    I think i messed it up by assigning myself (living in US) as the person to receive all mails from NVC.

    now that our paperwork has been sent to Saigon for process.

    I believe they are going to send me (instead of my spouse, who's living in VN) the interview package. That will take month to get to me; thus, delay the process....

    am I right? I wish I am wrong about that assessment.

    is there any way to change the address to my wife's now?

    I'm frustrated just to think about that fact .. :crying:

    Are you taking about the DS-3032 choice of agent form for your I-130 application?

    If so, you did the right thing by assigning yourself as the agent.

    As a matter of fact, NVC recommend that the agent be residing in the US.

    What they will send you (the agent) is the Visa fee and DS-230 form. Packet 3 and packet 4 still goes to your spouse in VN.

  2. Thanks guys!!! After consulting with my VJ family, I decided to send my I-864 package with copies of my tax returns and the W2s only. I couldnt wait for the transcripts to arrive! he he

    I was really only worried about the e-filing thing but I couldnt find any documentation that I can't file with copies if I e-filed so I went ahead with it.

    I think that sometimes people forget that there's always been a long line at INS/USCIS and that we chose to be on this line. When the line is not moving fast enough or people are not being processsed the way we like it, we b*tch.

    Long lines and time waits have NOTHING to do with what we're discussing here. K3s are being canceled with no justification or official statement, and that is our complain.

    I chose to be on this line UNDER A K3 APPLICATION, which was avaliable at the time I filed, and I damn well am going to make them process it.

    I wonder if we are forgetting that our spouses are not citizens or residents of this nation. That marrying US citizens doesnt grant them automatic "right" for entry.

    Everyone knows that. But what does that have to do with the fact that USCIS is acting in dishonest manner to the US citizens who are the actual applicants for these visas, and whose taxes pays their salaries?

    Yes its hard to be separated from your spouse but I knew it will be a long process beofre I married her. I also dont like that my K3 got cancelled but Im still grateful that I could bring my wife over.

    If you just sat on your hands when your k3 was cancelled, that's your own problem. Sheep.

    First you compare our govt to the government of Brazil and how so much better it is in Brazil because the Brazilian govt dont disrespect its citizens.

    Yes my K3 was cancelled last January and yes I didnt do anything. But trust me, I was far from being a sheep. Look where my application is now. Just submitted 864 and about to send my IV bill payment. Im almost at the finish line baby!

    Meanwhile, I really do hope that you submit I-129 application. And when or if it gets closed, I hope that you call USCIS, make a fuss, tell them to hold that approved I-130 because you want K3.

    And for the record... I'm a solid Democrat. Voted for Clinton twice and voted for Hillary too.

    Does that rejection result into an automatic IR1/CR1 conversion?

    I am not clear as to what happens after the "rejection". My I-130

    got approved Sept 6, the I129-F was filed Sept 12, and nothing

    yet has happened to that application.

    There's no conversion really.

    IR1/CR1 is IR1/CR1. K3 is K3.

    You cant file K3 without a pending IR1/CR1

    If your IR1/CR1 is approved then there's no pending IR1/CR1 anymore. Hence K3 rejected.

    I hope I didnt confuse the matter even more.

    My I-864 package was generated yesterday and I'll be doing the shortcuts of course.

    My questions is this...

    I've been e-filing the last 3 years. Do you know if its ok to use copies of my 1040s and W2 instead of the tax transcripts?

    I ordered my transcripts last week. Do you all think I should just wait for that?

  6. I am leaping for joy because God has been so good. Today my wife got a new job . Secondly I called the NVC automated line and I heard that our case is completed. I thought I was dreaming,I spoke to one of the agent and he confirmed it. Thank you all for your advice, and support God bless you all. I pray that God will give your papers speed and as many of you that have issues with your case the same God that took Daniel out of the Lions den will work a miracle for you. You will receive God's favor. Thank you all again. I am waiting for the case to be transferred to the Nigeria Embassy for interview. I will keep you posted.

  7. I'm trying to file a I-130 petition and I wanted to send in some affidavits from my husbands friends that the maShriage is real. First should the affidavits be from the foreign persons friends or the americans friends and family? If it's the foreigner's friends should it be in their natural language or english?

    We got married where he is at, Jordan. So my family have never seen us together? We've never lived together so I can't provide any of that information. :(

    I filed mine with affidavits from my friends and family from the US who attended our wedding in the Philippines.

    I figured the ones from the US carry more weight since those affidavits are from USCs and they're all notarized here in the US.

  8. Did you know that there was 13 I129F VJ user petitions approved with a NOA1 date of August? You must be wondering why other people are getting approved with an approved I130 petition? The last one documented on VJ was on FEb 16th.

    Still... the govt is doing nothing illegal. I'm not sure what we can sue them about.

    I dont recall anyone ever saying that USCIS stopped processing K3s. I remember a lot of people shared they're experiences of their K3s being cancelled.

    I remember a lot of people asking for advice on what to do and a lot of other people responded that it is not advisable to file K3.

    That's all it is advises. People can still file K3 and no one here is trying to stop them.

    It's actually surprising to me that US citizens, who have a bit of a fame of just starting law suits over anything are just taking this from USCIS with their heads down, without any warning, justifications or even an official comment on it. They are causing a drastic change in the process and leaving everyone without knowing what's going on. It's absurd.

    I think this is blatant disrespect to US citizens and their spouses, and when (if) they do this to us, we're ###### sueing them.

    Anyway if you are sure the petition been sent and is on completion..then the only thing is to cancel it which only your fiance can do.

    If theres none sent already theres no problem you nw fiance can apply for you.

    They met online November then personally in February. Sometimes that's all it takes to know someone enough to want to marry em.

    Since I never sent in the I129, I'm technically not on the K3 track. It's just that I mentioned on the Cover Letter in the Subject Heading...

    SUB: I130 Application packet for Spouse - K3 Visa

    They'll probably just ignore the subject line on your cover letter. They can't possibly put you on the K3 track if you dont file I129F.

  12. Ok has anyone ever recieved their noa1 in the snail mail berfore the check has even made it back to the bank? I just checked at the bank today and it had not come back yet to clear and i just got my noa1 in the mail? Im definantly not looking a gift horse in the mouth but Id never heard of this before. :dance: I cant believe Im actually on my way now!!!!

  13. Hey Everyone I'm New to the forum. I'm studying right now in the philippines i'm almost done with my 3rd year and graduating next year and met my girlfriend now my fiance in school. me and my fiance are getting married this thursday just a simple civil wedding with family only and i was wondering if i were to fill out the I-130 application in April would i have a good chance of bring home my future wife with me when we graduate Next March? i always go home back to the states when school is over but i always comeback when school starts again. :help:

    I think there's an excellent chance. File it as soon as you can.

    Also, you "might" be able to do Direct Consular Filing. Look it up.

  14. A little background: I'm from the US but I live and work in China. My husband is from Benin but was studying here in China. We were married over 3 years ago in Thailand. Our daughter was born in the US over a year ago. He finished school and couldn't find work here, so he has been in Benin for almost a year. He had a tourist visa granted to him through the embassy in Benin after we were married and he visited the US twice on that visa. Each time he was allowed a 6-month stay, but stayed fewer than 6 weeks. His visa will expire in May and he will apply for another one any day now. I will be moving home in June with our daughter.

    Here is my dilemma. My husband can come to visit us using his tourist visa. Hopefully, as in the past, he can stay for 6 months. I plan to file an I-130 for him soon. Should I file it as though he is still in his home country and let him return when he is called for an interview? Or should I file a change of status for him once he arrives on the tourist visa? I really don't want to side-step any laws or policies, and I don't want to lengthen the process in any way, but I would like to shorten it as much as I can. We know he will not be able to work while he is in the US, but he will be able to care for our daughter while I work, saving us the daycare fees, so it is a financially viable option for him to stay with us.

    I'm getting advice that my husband will be denined entry into the US on a tourist visa if I have begun immigration proceedings for him. Is this true? Should I wait until he arrives before I file the I-130? We won't be breaking any laws. He won't be working. He will be in the US for pleasure - the pleasure of being with his daughter and me.

    Any advice?

    I dont think you'd be side-stepping any laws. I think you can legally do either one.

    I mean you can file as he is still outside and just let him return or you can adjust status here in the US.

    Personally, I'd file I-130, let USCIS know he's here and just adjust status.

    I'm sure someone here with a similar experience can help.

    No can do, if his intent is to use the tourist visa for immigrant purposes. Sorry.

    He should just come to the US without that intention then change his mind later. :-)

My hubby and I aren't even close to sending stuff out, but I read that you should have a cover letter and table of contents as your first page, along with your cheque or money order attached to it. Then you would number all of your documents (hence the table of contents)...I had read one post that suggested clipping everything together with a big clip - that way it is organized and kept together properly, but they'll end up taking it apart to look at everything anyway, so a clip works well. I would think that staples would be much more of a hassle for them.

    Just my two cents, but keep in mind that I'm still in the learning phase! Good luck :)

    I didnt include a table of contents. I used paper clips instead of staples. Then I used a big clip to put it all together. I was actually impressed when I was done. I looked at my paperworks and said.. Yeah, I would approve that. LOL

    Also, dont laugh but for the passport photos, I bought one of those cute little 3x3 inch thank you cards from walmart for 49 cents and used the envelope. :whistle:
