  1. OP here. To follow up on this, we just got married on Aug. 30 :))) and we managed to get her a ticket back to China via Hong Kong, which is a little more complicated with extra quarantining, but the airfare comes to only $2,200 instead of $6,000. I need to return to China later this fall for work, so there is no point in applying for green card now. Thanks again for your help.
  2. Thank you, both. So, unlawful presence is a bad thing.... and would look bad on her record. Are there any potential consequences, or is it just bad in name? It seems odd that they would give you 90 days to marry and then zero more days to submit the application, since marriage certificates take some time to get.
  3. Hello again all, I found this wonderful language on the USCIS page. Can anyone tell me what this means? Doesn't this language contradict itself? Is it or is it not OK to mail the application after the 90-day mark? Our marriage certificate probably won't be ready until after the 90-day mark, which we need to adjust status. Is that OK? Thanks.
  4. I was in China at the time of interview. No attorney, just followed the directions very carefully.
  5. I was not at the interview, so I don't know exactly what CO asked, so I can't help you there. But I'm pretty sure my fiance did not conceal anything or mislead. At the time of filing, I had been living in China for 3 years. I know she brought copies of my employment contract, which expired about a month after her interview date. Every year it is uncertain whether the contract will be renewed. In any case, we definitely DO intend to marry and live in the US soon, but we might spend 1-2 more years in China before that happens. But I will also say that I gave my fiance plenty of evidence of US domicile, e.g. several bank accounts, investment accounts, etc. I am actually employed by a US university, too, so my paychecks go directly into a US bank. I also gave my most recent US tax return for 2020. I think all of this makes it clear that I have significant ties to the US and plan to return.
  6. We did not use it as B2. There was a 50% chance my contract in China would be renewed, so we did not know if we'd be doing AOS. The delay on the marriage is because we're trying to work out the details of the international prenup, which has been more complex than we anticipated. I'm not sure what "domicile" means exactly, but I am a US citizen and lived here until 2017. I am on a year-to-year contract in China, and after that, I plan to return to the US, so maybe I do have domicile here.
  7. We didn't buy a return flight right away because there were so many uncertainties about our situation. Can I ask what flight that is that connects in Doha? I don't see any such thing. Thanks!!
  8. Hello, my Chinese fiance is currently in the US on a K1. Our situation is unique because even if we get married within 90 days, we both need to return to China in Sept. for work. (Her 90 days is up on Sept. 13). However, the flight tickets to China before that point are at least $8K, which is about 15x the normal price. Does anyone know whether the USCIS has issued a waiver for this situation, or if we can apply for extension due to these extenuating circumstances? Thank you!!

  10. Hello, my fiance is now in the US on a K1 visa from China. And it's become clear that I'll be returning to China for work in September or October, which means we won't adjust status for green card. However, I am wondering if there are any advantages to getting married in China instead of the US. In the future, I will probably be working in China for the next few years at least. We were hoping to get her a B2 visa to visit the US with me during summer. Please let me know any advice you have. Thank you!

  12. Sorry to hear that. We checked for appointments about twice per day, and I think after 2-3 weeks of doing that there was finally an appointment for April 21, so we grabbed it. Not a great system, of course, but you just have to keep trying every day (or multiple times per day), and something will open up.
  13. Hello, we were originally scheduled for a March 21 interview but had to cancel due to Covid. Since then, we've been trying to reschedule but always come to the page that says, "No appointments available." Is this normal? Is there a problem of some kind? We are confused because originally there was no problem getting an interview only a few days out. Now it seems impossible to get any appointment. After emailing the consulate, they only reply, "Please note that appointments are at the discretion of the Consulate." Please let me know if you've had this experience.
