  1. Submit an Affidavit of Support with an explanation and proof of your pending Workmens Comp case. Also submit a co-sponsor Affiavit of Support from your dad with copy of 2007 tax return, 1099 forms, and statement of benefits from VA.

And the trickiest part is to package appropriately your explanation for not filing tax return and lack of current income.

Hi guys and gals, now it is my time to stress...

    Here is my situation:

I have been on workers comp for the past 2 years so according to my tax records I have Zero income. I am just starting litigation with workers comp on a settlement but it could take 6+ months to settle. If I go back 3 years on taxes I was off that year do to being a student and recovering from a different surgery. I am unable to return back to my prior kind of work due to ongoing medical issues related to my injury.

I had talked to my dad about being a sponsor for the I-864 and he said he would. So we requested his tax transcrips and here is were the problem lies. He is a medically retired disabled Vetren, is retired from the Airforce and draws SS. His monthly deposits are around $5000 a month for the rest of his life, more then enough for sponsorship, the problem lies in all but $16,000 is tax free. So on his tax transscripts he only claims $16,000. He owns a house but it has no equity and or just a little bit.

What are we going to have to provide to show his income for the I864? Bank records? Letters from the Vets Admin. and so forth? It's kind of a crappy situation to be in. My doc all along was telling me I would be able to return back to my prior work but after all this time I still have issues and the insurance compy finally said enough is enough. So i am stuck between this litagation and being unable to provide enough income proff. Any ideas?

    Thanks.

  2. What will Happen if your GC expire before filling for I-751?What are the penalties?

Here's my situation, My daughter and I filed at the same time (AOS)but she got her GC B4 mine. We are more than 90 days apart. Can we file I-175 together to save money?since the time I will file my I-175 her's will be expired by 7 days.

You meant I-751. Your daughter can be included in your I-751 so long as you and your daughter arrived together in the US. Filing fee is $465 + two $80 biometrics = $625 Total.
  3. To me, alot of posters who participated like that just wanted to increase their post count just to get a cool rank and the majority of them in the threads are in the OFF TOPIC section.

what is the purpose of getting "rank" on VJ I thought people came here to be educated about how to proceed with there cases?????????

That's what I'm wondering. Take a look at some of the VJ's top poster's posts, they're interested in posting some news headlines that probably no one wants to read or has nothing to do with immigration. We have TVs and newspapers for news.
  4. Hello..for my husband's plane ticket i am planning to book him a flight to honolulu via PAL and a connecting flight to LA via United Airlines....i wanted to know if Honolulu is what we are going to consider his point of entry?? is that where he would encounter all the immigration officers or would it be in LAX? I am a little confuse......
Honolulu will be his POE. They will take the brown envelope and if asked, his X-Ray from St. Luke's. (they did asked my wife's)

After he passes immigration, he'll have to claim his luggage (if any) as they don't transfer luggage and pass customs. Then he'll have to go to United Airlines section to check-in to his connecting flight.

  5. When my wife and daughter adjusted status here they didn't have biometrics until AFTER the AOS interview. I've also helped a few people from here and that's the way the local USCIS Honolulu office does it. At least from our island. We had the AOS interview in Honolulu and walked down the street and wife and daughter had their biometrics.

Only problem was they mixed up my wife and daughters A#s and it took two additional plane trips [about $500 a trip with hotel, taxis etc.] to get things right.

I had friends of mine who applied [K1] for AOS and EAD call the local office { I have the number after they screwed ours up so bad} and they were informed they would do EVERYTHING in one day also.

The local office is trying to save people here the expense of multiple trips to Oahu.

We even had to take a ferry to another island [Maui] to see a civil surgeon as we don't have one on this rock.

Yeah you have to pay bigtime to live in "paradise"!! Wish we'd stuck with the CR-1/CR-2 and not done K3/K4!

I was afraid to add up our total expense adjusting status but I know it was over 2K!!

Removing condition coming up in a couple months!!

Wife only tho as I adopted my "daughter" and she's a US Citizen now.

Yikes! That means another trip to ASC for biometrics!
  6. i heard having your medical at slec takes 2 days. im only available on mondays so i was wondering if i can have Day 1 medical on a certain monday then have Day 2 vaccination the week after (monday again)? or do i really have to go there the next day?
If you're going to do that, you'll have to go there early like a month or two before interview to avoid delays.
  7. Hi to all, i called Delbros today 02-339-2761 asking if my documents has been verified, and they tell me that they are just responsible for the delivery of the visa and that they have no access about the document verification (???)...they tell me that i should rather call the usem and they give me this # 1-909-101-7878 (the number i called to scheduled my interview)...then i did called this # and the usem call center operator at the immigrant visa unit tells me that once i received a confirmation from Delbros (This is to acknowledge the deposit you made etc...) theres no need to confirm if my docs has been verified as well as to fax the receipt to the usem immigrant visa unit, just bring the receipt at the time of the interview...that's all they said to me...

I'm just confused... as i've read some of the story here in vj that we need to confirm if our docs has been verified and for that it all went well at the time of the interview and no more waiting for you're docs to be verified.

So what was the real score about this document verification???

Did you asked to be transferred to Document Verification Deparment?
  8. I know I have not posted here in a while. But all is going good so far. My babe's interview with the embassy is on May 12th and her medical is on May 5th.

She lives in Butuan and the local Cebu Pacific office is over charging her to travel to Manila for the interview. Its about 2000 pesos cheaper to buy the ticket

online via Cebu Pacific Air. My question is that when i traveled last September with Cebu Pacific, they only wanted to see my passport and e-ticket...and that

was it. So could I save about 2000 pesos and buy the ticket on cebu Pacific website and email my girl the iternary. Anybody familaiar with Cebu Pacific's

travel policies, please let me know what to do ASAP. Thanks and god bless.

How much was the Cebu office charging? And what's the price online?
  9. anyone know how important bringing the 1040 tax return is. I havnt filed my taxes yet so I wont have a return by my interview. I have my W2 for 2007, bank statements, and pay stubs. Is it ok if I dont yet have my tax return?

Did you mean, for the interview of your beneficiary? Anyways, I don't know for whatever reasons you have of why didn't you file your taxes but during my interview before it was the first document that was being asked from me.

I have my w2 for 2007. Taxes are due on April 15 so I just havnt got to send it yet. I have the 1040 but not a return as of yet since I havnt sent it yet. Not sure why they would care about a return. I didnt have a printer and my local post office never had the form. I didnt think that would matter until just today when I was going over the forms. Hopefully a 2007 W2 and a filled out 1040 along with bank statements and check stubs will prove how much I make. I wont get any return for at least a month even if I send my 1040 tommorow.

Sure you can! If you send it out to the IRS, you can use the file copy.
  10. I got a message from a Compnay that helped processed our K1 Visa and state their to have the 2007 ITR first page should be notarized. . .

Do they really require this in the embassy during interview???

Because i have a thick record of his ITR in my hands right now , My fiance gave that to me while we are in Hongkong for a short vacation but it isnt notarized. . .

    Pls advice me. . .

    Thanks a lot!!!

Only the I-134 needs to be notarized.

  12. I think you meant 1099 for tax purposes?

Form 1099 is a form promulgated by the Internal Revenue Service (IRS) and is used in the United States income tax system to prepare and file an information return to report various types of income other than wages, salaries, and tips (for which Social Security Administration Form W-2 is used instead). The term information return is used in contrast to the term tax return although the latter term is sometimes used colloquially to describe both kinds of returns.

Each payer must complete a 1099 for each covered transaction. Three copies are made: one for the payer, one for the payee, and one for the IRS.

Most common 1099s are (to just name a few):

1099-B: Proceeds from Broker and Barter Exchange Transactions

    1099-INT: Interest Income

    1099-DIV: Dividends and Distributions

    1099-MISC: Miscellaneous Income

    1099-G: Government Payments

1099-R: Distributions from Pensions, Annuities, Retirement Plans, IRAs, or Insurance Contracts

  13. who came at him with a knife

just one of those bad choices

...or so that's what the off duty officer claims happened. It just seems illogical to me that if they both pulled over and he made it clear to the other driver that he was in fact a police officer, that this guy would so stupid as to come at him with a knife...unless he had a death wish.

It does happen...it's called "suicide by cop." Besides, the other driver wasn't behaving logically in the first place, considering he tried to run the deputy off the road.

True, although the other aspects of the story are more in line with road rage....one guy cuts the other off and the other guy retaliates. Hopefully a thorough investigation will get to the truth of what really happened. Was he going to make an arrest? If so, did he turn his lights on? Did he call it in? If it wasn't an arrest, why did he pull over?

I thought the article read that it was an unmarked, private sedan driven by the off duty officer.
  14. Who among you here lose weight or even gain weight for that matter once you get here in the states :P

when i was in phil, there's a lot of walking. inside the school campus, or after school, just walking to the nearby food chain, stores... plus a fast metabolism lol... i was 87 LBS or close to 90 when i got here last yr (jan. 07) but as of today my weight is 100 LBS. sometimes 102 if i really eat too much lol... ive got nothing to do except eat, sleep, and now im working at home, just sitting all day in my mini office lol... eating a bunch of junk foods and mind you both my husband and i are not vegie eaters lol. so no healthy food for us... any of you guys gained weight at all? most of my friends have, so its pretty weird... not that im sad about it coz gosh 87 LBS is pretty thin for american plus my mom wants me fat lol. im at 97-100 now so ive gained 10LBS at least and they still call me thin. size zero or worst double zero for petites...

cant live without ice cream in the freezer, gatorade, Hershey's kisses/bar, pringles and hawaiian sweet bread for my snacks lol...

so im the BIGGEST GAINER unless somebody can top me on that lol...

My wife was at 98 LBS when she came to Hawaii and now she weighs 125. Junk foods will do it. 100 LBS maybe still thin depends on your height. My wife is under 5'0 @ 125 which considers above avg.
  15. IS THIS TRIPS OF 3 MONTHS,THEN 4 MONTHS, THEN ANOTHER 4 MONTHS== 11MONTHS TOTAL OUT OF THE COUNTRY BEFORE FILING MY CITIZENSHIP POSE A PROBLEM?

PLEASE I NEED A RESPONSE SO I HAVE PEACE OF MIND.I DON'T WANT TO RUIN MY 3 YEAR PERIOD CHANCE

    OF FILING THIS CITIZENSHIP.

It's a gray area, and subject to discretion of the reviewer. If all three trips were in a single 12-month period, you might be penalized. If spread over the 3 years, you are probably okay.
  16. I cant believe it! I made it possible..Damn!That’s what I’m talking about.. I just talked with Grace from USEM..I called to ask if my fiancé interview date is already available. They got my petition Monday and hoping it will be available today that’s why I call..She told me that they are looking for April interview for my petition, but no schedule yet..I asked her if there’s any earlier slot? Then she ask me if my fiancé documents is complete..I said, he got everything already. We just waiting on medical and interview date..She gave me certain dates on February for available slot, and I pick Feb. 28..Then she told me to hold because she will ask for approval..They approved it! Yehey!yippeeeee :dance: My other half interview date is Feb. 28, 2008..She said also, they will deliver packet 4 at St. Lukes tomorrow, and my fiancé will pick it up when he will do his medical exam..I ask what time on Feb. 28, 2008. She said, they are open 7:30 to 4:30 so come anytime on those hours.. I am so happy.. I’m still shaking right now!!Like I said, when it comes to my love of my life, I will do everything!!..Thank’s God!...Oh my gOsh!!!What a relief!!!
That's great news! However you should go for your medical early in case something comes up. If something should pop up, you maybe delayed and would not be able to go to your interview. So go to St. Luke's early like this week or next week.
  17. HELLO EVERYONE,

MY HUSBAND AND ME ARE CONFUSED NOW.. HE FILED THE IR-130 LAST SEPT. 24,2007 TO NEBRASKA SERVICE CENTER AND HE RECEIVED A NOTICE OF ACTION FROM CALIFORNIA SERVICE CENTER. AND SO HE FILED FOR THE SECOND PETITION WHICH IS THE 129-F AND SENT TO CALIFORNIA,

IS IT RIGHT THAT HE MAILED THE 129-F TO CALIFORNIA SC WHERE HE RECEIVED THE NOA?

THANKS ALOT FOR ANSWERING OUR CONCERN.. :)

He was supposed to sent the K-3 (I-129F) to Chicago lock box. Did he received the NOA for the K-3?
  18. Hello! We are at the last leg of the petition process via CR1 route...but my 3 year old daughter is way behind, in fact her petition will still be submitted this Feb. 2008. So if I get an approved CR1 visa by April or May this year is it possible for me to fly to the US to see my husband and just stay there for 2 weeks just to make sure I don't go beyond the 6 month validity of the visa and then just come back to the Philippines and wait for my daughter's approval? Any input will be highly appreciated. Thanks.
    This sounds really goofy.

    1. You're coming to the U.S. on a CR-1 visa.

    2. The child's I-130 has not even been submitted.

    3. You want to leave the U.S. two weeks after you arrive, and go back to the Philppines.

None of this will work the way your query has been writtten.

    1. Are you on a CR-1 path or K3 path?

    2. If on a CR-1 path, you can come to the U.S., wait a few weeks for your Green Card, then return to the Philippines.

    3. If the child's I-130 petition has not been submitted yet, it will be 12-13 months for the child to get a CR-2 visa after the petition is submitted.
