Yes we were notified last week that retrogression has taken place and our priority date is no longer current. So they have returned our passports to us and will contact us again once the priority date becomes current. I have no idea when that will be. New fiscal year only starts 1 October. So maybe some time after that.

    That’s really a sad news

Wow, that's a very long time to wait.  We're on 38 days since our interview.  Status still says "Ready", no updates to the case on CEAC since the interview.  No issues with medicals as these were on file when we attended the interview, no other documents requested.  I've contacted the consulate on numerous occasions and they simply say the case is being processed and they'll notify us when it has been completed.  No idea whether this means we need to wait days, weeks, or months.  Quite frustrating.  In the mean time they still have our passports so that's perhaps the only positive here...

Most probably the Consulate will be waiting for the Security Advisory Opinion which has to be given from Washington.Nowadays it’s mandatory for Immigrant Visa.Just wait…….you can expect the visa in a couple of weeks.

Hello. We had our EB3 interview in Auckland on 4 May and our status has not yet changed online.  Still shows "Ready", same as it was before the interview.  I have checked with the consulate and they say the officer is still adjudicating the application.  How long after your interview was your visa approved and issued?

    Hi,

Our online status changed from “Ready” to “Refused” after the interview.100 days after interview the status changed from “Refused” to “Administrative Processing” and 102 days after interview the status changed to “Issued” and on 105 th day we got our passports .

    Regards

    Benita

Yes our passports are with the Consulate.I wrote a mail to the consulate to know whether my medical reports have reached the consulate and they replied as all your medical reports are on file.

After 95 days today our status changed from “Refused” to “Administrative Processing “

It means VO kept your passports after the interview? I think it will be fine for you. At least, they kept your passports.

Have you contact to the hospital to know the date the hospital did send your reports? I saw some thread, a lot of people have stuck in the Embassy like you because they don't have the medical report at the time of interview. In Dublin, they are waiting for 2 months because of that.

Most likely the administrative processing has nothing to do with the medicals because medicals are normally not a reason for administrative processing. The consulate can simply look at what was provided in the medical exam and make a decision.

Administrative processing is usually for security reasons, where they need time to conduct additional investigations. It often happens if your name is similar to the name of someone who is suspected of having ties to a terrorist group or if you work in a field that is on the Technology Alert List (TAL). If this is the case, all you have to do is sit tight and once they've verified that there is no national security risk, they will notify you that your visa can be issued.

Thank you very much for the information

Right.  It is the medical results.   Like I said.

I don’t think it’s the medical report because our medical report wasn’t there on the interview day.VO told after interview that everything seems to be fine and I will take my final decision after your medical report arrive. We did our medical the day before the interview.May be medical report will be along with the remaining packets. He gave 5 packets after interview and informed rest of the packets will be delivered with the passport.

Oh, I got it. As you said, I think it was checked for the hospital and your company. Please keep in touch, if you have any update, please share. If my friend has any update about his AP, I will share with you.

    Sure.

I feel sorry to you. I don't think this is a reason for AP ("I think my case was transferred because I am from a third world country (India) and applied for the immigrant visa from Germany.") because I have a friend who interviewed in the 3rd country like you, and he didn't get the AP.

Do you think you have any problems in medical results? Sorry for more details, I just try to brainstorm with you.

I am waiting for an interview in the 3rd country too, but I have only the job offer, no contract. Worried about it.

If there was anything wrong in the medical report VO could have simply refused my Visa and return my passport. What’s the need for Mandatory additional Administrative processing?

I think in your case job offer is enough.

For Health care workers a recruiting firm is our sponsor and we will be working in a third party client site ( Hospital). That’s why I have job contract with the Recruiting firm and job offer from the client ( Hospital).

My friend is pursuing EB2-NIW (self-sponsor). He failed to give them the plan when he will come to US such as a job offer or being a potential employee.

Can I ask you, the case is transferred to Washington for Security Advisory Opinion for what? Every case will be transferred to there when got AP?

As you said, they asked you show the job contract, it means you are working for the company (Germany branch)? I think you just need the job offer instead of the job contract?

My employer is my sponsor.I’m not working here for an American company.I’m a nurse by profession.I had both my job offer and job contract. There was nothing wrong with any documents from my side.If so VO would have asked to submit additional documents.

I don’t know whether every case will be sent to Washington for Security Advisory Opinion.I think my case was transferred because I am from a third world country ( India) and applied for the immigrant visa from Germany.

My friend who interviewed in Japan got AP for 3 months like you. No news now :( Sorry. Btw, can you share your interview experience? Was it smooth or was there anything else wrong when interview?

Interview was quite normal.VO asked only about my job contract .He was convinced and everything was over in 15-2.0 minutes .He even handed over 5 sealed visa packets and informed the rest of the visa packets will be delivered by post along with the passport .I think our file was transferred to Washington for Security Advisory Opinion.

  12. I am an Indian Citizen working in Germany.Myself and my family (spouse and 3 kids)attended our immigrant visa (EB3) interview at US Consulate Frankfurt on 2021 Nov 04.After the interview the Consular officer told everything is fine and he will take his final decision once the medical report reaches the Consulate. He also handed over 6 out of the 10 confidential visa packets(sealed yellow colour) to me and said Consulate can only send packets upto 1 Kg by post and the rest of the confidential visa packets will be delivered by post along with the passport.

It’s almost being 2 months and the status is reflected as Refused. After a month I contacted the consulate via email and they informed that my medical reports are on file but my case is under mandatory additional administrative processing.

Have anyone of you gone through the similar situation?

    Thanks in Advance
