  1. Fraud due to lying to CBP is the real issue here. I think that will be the biggest factor, whether you apply for AOS in the US or she leaves and you petition the CR1 —you seem to be in the same boat, either way, in the sense that she committed fraud against USA. You should really find an attorney who specializes in overstays and AOS, as they are going to have all the relevant experience that you guys need. I have a feeling AOS within the country is going to probably be the better choice between the two.

  3. Just wanted to chime in on the NHS part.. My husbands aunt is a UK citizen and a US resident ..she’s been in the US for the last 40 years or so. And funny enough, we were just having a convo about this last week lol. She said she was surprised when she came back to the UK this year to visit because she got sick and she thought the same thing—that she would no longer have full NHS access and would have to pay out of pocket. But, they ended up covering everything as they would for someone living there.
  4. Do you by chance know how long the police certificate is valid for use with the visa application? We are in the very early stages still, but would just like to have as much ready to go as possible.
  5. You need to explain your circumstances better to get a correct answer. How many dependents is your spouse going to be supporting? Is his job new or has he had the same position for some time? How much income is reflected on his recent tax transcripts submitted. Probably easier to have your spouse discuss these things on here to get a clearer answer. But, my best guess based on what I’ve read would be that since your lawyer is telling you that you need a joint sponsor, your spouse is not meeting income requirement guidelines for the number of people he is supporting.
  6. Ok, then research how to do these things on his IRA/insurance, etc. same thing.
  7. Sounds like you need to do some research on your end to make these changes. Easy to do, check with HR about making changes to benefits, look at IRS website, etc
