    Thanks. Could you also suggest if I should check the box on 25 saying "I was not required to file a Federal income tax return as my income was below the IRS required level and I have attached evidence to support this"

    We have similar situation. What did you do and did it get accepted. Did you provide letter of explanation or explained reason for not filing at the end of the form.

    My petitioners didn't file for the 3rd most recent year since income was below the required level. However, she filed for the most recent and 2nd most recent year. Do we need to include letter of explanation or just the information at the end of the form i864 is enough.
