    I have supported him, I have been working with my illness.  Unfortunately, with all my medical issues, we have had to prioritize our finances, we pay my medical needs first, then  bills, rent, and whatever is left over goes to cost of living expenses.  He has not worked this whole time, just taken care of me, my family has helped alot too, we have proof of all of that. 

     

    We except that they will require more proof, which we have in spades, just want to make sure all of our basis are covered before we file. :)

  2. Good Morning All,

     

    I have a few quick questions in regards to my husbands AOS.   I want to let you guys know right off the bat it has been awhile since he came to the US, like 2008.  We applied, he came over, we got married in 2008, and then I got diagnosed with a major illness.  Much to say we did not apply for his AOS, due to my health.  Throughout this time he has not worked, been out of the country,  etc.   We can now file, but I need to know what forms I am going to need to submit, and if there is a possibility that due to the long time since he entered the country if we will have any problems. 

     

    I really do not want to loose my husband, due to me getting really ill,  and us not being able to file.   Any help would be great, we are going to file as soon as I know which forms to fill out.  I thank you all for your help in this matter.

    Presumably the 20 year GC is a typo?

    Will he be surrendering it?

    Are you aware of the sponsorship requirements for the UK?

    They have been tightened up.

    Yes lol that was a typo... he will not be surrendering it.. Our main question is how do I go back with him and the steps that we need to take.. to ensure that everything is legal and such... I dont know about the rules and such and ive posted on other forums without luck (ppl on this forum are sooo nice and helpful..

    My husband came here on a K1 visa in 2008, we have been married 5 years, and together for 8 year, and he has his 20 year green card already, I am a US born citizen. We are wanting to move back to the UK, in the next year, and I was wondering if anyone had any experience with this? What do I need to do to go over there legally, we already have a place to stay with his family, until we find a place of our own, and we have quite a bit in savings for the move and such. Do I need to apply for a spouse visa, or do we need to go over there, and I apply for indefinite leave to remain once we are there? I have read that since we have been married and together for so long that it will be quite easy for me to become a british citizen and such... Just curious if anyone has any experience, or can direct me to where I can get some more information on this.. All help is greatly appreciated, and I thank you all in advance!

    I need some help with applying for my husbands AOS... It's been 3 years since he has been here and he entered on a K1 visa legally, we got married within the 90 days, and he has not worked since then. We have had some hard times with the economy and me loosing my job and such. Now that we are on stable ground and everything we are going to start the aos process. My question is along with the I-485 and employment and advance parole documents, what other forms do we need to submit with our application. We are willing to pay any additional fees due to the issues and the long extended time he has been out of status. We have been very careful and abided by all rules and such, not working and everything, we have our lease in our name and he has bills and such that are being sent to our address. We have lots of things in our name and he pays bills for the house on his credit cards.. Please let us know what we can expect and any help would be grateful!! I am really busy at work at the moment and will try to check this forum as much as possible, but if I can't, and you have some helpful advice please email me at shawna.trevathan@sbcglobal.net !!

  6. Currently our situation isn't as straightforward as much paying out for the AOS, this has been a rather bumpy year and we don't want to compromise anything. I thought I would be better off asking, seeing as we are follow the very strict rule of no state assistance and not allowing myself to work. I wanted to find out a if it is possible to study in this rather blank period. It's just rather annoying how a 6-8 month AOS applying time turned into 2 and a half years due to the recession.

    Thanks for the swift replies, and I will make a note about the I-130. As I mentioned previously, I don't want to compromise anything that we have to do to complete the AOS.

  7. Currently we are still working towards the AOS adjustment for the Green Card. While out of status I have wanted to go back to school and better my education towards my future. I did a rather extensive search, but couldn't find anything on this subject, so hopefully someone can shed some light on the matter.

    My main question is, can you study while being out of status without compromising the AOS and Green Card status? I don't currently have any active visas, and we have been married for over 2 years. I just wont to find out if there is some legal way to study without compromising my status and green card.

    I have a quick question.. My husband and I just wed last week, and we are wondering when we need to file for the aos, as he's been here since May13 and the stamp on his passport says Aug 10 .. does that mean we have to file for the aos by that date, or can we wait until mid August to file ... Do you have to file for the aos within the 90 days?? Just curious..

    When I had to go through getting tax returns notarized and such, I just called this number to Request transcripts. 1-800-829-1040, here is the link to the IRS's website http://www.irs.gov/individuals/article/0,,id=110571,00.html When I requested them it took around 7 days for them to get to me . I did not get those notarized as they are official documents from the IRS, its easier and is one less thing you have to worry about! Hope this helps, good luck with the interview!!!

  10. We had a 4 hour lay over which was plenty time to get some food while we waiting for a 2nd flight. It was fairly painless for me but i'm sure there are people who have gone though and had a hard time. Depends I guess, thanks for all the good words :D

    Sorry for the late reply, yes i was living in Bristol, can't say I enjoyed it that much apart from the music scene which I played my part in for a little while. Well a few years but now I'm here in Houston and loving it.

    I've a quick question, I've posted in the AOS forum but ive not gotten much response... After Chris and I get married in June we are going to get his social security card, but he didnt get ead upon entry, we planned on filing for that with the AOS along with AP.. but what im wondering is will it be harder now since he doesnt have his ead to get a social.. is there any information that we have to bring with us .. I just want him to get his social so he can get a bank account here and transfer his money, also I want to put him on my medical insurance after we are married... any help would be greatful... sorry about posting this here but you guys all know us!!!

    We've just jumped forums so to speak, and are now in the process or are about to start the process of AOS. Ive a quick question here, as I tried the link to the form that shows that K1 visa holders are allowed to have a SSN announcement and such... I have found that there is a link in Captain Ewok's K1 Visa Flowchart for form RM 00203.500.. but that link doesnt work. I just dont want to get to the social security office after Chris and I Wed only to be told that he cant get one... grrrr hehe So any help with a link would be great!! Also, we are located in TX so if there are any restrictions that I dont know about other than that TX doesnt recognize the K1 for drivers licenses.. then please let me know.   14. So I have decided to share how the experience went for me while leaving the UK behind to be with my fiance. So the day started out early like most flights and saying goodbye to my family. It's hard to say bye to your loved ones but remembering you will see them again is something that really helps ease the pain of moving to another country. Packing my life into a few bags has proven to be an interesting task as you can fit quite a lot into a few bags and get away with weight limits. Either way we checked 1 30kg bag, 1 26kg bag, a apple imac in it's box and a guitar in it's flight case. We managed to get away with paying over weight fees on the 26kg bag so it must have been my lucky day only having to pay $50, I was expecting to pay at least $100 for both the heavy bags. So we said our goodbyes and wished everyone well and then passed though the security at Bristol Airport. We sat down for a little while in the departure lounge and then boarded our flight 20 minutes later to Newark Airport.

    The flight was pretty smooth, I don't like flying that much but it's mainly due to turbulence and some of the very harsh landings. Once in Newark me and shawna went though the security and immigration lines and had our passports scanned and checked. Once I had had my passport scanned the officer at the desk took my visa packet with passport and took me and shawna to a lift hidden being immigration and told us to give the visa packet to the officer on the lower level. Got out of the lift and handed over all the info but he didn't want the x-rays which I had been trying not to damage then we followed the office and sat down in a line up of chairs where the visa packet and my passport were handed over to another officer at the desk. We sat in the immigration checkpoint for around 5 minutes and then the officer called us up to the desk asked when we are getting married and "you know you have 3 months to get married" which we said we knew about. The office then handed over my passport and said enjoy your stay, at this point we made our way out to baggage claim to hunt down our bags and then carried on our flight to houston.

    The passport had my K1 I-94 stapled in the back with K1 written within the dated stamp of expiration. be sure to check this to make sure the stamp says K1 as there have been a few incidents so i've heard where they have written the wrong visa type in the stamp.

    The 2nd flight took forever, or seemed forever, I guess that's because I was sick of traveling and wanted to rest but now I'm here with shawna in this lovely humid but warm part of the country and we have plans to be married mid june. I hope this is of use to someone who is interested to what is coming up and what there is to expect when arriving in the US.

    This is the first time i've posted here as this is my fiances account but I thought I would tell you the cheapest way I have found to fly. A lot people don't know you can book though the continental website and buy flights from the UK to the US and other parts of the world.

    So far my prices have smashed all the above with £335 a full round trip which I will just try and sell the ticket back to continental if they want it. Either way, a single trip would have cost me around £550 or so.

    Also to drop the price in fairs as if your going one way do the return flight but make sure you come back on a Thursday and fly out on a Monday. While messing around with the website and dates we worked out the best way to keep ticket prices low. Seems Fridays, Saturdays and Sundays are all expensive, also leave around a 2 week gap in the return flight and the prices will drop me.

    One thing that did amaze me about the prices of the these tickets were they were only booked 2 weeks before I am flying out. Now that fuel prices have gone up i'm not sure if it's affected the prices majority but that's my suggestion.

    Oh one other thing, there is a transfer in the middle of the flight but if you can put up with that the prices will be much lower than a full long haul flight.

    I am flying back in May to fly back with my sweetheart, he just got his visa... My question is this, would it be okay if I told the CO that i am there to fly back with Chris to the states, and that he just got his visa?? Or should I just tell them I am visiting him?? I don't want to get turned away because they think that I am there to smuggle him out of the UK illegally :S ... any thoughts on what I should tell the CO?? I was just thinking of telling them that I'm there to visit friends... what would you guys say? I was thinking of bringing copies of our NOA's and such and a letter from my employer that I am still employed there and such and my most recent paycheck stub and my lease agreement., showing that I will be coming back... Just fretting over this.. though I am probably fretting over nothing... hehe Any suggestions would be great!!

    Yep I'm flying back May 8th to be with him as he says goodbye to his family and friends and see them all one last time!! Help him sort out the rest of the odd ends that are left, and then we are both flying back together on May 12th!!! Wedding will be in June near my birthday!!! Can't wait to make the trip back to England to bring him back!!! It's been such a long journey and its finally over, and he will be here with me!!!! :D

    I just got a call from Chris, he had his interview at the London Consulate, everything went smooth other than the wait!!! He was granted his visa :D , and should get it within 5 days!!!! Yayayaaa I'm so excited right now will not get back to sleep!!! Thank you everyone for all the help, and kind words along the way!!! I am flying out on the 8th to bring him back on the 12th for good!!!! EEEEEEEEeeeeeeeeee I'm so excited my baby has gotten his visa!!!!! Words cannot describe this!!!

  19. Chris was Approved today!!! Just got the call yayayaya :D I'm so happy excited and my baby is finally coming home!!! We are making travel arrangements as soon as he gets back today!!! And then I'm off on the 8th to England to fly back with him to our home!!!!! I wish all the same speedy and best luck in getting your visa's !!!
