  1. I am sorry to hear the response they gave to you, Devine Mercy. It seems to me they are leaving you with no choice but the CR1 route. And it seems I will have to follow some of your steps, at least the part of contacting my senator. My process for NOA2 is about to turn 180 days old... although based on your experience, that may not make any difference. I am hoping a call to CSC (like the one Deb did) will help get my process adjudicated.

    Calling CSC did work for me. They have been working on my petition since Wednesday of last week and they were even working on it Saturday as well, so I should be seeing an approval in the next week or so I think.

    hmmm So they are adding together the time it takes to get the interview for a K3 WITH the time it takes to adjust the status. I'm only seeing the time it takes to be with my husband. Are they really this stupid? (yeah i know the answer to that). They really only see things in terms of paperwork don't they. They don't realize they are talking about real live human beings. I guess it means nothing to her that my son doesn't care if his dad is here and not able to work, he only sees that his dad is here. They are total #######.

    Wow, Wow, Wow!! This is terrible. You are so right. My mind is blown too regarding their opinions and trying to play "ruler" over this based on their opinions. I really thought it was up to you as to which route you choose to continue. Some have let go of K-3 route..but that was their choice. Really you and your family are in my prayers.     A question, what happens, when I don't get no answer from USCIS? It means, is it anything wrong with my petition!?!?

    They make me very sick. :wacko: why don't they give a new status after each case-touch, then we will know in which

    situation our cases are?

    This was my last time that I deal with immigration. I don't want to lose my health because of it. I never haven't been

    depressed and haven't had insomnia. But now, everyweek, I am depressed and have insomnia. :crying:

    sorry, I like to say very polite that they are arrogant and absolutely idiot. These people don't have a feeling and a family at all.

    why don't they want to optimize their daffy system? there are a lot of patterns for that in the world. No counteries have

    such a bad system.

  2. Hello everyone,

    I hope everyone is having a great week. I don't think too many people are left to write on this thread but me. I am really feeling lonely on this thread since most everyone on this thread has been approved but me :crying:. To update everyone, I just called USCIS and she assured me that our petition is now on an adjudicator's desk and of course, they felt the need to tell me that I just called on Nov. 30 and that I should give more time than just three days for them to approve the petition. I let her know that I was calling to find out if it was actually on someone's desk and now that I have that assurance, I am satisfied and will let them do their job. Some have no clue or compassion for the inordinate amount of waiting a couple has already done before they start calling their office. I have never bothered them at all until my petition was past the processing date and now that I know it is on someone's desk, I will leave them alone and wait patiently for their decision.

    Hi Deb,

    no, I have not been approved until now. Next week on Dec. 12 will be six month since I started to file the I-130. But no answer from USCIS. I am very depressed

    and angry at the USCIS-Working. I don't know whether I can call them now or not? On next Wednesday is the 6.months over. I am really frustrated now.

    Last week my case is touched, but my status haven't been changed. Is it a good sign?

    How is it, can I call the USCIS next week and ask about my status, or should I wait 30 days after this timeframe?

    I hope our cases will be approved very very soon. I don't now what to do, if I should wait more!?!?!

    YAY!!!! Guess what everyone? I checked online this morning and it says that my I-130 approval notice was sent on the 20th! YAY!!! Nothing yet for the 129-F but I'll keep checking my snail mail too. I was beginning to think they lost my papers or something.... THis is soo exciting!!!! Thanks everyone for helping me through this process!

    I have a question, did you get first an email or did you see your approval notice online?

    I asked you because I normaly don't check my case online. I check my email every one hour.

    I sent my I-130 one day after you (on 12. June ), but I haven't got any answer from USCIS. :(

    Hi shaman, You do not need a copy of the check you mailed. You can send in your I-129F with copy of I-130 and copy of mail reciept that you received from the post office. Prepare a cover letter similar to the following:

    To Whom It May Concern:

    Please find attached an I-129F Petition for Alien Fiance(e) for my husband, xxxx, who is a citizen of Guatemala. This application is being filed for a K-3 visa. I have already filed an I-130 for my husband, currently pending in USCIS, Vermont Service Center.

    Listed below are the contents of the entire package in order from front to back:

    1. I-129F Petition for Alien Fiance(e)

    2. Copy of Filed I-130 Petition for Alien Relative (Original Received by USCIS on 8/15/2007)

    3. Evidence of Filing I-130 Petition – Certified Mail Return Receipt -- No NOA1 received as of 9/13/2007 – Per USCIS phone call, certified mail return receipt is okay to send as evidence of having filed I-130 Petition

    Hi,

    we sent the I-129F and I-130 at the same time and the wrong address too. After that we heard what we did was wrong.

    But the good news was that we received our NOA1 for both of them. Actually, my wife went to San Francisco(CIS Office) and talked

    to them where we did wrong! And they sent a letter to the USCIS (CA).

    We are fine now. Thanks God!

  5. *Unless you didn’t mark clearly (on envelope when sending I -130) that you want consular rout, to avoid waiting your option is continuing K3.

    In my time on this forum, I don't remember seeing anyone actually say that marking the envelope/cover letter etc with "consular processing" has worked.

    I do know of at least one person on this forum (can't remember their forum name though, but I believe they were a March filer) who put as clearly as humanly possibly that they wanted consular processing on the I130, only to have the USCIS completely ignore this and send on only the K3.

    So marking the I130 with consular processing is not 100% effective at getting both forms sent on to the NVC :(

    can I ask you, what time did you get your approval yesterday? I applied my case on 12. June, but I haven't get no answer until now. :(

    Amoro, the status of my case reads the same "This case is now pending at the office to which it was transferred.", so this is normal...I got this message when my case was transferred to California Service Center. But like I said before, try giving USCIS a call to double check that everything is OK.

    we called the USCIS two times and my wife was in San Francisco. They can't help us to send our I-129F to Chicago. I call the USCIS every day. when I give my case number, the machine says my case is in Laguna Niguel. I can't understand why they won't work.

    Calling dose not work at all :-(

    what do you think; is it better that I forget the I-129F and only wait for the I-130????? my I-130 is over four and half months.

    dose I-130 depend on the I-129F?

    I think your documents are fine. You don't need to send your documents to Chicago, they no longer process the I-129F. California Service Center (In Laguna Niguel) process the I-129F.

    I have read a lot in the forum that a case is touched. How can I see when my case is touched? Actually, I have an account, but I can't finde it. Is it written under "Last Updated (mm/dd/yyyy)"?

From my experience.. i would say CR is the better option. searching the timelines I have seen that people who just do CR get an approval faster, compared to people who file for both I-130 and I-129f. in the end with K-3 you end up saving maybe a month or 2...but sometimes even not that. if you are able to make a trip to visit your spouse in India..then stick with CR.

    And we are very frustrated.

    But there is no problem with I-130 and we waiting 4 month for that . The question, should we refile I 129F again, or not?

    and if my I-130 is approved, can I come to the US, or should I wait more for the other process ????

    have you received a letter from uscis (NOA1) for your I-129F? if you have then you are fine... otherwise i don't know. email some of the senior members here with your concern. i am sure they will have some answers for you.

    Are you sure if I have NOA1 for my I.129F, then it is no problem with my case?? My wife said we have received NOA1 for the I-129F, but I am worried about it because we sent the application to CA, but the correct address for us was Chicago.

    we pray a lot that everything is o.k. with my case. I am really tired of this process.

    The 6 month timeframe is only for USCISs part of the process, it can be shorter but it's all in the luck of the draw (CSC seems to be dragging applications out to their limit, while VSC are approving at least a month or so faster). On top of that, you have processing time at the National Visa Centre (I believe a couple of weeks for I129F and up to a couple of months for I130) and also time taken for the embassy to process your file and schedule an interview. For the UK it is about 10 months from start to receiving the visa and this is one of the faster embassy's. I'm sure that processing time will lengthen due to all the delays we're seeing at the CSC :(

    You might want to check the Australian forum to see roughly how long it takes the embassy to schedule interviews.

    Actually, my wife will go to San Francisco to ask about my I129f-case. If they say that we must transfer the case from California to Chicago, then we have lost 4 months. we pray that we have an answer from Immigration for I-130 soon. We applied it since June (4 month).

    Today, I called the US-Embassy for B2-Visa. And they said that I have 50% chance to get a tourist-visa, because I applied for the immigration to the US.

    Actually, I like to visit my wife only for two weeks, not more. Where is the problem? Anyway, I will try it next week.

    we are very sad that the US-Embassy won't understand how difficult and hard is for us that we must wait a long time for our process.

    When we are married we must be together. After 10 months, I am sure I can't recognize my wife again.

    What I don't understand at all, why the fiancé-visa is faster then our visa? we are really tired of this system and may be it is better that we give up.

    And I can bring my wife to my country without this theater.
