  1. Yes, I was approved eight days after they received the exam.
  2. Hi, We recently adjusted after the i130 was already sent to NVC. We contacted the NVC through the public inquiry and they said that they won't send the i130 back to uscis preemptively but will only do so after uscis requests it. In any case, we just had the adjustment approved, while the i130 status is still "case was sent to the state department." So it seems like they are doing it on their own and perhaps it does not require anything since the i130 was filed online and uscis still has access to it from the online account. All this is to say, don't stress about having uscis recall the petition from the NVC. I stressed about it and contacted both uscis and NVC and in the end they just approved the 485 when they were ready to adjudicate it.
  3. So, I sent it in April 19, one day after the email. They received it April 20. Today I got an approval notice. No official RFE, just the courtesy email.

  5. After RFE, I know of at least one that got approved within 14 days in our field office. A friend from here. But she did indeed receive an RFE. I am curious to know whether anyone that followed their email's instruction and got approval. Also, others that sent following email and then received an RFE, did they ask for a second sealed envelope from their civil surgeon and send another one? This is all very confusing.
  6. Thank you for your reply. Do you know if people have been approved after sending the exam following this email rather than RFE? I take it this email is a new thing? I am really hoping this will start the ball rolling as we are moving to Atlanta in June, and their processing times are somewhere between forever and eternity.
  7. Hello, I adjusted from an E-2 Visa. I recently received an I-693 Courtesy Email from my field office. This is not the deficiency notice which I received a couple of months ago. This specifically states to send my I-693 to the field office. On the one hand, I don't want to delay and wait for an official RFE if this serves "like" an RFE and can be adjudicated promptly following submission. On the other hand, I don't want to send without an RFE if one is still required and to have my medical exam lost as per USCIS horror stories. Note the language under "how to respond" and the bolded language there. Disregard the generic info re I-130 as my I-130 has already been approved (I filed under consular processing but moved to the US through my employer and ended up adjusting rather than using NVC). I know that many have received similar emails but I am not sure I quite understood what the bottom line is for this matter. Have others waited for the RFE or sent their docs?   9. That's very speculative, no? I could also sell above asking, which still happens here, even during these last couple of months where there's been a slowdown in the real estate market... Hypotheticals shouldn't deny an i864 imo
  10. Thanks, once more, for your detailed reply. We have owned it for less than a year. We recently (March 2022) moved back to the US from abroad. We owned a home abroad, which we sold. We purchased a home here using the proceeds from the sale. Included the deed, mortgage statement, remaining balance on the mortgage, and the appraisal which was used by the lender for closing. I did not use realtor appraisals as it was included in the licensed appraiser's appraisal. Property tax assessment was not provided as I received it following the submission. As for income, I included the total income line from my tax returns for 2021, 2020, and 2019. My current individual annual income I put down 0 as I have been unemployed since March 2021.
  11. It is about 30k over the 125%*3 (income requirement, which in our case is the difference between the income and the requirement as the income is 0 multiplied by 3). That alone is more than 125% for a household of 3, had we used income.

I can resubmit but it really was clear as day that we are using the home only as it was written in the cover letter, included an appraisal, mortgage balance, and the current individual income was 0. And as mentioned, if the RFE is denied then I have to resubmit and pay the fees again, so it may just be easier to get a joint...
  13. I submitted my AOS package not too long ago, but my I130 has already been approved. Presumably, the heavy lifting of proving the legitimacy of the marriage has already taken place and the more technical in nature docs like 485, 864 etc. will be pretty quick? Just my hunch. As for my RFE - I submitted an affidavit of support with tax return transcript for 2021, house appraisal from May 2022, remaining balance on mortgage for June, all showing the equity in the home, even writing down in the cover letter what the equity is after deducting the loan amount. I am really at a loss here. A side question - and I have looked in the forum for an answer for this but have seen conflicting answers - will the 765 be held up until resolution of the 485 RFE?
  14. Thank you for your response. Household size is 3 as we have a toddler. Included 2021 tax return transcript. Did not include W2 as worked in 2021 abroad and there are no W2 equivalents. Mentioned this on the cover letter. Asset is indeed primary residence, but as mentioned, it is well over the 3x the difference and we included a license appraiser's appraisal from three months ago. I am at a loss here.
