  1. Hi Everyone, Something is troubling me today. Yesterday, I received a N-400 denial notice from the USCIS. I applied the N-400 last June and received an interview notice scheduled May'22. However, due to separation, I was no long eligible under the five year rule. Therefore, in April'22, I withdraw my N-400 application by sending a letter to USCIS, and resubmitted a new application under the five year rule, which I was already eligible for. Approximately two weeks after sending the withdrawal letter, I received a letter from USCIS notifying me that per my request, the interview was canceled. However, yesterday, USCIS sent me a notice says that my case that filed in June 2021 was denied. Although I requested to withdraw that case, will the denial notice impact my current active N-400 application? I was always under the impression that any withdrawal case's status would be "Withdrawal" instead of "Denied". Any thoughts will be very helpful! Thanks so much.
  2. If her income is under the filing threshold and she is not claimed as a dependent on any of your tax returns, she has no filing obligations. See IRS Publication 501 for details. Make sure both of her unearned and earned income are under the threshold, and she has no income under table 3.
  3. No need to worry. If you make less than the IRS threshold, you don't need to file a tax return. See IRS publication here: https://www.irs.gov/publications/p501#en_US_2021_publink1000220687. Make sure you read the Table 3 - Other Situations to ensure that you don't fall under any of those situations.
  4. Thanks! I will check “separate” and provide the IO a status update during the interview. I think the divorce should be finalized before the interview.
  5. No, just informal. Everything still together, joint accounts, credit cards, life insurance, etc. But we live in separate places now.
  6. Hello! I am about to file my N-400 based on the 5 year rule and I have a question on the marital status. Currently, we are separated and we will file a divorce in a month or two. Based on the timeline shared by other VJ members, it will take approximately a year to schedule an interview. If I check the box “separated” on my N-400 application and my divorce is finalized before the interview, could I change my marital status during the interview with the IO? Or should I finalize my divorce first before filing N-400? California has a 6-month waiting period for a divorce. I prefer to file my N-400 early, if possible. Many thanks in advance! Much appreciated.
