    Your question is confusing. If she has a SS and was born here in the USA, then she is a US citizen. You will need to clarify your question, so we can answer it correctly.

    Hello everyone,

    Recently submitted a joint ROC and got an extension for one year. The Roc was submitted even though we are separated and didn't choose the waiver option when the forms were submitted. Now that the forms are submitted, what can I do to change it TO the waiver option( i.e filing it by myself not joint)secondly can I file for divorce now or wait till the roc is removed and I have my 10 years green card. I need help pls

    If she is married - she cannot use the K-1.

    Was she a student, got married in the US, and now wants to AOS?

    If she was a student - what was written on her I-94? If it says "D/S" only an immigration judge can state she is 'out of status'.

    She should be in the process of doing the AOS - where is she at on that?

    Bobby you are on point. The 1-94 says D/S . She is some forms already filled. Her 1-20 expired last year may and on one of the forms the ask for the expiration date what should she write there. Secondly they ask for the expiration date of the i-94 what should she write or just write DS

    If she is married she can't apply for a K1. Did she come on a K1 in early 09 and then not marry until the end of the year ? Did she marry the petitioner ? If she married the petitioner she may be able to file a cr1 ( the k1 is dead if she doesn't marry in 90 days )

    Thanks for your help. She came on a student visa but they have been dating for 4yrs now they just got married in Dec 09. Even if it is cr1 what do they need to do now as per the forms needed . Please help

    My wife just went through it. I will suggest you go for the medical check up quickly. It is a busy place so go in advance. Have your pictures, phone record, even if you use a phone card take it along. E mails. I did not send any financial record, they already have my ds 230. I only send the receipts of western union. I think you just have to make that you know your wife in and out. Have the confidence that you have the visa already you just want to n pick it up. If have any other question feel free to pm me

    She should be getting her greencard in a few weeks.

    In the meantime she is able to use the stamp in her passport to work, get a driver's license etc.

    My wife arrived on sunday from Nigeria on a CR-1 visa we are just 1 yr and 1mth in our marriage. The questions is this, is there any other documents I need to file to get a her a 10 yr green card. Can she work now or I have to apply for her to work and finally is she going to get her 2 yr green card immediately or we have to file another paper

    My confusion is about that appointment too. I thought that the CR1 visa recipient automatically got the greencard once they enter the US.

    Sorry for the confusion. You already no my case we just got our visa and my wife is landing in the state tomorrow. This person is a very close friend of mine. She came on fiance visa and I think they have to go for series of interview b4 they can get the green card. So far things are not working very well for them that is why she is using my user's name to ask questions. I am really sorry for the confusion. What I will suggest is for her to register and then ask her question under her name, so as to avoid this error in the future.

    I really want to thank God for all He has done. Today my wife's visa was granted in Lagos. I am so excited my joy is overflowing. I want to thank the admin for the wisdom to put such a forum together, my thanks goes to everybody who advice and encouraged me. I pray the same Lord who did mine will do yours.
