant that’s bc Pushbrk STRONGLY says that’s what needs to be done. See above.
  13. Dashinka, yes my wife and 2 children have separate I-130’s with each having paid the required fees.

I suppose that since I have already submitted the I-864 with my Wife listed as the Principal Immigrant I will wait until we either receive the Approved Visa or receive the Children’s Passports back from the Embassy and immediately upload the new 864’s to CEAC and resend the Passports back to Embassy. I can’t resend New 864’s without their Passports.
  15. Pushbrk- So I need to file an I-864 for Each Child and leave my Wife’s name off of it. Correct? So the only name will be one Child as the Principal Immigrant and one for each Child? sorry for being slow.
  16. No my Wife is listed as the Principal Immigrant of all 3 I-864’s. Each child is then listed as Family member 1 on their respective 864 with the other child listed as Family member 2.

After the children’s denial on June 20th we resubmitted the same I-864 accompanied with my 2023 SS Benefits Letter that we Submitted on June 8th when my wife was first denied and then a few days later Approved and Issued. CEAC currently shows the I-863 as “Submitted” but not yet “Accepted” which leads me to believe the CO on the 20th didn’t read the 2023 Income so we wouldn’t have met the new March 1st US Immigration Income requirement. Notwithstanding CEAC own guideline stating if Income is sufficient when submitted, which it was in October 2022, it won’t be subject to future increases in the required Income. Im not looking to have that argument because it would require an attorney and it’s a moot point because fortunately my current documented 2023 Income is Sufficient. I know I repeated myself a bit but for new folks it’s important context. Thanks to all for trying to help.

At this point since the children were denied on June 7, and we submitted the new I-864 with 2023 Income Benefits Letter that afternoon and because my wife was first denied and then issued a Visa a few days later after the Embassy received the Benefits Letter I think waiting for a few days just makes sense. There’s always time to panic later. Having said that, unless there’s a compelling reason not to go to the US on July 13th we’re going to go. Isn’t it better for my wife to be in the USA just in case a bus hits me? I know I’m an old guy but I want this for her and the kids. For me only I’d stay here. This is like my family hitting the lottery and I could die happy if they were all in the US. I have a pretty hefty Life Insurance policy to help them.
  20. My Wife is the Principle Immigrant on all 3, I-864’s with both Children listed on each. We did file separate I-130’s for the children. I don’t follow that mom should file I-130’s for each of the kids. If we do go to Plan B, I will get a job to boost our income. If my wife is working in the US will her income help as well? Do you know how long we would have to work to have the income count? Thanks.
  21. Thanks Redro, my wife is on all three forms. My wife and I decided last night that if the children aren’t approved we will go to “Plan B”. When my wife was approved last week I booked all 4 of us Flights to the States three weeks from now. That’s plenty of time for an approval if we’re going to get one. These flights are expensive, $2,150 each. If we could have waited until September 12, the end of high Summer airfares, the tickets would have only been $1k each but her Visa expires on August 26. I had already purchased the $1k fully changeable and cancelable when I thought we’d be leaving on June 15th. It was a no risk high reward decision because buying in advance saved lots of money and the tickets are changeable and cancelable without penalty. So Plan B is my Wife and I will fly to the States in 3 weeks, get settled, get jobs even if only working at a Temp Agency, Walmart or any job making $15 an hour. Again my Wife is a Degreed Accountant and I can do many things if I dust off my MBA Degree. So my question is this: Does anyone know definitively or at least from some knowledge base how long we need to work before we should resubmit a new I-864? I’m quite confident many people have done this in the past. Assume worst case and we both work for $15 an hour, 40 hours a week so our combined income would be $1,200 weekly. Annualized that’s $62,400 plus my SS of $38,000 equals $100,400. The Immigration requirement is $37,500. We will then rebook the kids in September reducing their flight cost back to $1k and use the $2k savings for my wife to fly RT to pick them up.
  22. We uploaded the new I-864 to my wife’s and both children’s CEAC Accounts. We don’t believe the CO today saw the new one. All 3 of them have their own case numbers if that’s what you’re asking.
  23. Redro, Yes but I don’t believe the CO today read the new I-864. We think only the CO who approved my wife’s Visa last week read it. Nothing else makes sense. My wife was immediately approved the day after they received the new 2023 Income that met the new March 1, published required income.
  24. SalishSea, I understand they won’t count the SS Income for the Children but not your point it will eventually stop. The children are 7 and 9 yrs old so yes it will stop in 11 years and 9 years respectively. Hardly an issue.
  25. I understand that future SS Children’s Benefits are not income. Honestly I think and hope the CO just didn't read the updated I-864 with the 2023 SS Benefits letter.
