    I'm not in a good mood, we need your help.

    Today I came home from work to find this letter from USCIS asking us for more documents to prove that we are in a bona fide marriage, are they crazy???????????????????? what's wrong with them, I feel insulted by this stupid letter. They are giving us until January 7th to submit extra documentation. We have no idea of what else to submit.

    We sent them already:

    - 3 letters notarized of family and friends.

    -Copy of our joint tax return.

    -Letter from hubby's company (life insurance)

    -Copy of our Visa card showing a joint account.

    -Copy of health insurance cards showing a joint policy.

    -Copy of airline reservations for a vacation we took together to Peru last year.

    -Pictures of trips, New Years and diffrente celebrastion.

    -Pay checks of hubby and mine showing our current address.

    Maybe I made a mistake opening my own checking account???

    We don't own our apartment, we pay monthly.

    Any suggestions? Hubby is freaking out, he thinks that we made a mistake not hiring a lawyer to help us with this process but I thought that that wasn't necessary.

    Another thing you might want to add is a letter from your work stating that your status at work is married and also your husband is mentioned as a emergency contact person. Your husband can also get a letter like that from his work.

  2. When you apply for removal conditions you need to be married that is very important, and you supposte to have an interview with immigration together with your wife, and you need to prove that you have been living together, and that you are going to be together.

    I mean that is why we get green card first for 2 years if is marriage less then 2 years. They wanna make sure that we are not getting into marriage for other purposes.

    Anyway, I think that they going to deny you. I am sorry.

    You don't seem to know that much about Removing Conditions, so please don't mislead people. You don't need to be married to file for the removal of conditions. You can file after the divorce is finalized and if one can prove that the marriage was entered in good faith then 10 year green card wll appear in mail soon.

    In this case my suggestion would be to hire a good immigration attorney.

I'll definately get the stamp before travel.I was just wondering Do they still require you to have expired green card with you.Yea My Lawyer gave me bad info.My Wife wont let me go untill she is satisfied that immigration will not give me anyproblem at the airport.I did'nt know before filling that NSC is moving so slow.Thanks Guys you are helpfull than any lawyer

    Just go and get I-555 stamp and you will be fine. Also tell your wife to relax there is nothing to be worried about ;)

  4. I don't think you can travel without it..... so you might have to wait till you get your 10 year green card before you travel.... there is a stamp you can get in your passport but I am not sure if you still need your green card to travel, maybe someone else will know better....

    as for your lawyer I think he gave you bad info... I don't think they ask for the expired card at all..... they never asked for mine

    They take your expired GC away when you go to get your passport stamped. To reenter US all you need is either expired GC and the extension letter or the extension stamp in you passport.

    I guess at this point you don't have many options left other then going at your local USCIS office and getting I-555 stamped in your passport.

I used the letter twice now to travel: 1) United Airlines representative didn't understand the letter and it took forever until they let me actually check in in Frankfurt, no problems with immigration in DC - I got through within 2 minutes, 2) no problem with the airline (Lufthansa) but 2 immigration officers in DC didn't understand the letter and I ended up spending over an hour in secondary inspection until they got their supervisor to verify my status. :blink:

    Did you show them your expired Green Card as well?

    sure - without it you don't usually get very far, no? :blink: the card isn't the problem - some people have trouble with the letter, thinking it's fake or something?

    If you take the extension letter and face the light, you will clearly see 5 or 6 seals through it. I believe one can find it hard to fake the letter.

  7. all we sent in was the copy of the return we got from the accountant and just the page that showed we filed jointly... we didn't send in any W-2's.....

    it is weird that they seem to expect different things from different people :unsure:

    my case was pretty quick, I wouldn't judge your progress by how fast mine went....

    Feb 3rd, 2007 - Mailed off Removal of Conditions package

    Feb 7th, 2007 - Package was received and checks cashed

    Feb 27th, 2007 - Received NOA

    Feb 28th, 2007 - Received Biometrics Appointment letter

    March 13th, 2007 - Biometrics Appointment

    March 24th, 2007 - Card Production ordered

    March 27th, 2007 - Email, stating that a notice was mailed that they had approved our petition

    March 29th, 2007 - Green Card received in the mail

    this was the list of evidence we sent in....

    copy of baby's hospital certificate (this was not the birth certificate, just the paper we got from the hospital that hubby used to add the baby to his health care insurance)

    copy of baby's death certificate

    copy of rental agreement

    copy of car insurance

    copy of one recent joint tax form

    copy of 401K that states that I am the primary beneficiary

    copy of health care statement showing that I am covered under hubby's health care insurance

    copy of one recent gas bill

    copy of one recent phone bill

    copy of one recent cable bill

    copy of recent bank statements

    copy of paper showing that hubby added me to his bank account

    Copy of some bills (Sirius, Netflix etc) with just hubby's name and our address on it

    Copy of some bills with just my name on it and our address (recent electric bill etc..)

    Some envelopes with both our names and address on them...

    I wish they were as quick with others, it would have made our lives much easier.

    Which service center did you send yours?

    So far my time line is this

    Sep 17, 2007 - Mailed off the package

    Sep 18, 2007 - Package was received

    0ct 14, 2007 - Received NOA

    oct 18, 2007 - Received Biometrics Appointment letter. Appointment scheduled for 11/03/2007

    oct 23, 2007 - Did a walk in Biometrics

    Oct 24, 2007- Case touched

    I'm going back to Rep OF Georgia with my wife for new years at the end of December. I know i can use my NOA to reenter US, but it would have been nice to have 10 year one prior to my departure.

  8. Hello everyone,

    I had received two NOA letters back on the 31st of october and I had thought they were just duplicte copies, however while checking it again I have found out that the recepit numbers are different. I am unable to pull the status of thoe both of them on the USCIS's website since I still have not received my wife's biometrics appt. My question is was this an error on USCI's side or am I missing something. Both of the letters came from the California center. I thought we would get the biometric letter by now, but still nothing.

    Any help would be great!!

    If i was you i would make an infopass at your local office. You can also call 1800, but from my personal experience these guys suck. I don't think it's something to worry about, but still with USCIS you always want to be on a safe side.

    I think you should be fine, but to be on a safe side just go ahead and request a transcript. That's what i would have done if i knew this much before sending my application.

  10. I will send my package soon to lift my conditions on my green card. i tried calling IRS to get transcripts but i cant go through, which options should i select? i phone this number: 1-800-829-1040, please help me what option should i press next. thank you so much

    I just mailed the request form. According to them it shouldn't take more than 10 days.

  11. The Printout from HR Block does not show you have filed a tax return it just shows that you had HR Block prepare your taxes.... The tax transcript from IRS is 100% proof that you filed for that year and you do not need to send any additional evidence such as W2's 1099's

    I guess at this point i just have to wait for RFE and meanwhile i can request the transcripts from IRS. I only sent the 1040 with no W-2 :unsure:

    When you originally sent the I-751 did you send tax transcripts from the IRS or did you send a copy of the taxes you filed? It seems from other posts on VJ that they request W-2's if you sent a copy of the taxes filed (ie, the 1040, etc.), and not tax transcripts. I'm not syaing they always do, but I do remember seeing some similar threads awhile ago.

    What's the differences between taxes filed and the tax transcripts? I have delt with taxes only twice in my life so i don't really know how things are in terms of tax filing.

    I guess the difference is a tax transcript comes from the IRS, and it verifies a person has filed their taxes. If you just have a copy of the 1040 that you submitted say via paper to the IRS then that does not prove that anything is actually filed. I would guess an e-filed tax form would have a confirmation proving it was sent to the IRS.

  14. You can have the transcript faxed to you if you have access to a fax machine... if you have them mailed they only take about 5 days to get..... I would sent the transcript.. that is what they prefer if you want to send your e-filed tax return you will need to include W2's...

    I'm not quite clear what's the difference between e-filed tax return and the tax return that they give you at (H&R) block. Does one have the w2's included and the E-filed one doesn't?

    I sent in the print out that i got from the local H&R office, but forgot send the copies of W2.

    FVA, yes, I'll be applying for citizenship next year. Right now we're working on my husband's adoption of my son. When that's done we'll be applying for my son's Cert of Citizenship (N-600).

    So, I'll be around for a while. :)

    I'd really like to get this list to grow and I know that there are other CSC transferees out there who are now filing for removal of condition. I just hope they come and give their info so I can add them to this list too.

    Did you send the W-2 with your income tax return? Someone posted that they got RFE because of not sending their W-2.

    I wonder if there is anyone who got approved without W-2. I thought all they required was the income tax returns.

    I got a REF on I-751 saying to send more evidence. They want w2 and all leases we had in all 3 places we lived since.

    forgot to send W2 with tax returns.

    Filed 20th october, came back check had cuttings on it. sent again 15th november, 2006

    bio jan 25. since then nothing and finally REF in november 2007.

    sent plenty of other evidence, seemed never enough.

    any body know how long it takes once Ref sent?

    Didn't realize they required Tax ####### for the I-751 as long as you show you have a bonafide marriage with other evidence.

    Leases do show you lived together.

    I also can understand joint returns will help show such better.

    got my wife's NOA on Thrusday which is great.. we are planning an international trip very soon. My question is how long after the NOA do we get the Biometrics notice? I just don't want to plan the trip and then while we are away we get the Biometrics notice and miss it. If you miss your Biometrics date, can you retake it again at a later date?

    Usually bio notice arrives a week later from NOA.

    You might be able to do a walk in at your local CIS office. My Bio was scheduled on 11/02/2007, but thanks to the staff members at San Francisco office i was able to do it on 10/23/2007. You should give it a try.

  19. URGENT: Advice needed for international travel

    I filed an I-751 application in Aug 07 to have the Conditions on my Green Card (through marriage to a US citizen) removed. I simulataneously filed an Advance Parole application for international travel while my application is being processed ( I was not aware that I didn't need to file Advance Parole).

    I did not receive a Receipt Notice for the I-751, but only an Appointment Notice for this application to have my Biometrics done, which I completed in Sep.

    When I tried to expedite my Advance Parole application, USCIS sent me a letter stating that I only need to get my passport stamped from the local office and can travel with this stamp and the I-751 Receipt Notice. I recently visited my local office and got the I-551 Stamp, which is valid for 1 yr. However, they took my Conditional Residence Green Card as it was about to expire and said it would be sent to the Service center where my application is being processed. I called USCIS Customer Service regarding the I -751 Receipt Notice, which I never received. However, they said they do not issue duplicate notices.

    At this point, I only have a photocopy of my conditional residence card, the I-551 stamp in my passport, and the I-751 Appointment Notice. Could someone please advise if this documentation will be sufficient to renter the US after travel overseas. Will I be ok without the I 751 Receipt Notice?

    The notice clearly states that your conditional green card has been extended for the period of one year and also it specifies that within this one year period you are authorized to work and travel. Just take a close look at it.

    All you needed before was your passport, expired GC and the letter, but now you can just carry your passport with the stamp and it will serve the same purpose.
