Hello forum. Small update, after all this messed up USCIS attitude case was approved January 23 2024, without interview, awaiting green cards. Total loss over 12000$. Conclusion, USCIS plays its own game where everyone is trapped like a mouse, they are 2 steps ahead of you, follow strictly guidance from USCIS to avoid complications because they don't give a ####### about you. I did not use any lawyer as they are useless goons and only application fillers, easy can do it on your own. My advice, get online account with USCIS and check it EVERYDAY(if you have no app case tracker, if you do - once a week enough). Get app case tracker which is good app, but also not reliable because did not update case progress sometimes( its a must do copy paste within app to see progress of your case online). Watch your case and don't give a chance USCIS to screw you. USCIS did not send few letters to me which resulted in case denial in first filing, even motion to reopen(with lawyer service) did not work(after case denial)as USCIS stood their ground and told me Foff basically. My last(3rd) filing went over processing time and i did online e-request, which gave me useless reply we working on it, but after 2 months case was approved. Follow instructions and monitor your file and progress of your case aggressively yourself without rely on USCIS notices(as they cheat and don't send the most important letters(RFEs). You may see it online on your account if they sent anything in Document tab, but if you dont have online account and rely on paper letters you will be in very weak position(that happened with me when i filed first time). P.S. USCIS play dirty, but they do it smart way in form of invisible hand. Nobody should pay twice for the same person for the same immigration benefit, that is their job to deal with it, they dont, you pay twice or even more than that. The picture, its from I797c approval notice, no priority date listed. Some said here on forum, the day when I129f was received by USCIS that is priority date, i left priority date field blank on my I-485.

Sorry that you have this experience. Don't get lawyer, don't file motions etc. Once adjudication is done thats it. Case by case basis as USCIS says, in your case denial is after RFE and is final, i had similar situation but things were out of my control, IRS 9 months delay. This situations like you have or i have, bring USCIS hundreds millions of dollars extra, pure business nothing else. USCIS brutal organization that has no mercy and you can not complain to nobody, they decide your fate themselves by rules they create themselves. Unfortunately once denied, you need refile same application again and you will have different case number.

I did not sent any originals. Dont see anything extraordinary in this process, followed instructions line by line always. Question is why K2 has RFE now? Relax is not acceptable, can debate a lot about the process, caught USCIS playing dirty so i dont trust them. My first file had 2 RFEs, that second RFE which i never got, i even waited per instructions and did request online (that nothing was received, please resend it) request had no answer and denial issued after 2 weeks. I got all letters except that second RFE, i see it as a money making for government, they don't care. I suspect they can request now some documents form K2s country of origin and i will be screwed. And DIY is it a problem? I had a lawyer for motion to reopen, got money spent, denied and lawyer said good luck( kiss goodbye). RFE is a bad indicator, they again digging for something, all documents were sent per instructions, all proof they have from me, what they do is trying to bring me down,thats what is all about. Otherwise i would not have so much pain to go through it, never ending story, the process started 2019, soon will be 4 years, nonsense.

There is some activity now I received notification through the case tracker app, on my K2 that RFE was sent, but on K1 no any updates. When i log in to my USCIS main account there is no any activity, still the same : Case was received and thats it. Is it OK to get RFE only for K2? And what could this be? Request for original documents?? I sent my package almost same as first time( added few papers), first time there were no RFE for my K2 at all, just one RFE regarding tax transcript request. What are they doing there? One time is like this, second time is like that,( i dont even mention when they rejected my application due to fact that no priority date can be found on my initial i129F( approved i797c( there is no priority date listed). Getting stressed out with all this. Btw K1 is mother of my daughter which is US citizen through CRBA.

There is no interview notice, just this paper.

Small update, received this yesterday, Sunday. Does that means USCIS already at fingerprint stage?!? They received file 15 june, june 26 got this notice, lightning fast progress, or what is it?!?! First filing last year(2021)did june 21, but fingerprint were set for 10 September appointment, which is 2 months and 20 days.

Thanks to everyone who shared their knowledge and gave advices. Small update, i sent new i485 with all docs and fees. I sent on Tuesday 14 June and package was delivered to USCIS Wednesday 15 June. Today Tuesday 21 June my bank account was charged by USCIS and also same day today i got Notice of action i797c I find it very strange, so fast they did that, basically 4 working days(including the day when USCIS received package) only passed since they got package, quite aggressive they working on my case this time.

Does anyone know what this green paper means?!? Is it a notice to tell me i have only one last chance to file?!?

31st day after denial to court for deportation??? denied january 07 2022, motion to reopen denied april 24 2022, new i485 rejected may 24 2022, so when they can send to court???

I submitted everything as per instructions, and i sent notice of action I 797 that petition was received( not the approved petition I797). She does not have I-94, only blue stamp of the day when they entered US at same page where is K1. Question is what priority date they can not establish now?!? Confusing. All same documents i sent first time. Now i think may be they want I797 approval notice of I129f petition?! And will they proceed with immigration court for deportation?!? All is just a nightmare.

Yes married after 60 days, i sent i-129f notice of action, did not sent I 129f approval notice, i did everything exactly as i filed first time. USCIS never requested this first time when i filed i485.Did not list receipt number nor priority date. Cant locate this approved I129F petition letter, may be i lost it.

Good evening forum. My first post here, so help me God! Filed for K1 visa may 2019.She got in US april 2021 with K2. Filed i485 for both june 2021, got RFE(tax return from IRS for 2020) request july 2021, deadline was october 2021. August 2021 got biometrics appointments for september 2021, did that. While filing i485 in june 2021 noticed error on IRS tax return for 2020, filed amendment and it took until may 2022 to fix it for IRS. Did not respond to RFE(did not have proper IRS tax return), received denial of i485 in january 2022. Hired lawyer, filed january 2022 motion to reopen/reconsider.April 24 2022 got denial for motion to reopen. May 11 2022 filed again i485, new one, the same way i did in 2021, and got it rejected in may 2022. I attached the letter from USCIS. Honestly i cant figure it out what they asking for?!?? Should i submit in my second i485 that notice of action from my first filing in 2021? its not a rocket science but confusing
