Hi, I don't have a solid reason besides just to keep H1b going until vawa is approved. I just have lot of anxiety about this matter even though my lawyer says I have a strong vawa case etc.. I have no criminal history or any inadmissible on any grounds, I have PF approved as well. I never filed for marriage based GC with my spouse i130

I applied for vawa and received EAD/AP have a valid h1b that I am currently using to work. I want to travel and my vawa attorney is recommending to travel on vawa Advance parole and instead of my h1b. He says if i re-enter on h1b, I will abandon my vawa i485 application and so does one more lawyer but I have a valid status (h1b). I consulted with one other attorney and she said since I already have a valid status I should be able to travel on my h1b visa without abandoning my i485 through vawa. I also read on CBP site (link below) that I can travel on h1b visa with approved AP on based on pending 485. Anyone in the same situation ? please help .

Thanks 🙏 I was unable to post on there. My lawyer is very arrogant, so every time you try to contradict him he gets defensive, he is a good vawa lawyer tho. I need to find a diplomatic way of talking to him. Thank you so much for your responses.

Did you had approved AP based on pending 130 when your entered using h1b?

Thanks, that would make sense but I don’t know why he keep saying that and I don’t want to do something he is not recommending since vawa is a long process. 

Right!! I know for the fact that with (approved i140 and pending 485) you can re enter with h1b as opposed to AP. I have seen people do it all the time but I am not sure how it works with vawa based 485/AP.

So i got the rfe of bonafide marriage and GMC. My lawyer is requesting supervisory review as there was plenty of evidence already attached for PF. I also sent FBI report. what do you think will happen now, would i get my first PF ? and perhaps EAD in 8 months ?

Hello Everyone,

I received an RFE within  a month of filing vawa petition, my lawyer is still waiting to receive letter from uscis. But is it normal to receive rfe this early in the process ? If yes, what is the rfe might be for ?

I submitted substantial evidence of all kinds but i didn't submitted fingerprint based police clearance letter it was a web based search, I have a good lawyer but i am still worried. Also, my marriage was short so we didnt really had finances together but we dated for almost 2 years before marriage and i provided all evidence of travel together etc...
