Yay to being able to start working. I still can not believe I have my EAD and AP documents on the go. Hopefully full perm res status will follow soon so we can pspend the rest of our lives together missing him

Sounds good to me Julezabelle. Could be nice to met up for a meal one day or something? I am sure my better half is keen to do the same. Also if anyone knows where we can get Duck in Pancakes then let us know as that is the biggest thing I miss from the UK even though you can only get them in Chinese restaurants !!!!

Thanks for the replies. Another coupe for you all if you do not mind. As we have to treat each form separate does that mean separate checks? Also on the 485 part 2, Should I put an x in (A) as I am married to a US citizen or (H) and say I married a US citizen?
I thought the forms were easy until I got to this one lol.

Hi all
I have a couple of questions that I need to know before posting my AOS on Monday
1) With the divorce do you use the filed date or the date the judge signs it? I believe it to be the filed date but not 100%.
2) What surname do I use on the forms as my wife's surname has changed to mine after we tied the knot so does she use my surname now or her old one?
3) When sending in documents together do we need to supply pictures as requested or will 2 be enough as all the files will be together?
I think that is it but may need to come back for more advice soon

Well here goes,
I came back to the states on the VWP in January and by February we found out that we were going to have a baby. We discussed the possibility of just getting married as we had no intention of getting married when I entered. We decided against it as the K1 should not take that long to get and thus we could cope with being apart ( even though that is so hard).
Alas a few weeks ago we lost the baby due to an eptopic pregnancy and this has knocked us both really hard and the thought of losing each other for even a few months is too much to bare especially as my partners 2 year old can not stand me being away for even a day. We decided to get married and apply for AOS which yes I know will annoy some on here waiting for K1 etc but we just could not cope with what has happened and then being forced apart. Obviously everything could get denied and I could get sent back to the UK and apply for K3 but at least it would give us a bit more time to come to terms with everything that has happened.
My question is which forms do we need to fill in and send?
I know we need to do AOS and AP but has someone got a definitive list so we can file?

You sound like you have enough. I got denied a visa at the consulate in London but still got in under the vwp a couple of weeks ago. I had the following
a letter from my new employer,
Rent agreement
receipt for rent payments
letter from my dads doctor about hospital appointment for March
Bank statements from all my accounts showing various amounts of money.
I was grilled for near on 2 hours at the rainbow bridge but got in anyway so do not worry you will be fine.
I would not take to much money with you as this is one of the things they checked on me along with going through my wallet and my cases.

Hi All
Just a quickie today, When completing the K1 forms and attaching documents do you have to write on the back of each one that they are a copy of an original document? Also, as I am stateside at the moment should I sign each document along with my fiancee?

I believe A/P can take a couple of months or more to get so you may have to hold fire on the Honeymoon matey. Good luck with it all though and yes you can stay on the VWP just make sure you have lots of evidence of ties back to the UK

Yeah - bring strong ties - I am about to take my chances next month but am going to bring a letter from my employer, rental agreement and NOA1/2 to show I am going through the legal procedures
The other main point is to not offer any information that is not specifically asked for and answer all questions honestly
MMM I wonder what crazy fool give you them instructions hehehe. As for the receipt we just wrote something up on the computer showing that I confirm that >>>> has paid x amount in rent znd is now paid up to whenever. Both sign it and then you are sorted

I know - but it is still really nervewracking - I have no problem keeping on my engagement ring and things and anything that looks in the slightest bit dodgy is going with my mum!! Did you have to show the past payments for your "rent" or did you not bother with that?
I am expecting a letter from my employer (the agency at least) soon and I have to get mum to fill out the paperwork - I printed it all already
Ooohhh - I just hate not knowing - I wish I could fly out tomorrow and be done with it!!
They did not ask for old ones but I had one to show that I had paid for the next 3 months and that if I moved out before the contract ended i would have to pay 2 months to close the contract
We are not supposed to be in the US until tomorrow but as we were so close we could not resist crossing a couple of days early. Everyone over here were really happy that I had made it and got a round of applause from the people at the local bank
It is so nice to be where I consider home now.
Again do not worry and just remember that YOU ARE DOING NOTHING WRONG so do not feel nervous

Did you plonk down all the paperwork first or did you wait to see what they asked? I'm really nervous about going through Dublin but figured it is best to go through there so I can relax over the Atlantic!! And 3 months with your OH sounds like bliss!!!
Thank you Jeraly, It was a long time but I do not think it was bad. My other half panicked a little bit but I was cool as a cucumber thanks to vj and all the advice I had.
I did not show them anything unless they asked for it but had it all just in case. The things that swung it I think were the job offer from my friend, the 16 page tenancy agreement
( they did not care it was at my parents as long as you say it is a proper contract.
Things to be careful of are carrying things in your purse / wallet that show you are so serious but then again if you have the K1 paperwork you should not have to worry about that as they know you are serious. You will be fine on your journey Jeraly, just make sure you have lots of time between landing in Dublin and flying on to the states. Like I said before, I have been in the states for 5 and a half months during 3 trips in the last year and still got another 3 months. They also said that they are not trying to keep people apart they just want to make sure you are doing everything by the book.
I will keep my fingers crossed for your trip but I know you need no luck and you will be with your sweetheart very soon.

I thought I would write to tell you all about todays journey through the Rainbow bridge crossing today.
First of all I made it across so i can spend 3 months with my 2 angels. There was a lot of doubt as I had a visa rejected in November by the London Consulate.
With me I took, bank statements to show I could afford to travel, Booking of accomodation in Myrtle beach although we will not be going there now
, Job offer letter for March and a tenancy agreement.
I got bombarded with questions some of which were as follows
Why do you travel so much? Because I love it
Where in the middle east have you been? I haven't
Yes you have, the stamps are in your passport? No that is Tunisa and Egypt which are in Africa and not the middle east
Where are you staying? Myrtle beach
Why did you fly into Canada? To visit family first
We were then sent to the place to have further questions and fill in the form. More questions up there were
What has changed between Nov and Now? Nothing
But you said you were redundant? I explained that it is different to the redundancy in the US and that I can get my old job back although I have another lined up ( showed job offer )
Why have you got an American Bank account? Because it saves getting charged with my English one all the time.
Are you 2 dating? yes
how did that occur? explained everything
Let me see your wallet? showed them
Why have you got a darien lake pass? because it was $40 for one visit or $70 for a year!!!!!
More questions about how I knew by SO
They then called up my SO and asked the same sort of questions.
Then they went down and looked through the car and came back and asked more pretty standard questions along the same lines to ensure your story was still the same. The border officer than told me not to worry about all the questions as they are not trying to stop people entering the country as long as they intend to stay and to expect lots of questions in future visits. Thanked me for having all the info I carried as it meant I could prove I intend to return to the uk, told me the cowboys suck and to have a good trip
Still can not believe I got across after tourist visa denial but I am and am going to enjoy the next 3 months and hopefully get our K1 on the go

I am the other half that went through this with OP it was nerve wracking as I have never had to go through anything like this before. I think the car search was the worst as I was quite embarrassed by having them going through all my personal things. But we were truthful with our answers.. so this answers anyones questions about how many times you can come in under the VWP 4 so far in a 8 month period and yes you can travel under the VWP after you previously have been denied a visa and its only been 6 weeks since he was denied that visa.
i am thrilled though that he is here and it was worth the headache!

mmm I think you should be ok going through the process and am sure someone on here will advise you more. You may be lucky and get to stay while undertaking the K3 route which of course is what we would all do if we were allowed to but most of us have to suffer the K1 or K3 from our home countries with the K1 currently being slightly quicker for the process and getting work clearance afterwards.

If you travelled using VWP on the plan of getting married then you will get deported. If however you entered as just a visitor with no intention of actually getting married then actually did you would have to prove that you had no plan originally.

You spend as much time "together" as possible. We use skype, email, and the webcam is a lifesaver!!! We plan our wedding even though we have no idea when it will be. When its really rough we cry, scream and curse (well at least i do!) You just have to realize that its not forever and at least we have each other , at least we know we will see each other again. I went through the physical pain last time David left. I went weeks without sleeping, could not eat, felt like I could die. But for me I had to get my a*# in gear as I have a small child. Yet I made it through that and we will see each other Friday for a few weeks or months depending on the POE. Yet we all have to go through this if we want to be together. Just think of it as a test of the strength of yourself and your relationship, you will make it through because the only other choice is to give up and I know for myself I am not giving up the only man that has made me believe in love..
So be strong! think of all the good times you have had and all the many more you will have in your lifetime together!!!!!!!
You have brought tears to my eyes as well baby. I will get to see you tomorrow and like you have said you either deal with the distance and give up or fight for your right to be with the one you love for eternity which is what I do every day. Keeping yourself busy is a good way to deal with being apart ( note to oneself, should really listen to my own advice lol ) and of course chats etc everyday if possible to your loved one. It costs me less to call Cher in the US as it does for my mum to call her sister some 40 miles away in Horley which is just as well as we talk for about 5 hours a day.
My best advice would be to remember why you are going through all this and that tends to push you on when you are having a wobble.

Ignore chuck and rose mate. You want to quadruple check everything and then check it all again to make sure. Trust me I have checked my papers at least 20 times. Before anyone asks I do not have O.C.D or at least I didn't until I started this lol

Hi all
I am getting together the information for our interview at the end of the month for my Greencard. My parents are here at the moment on a visit and I was going to get them to write something but we do not know what to put in it. They missed the wedding as it was short notice and my Dad was too ill to travel so now they are here should they put something like that down in a letter.
