  1. Just to clarify....

    what you guys are saying is that if USC petitions a parent, only the parent qualifies for family based immigration visa... Not their spouse or dependent childeren under 21 years of age???

    but if USC petitions a sibling, their spouse and dependent children qualify?

    The reason why i am making this distinction is because that's how my family immigrated to US. The USC sibling filed for his brothers and sisters, and their spouses and depedents get to come along for a ride.... Has USCIS stopped this now?

I used separate sheets labelling each section correctly like 'Birth Certificate', 'Marriage Certificate', 'I-130', 'G-325', etc. then I just used small binder clips and large paper clips to secure the entire bunch from left and top. Put the pictures in plastic zip lock bag and attached with other docs. Then I sent it...I think you would be fine without any transperent sheets and please don't punch hole in your originals. You would be fine...

    I am US citizen applying for my alien mother to immigrate to USA. What is the maximum age of her unmarried children who can accompany with her? is it 21 years? I had heard that USCIS had raised the age limit of unmarried children who can accompany a parent to 25 years of age. Is that true? I wasn't able to find any information regarding maximum age from i-130 form instructions while applying for a parent.

  4. and no one, no matter where they think they reside on the phylum scale, has any 'duty' to support or anything else on behalf of somebody seeking a tourist visa...any interference or 'guarantees' that focus on a tourist visa applicant are totally without merit, because neither you nor I nor anyone else, save ICE, can regulate the behavior of anyone admitted to the US of A as a tourist....if your friend decides to go wash cars or dishes or hotel rooms, how are you going to stop said friend? Tell him or her ...don't do that!'..? Or, call ICE and have said friend picked up and deported? Really? some friend you are.

    Bottom line: no matter what you write, on no matter what kind of piece of paper, has ZERO positive impact on any applicant requesting a tourist visa...period...game over. If you doubt that, please, by all means, find that section of US law that says otherwise.....I'll go one better...I DEFY to you find such a law....(no excuses now....)

    I don't imply duty as in legal requirement...The person that i am applying for doesn't know these rules....so this is just in case she doesn't get visa (which she already has very slim chance to get anyway based on imperical evidence of what goes in that consulate and her weak application showing ties to her native country), she does not feel that lack of financial sponosorship got in way of not getting a visa. It's only done for psychological assurance.

  5. totally immaterial...the I-134 is a document that has zero value in this instance...(and many others) it is not a legally enforceable document, and, as far as tourist visa applications go, it has about as much value as two week old newspaper.

    Remember, the applicant must qualify in ALL respects for a tourist visa....no third party can make any meaningful POSITIVE contribution towards convincing a VO that the applicant will:

    (a) depart the US promptly after a visit of appropriate duration

    (b) not engage in unlawful employment

    © find 'true love' ten minutes after clearing customs.

    An I 134, whether signed or not, notarized or not, original or not, cannot control, modify or change any of the above.

    All an I-134 can do is make things worse...

    I suggest you read the post first. Was I asking about viability and usefullness of I-134? Was I asking whether I -134 would be helpful in getting the visa? I already know whatever you wrote.... Your comment is not in any way, shape or form answering my question....

    I am not filling out I-134 so the person can get visitor visa. The applicant has to prove that he/she has "STRONG" ties to his/her country and will not overstay his/her visa. I am doing this so the person feels that I provided financial support and will do everything from my side to support him/her. For me, it's just my duty, regardless how immaterial I-134 is...

  6. I am sending affidavit of support (I-134) for a relative who wants to get visitor visa (B-2) to US. I have couple of questions:

    1. Should I send a copy of I-134 (along with my bank statements showing financial support as evidence)? or Do i have to send original signed I-134

    2. Where should I send this form I-134? Directly to consulate? or to the applicant? From what I remember, i think i have to send the form I-134 to the applicant and applicant takes this form to the interview in case consular officer wants to review the form along with DS-160 for applicant.

  7. Not to rain on your parade chief but any American living anywhere on this planet owes IRS tax on whatever income he/she makes in any country. Having said that, there is no double taxation, which means if you pay tax to Malaysian government, you can claim refund for all those Taxes from IRS. Even then, You must declare all your income and fill out a tax form (1040, 1040EZ or whatever form that applies to you since you also own business) even if you don't actually have to pay a dime to IRS. Oh yeah, don't even get started me on foreign bank account requirements. You must declare all your foreign bank accounts (even the ones where you don't own the accout but you are only death beneficiary) and report the highest balance in a given year to IRS every year. Penalties for failing to do this are severe. You also must report all taxable interest income from all these bank accounts. These requirements (however ridiculous they may be) are precisely the reason, ultra-wealthy Americans are giving their citizenship. I am not arguing about the fairness of it all. I am just trying to make you aware of IRS's reach and preventing you from any future liabilities.

    sorry for IRS rant.... but if US embassy denied your spouse once on tourist visa, maybe they are telling you to follow proper process and apply thru spousal visa. Since you visit Malaysia so often, you should look into Direct Consular Filing (DCF) for your spouse, so that once your wife gets a visa interview and passes the interview, she can visit US anytime she pleases, and she won't have to apply for tourist visa every time she enters.

    My wife and I were married in Feb 2012. I am a US citizen, she is Malaysian. We live in Malaysia, I am there working, coming and going on a tourist visa there as my spouse visa processes. It's simple there, I just exit and reenter every 90 days with a stamp to my passport.

    We just applied for a tourist visa for her, so we can visit my family in the US during Christmas. The embassy denied her! They said she might stay in the US, so we needed to show she had strong ties... to her own country?

    I don't understand the problem for the life of me. If she did stay in the US, we'd just apply for the greencard, it would be perfectly legal, she is my wife after all.

    We ask what we can show to demonstrate that we have no plans to stay in the US, they said they have no idea...

    She does not want a greencard, it would be useless. We have absolutely no plans of living in the US, I'm not excited about going back and starting paying all those ridiculous taxes again. I have a great job in Malaysia, we just started a business together, own property, but the slow-minded embassy staff said non of that was enough to demonstrate "strong ties"...

    Any suggestions? I don't know what else to do other than file a lawsuit for discrimination...

    My spouse's oath ceremony is over and she is now US citizen. I have to notify social security administration that she is now US citizen (while we were at ceremony, no one from Social Security Administration was present). Is there a form that we have to fill out for this notification at local SS office? How long do we have to wait before we can notify Social Security administration? After notifying them, is my spose going to get a new social security card and number? She did NOT have her name changed....Anyone who recently had their spouse become US citizen, please let me know the process that you guys went thru...

  9. My wife passed her citizenship interview. However, on the day of the interview, interviewer asked her "where is your husband"? "is here today?" My wife said no. So, after passing the interview, interviewer asked that my wife bring her husband (me) to the oath ceremony. Has anyone been asked this? Is this required for the Oath Ceremony to have your spouse present? Do you folks know what they will ask the husband on the day of the ceremony? I am confused...why would they need me on the day of oath ceremony? are they going to interview me too?

  10. Just to elaborate on our case after wait of more than 5 months...

    Here is the full story:

    We were over 5 months from our application and getting anxious about approval. Then, one day my wife got another letter which said that she needs to take the finger prints again. We were confused. Why would they ask for fingerprints again in 5 months? She went to USCIS to do fingerprints again and the guy at the USCIS center was confused also because he said "you shouldn't have to do fingerprints again because they are good for 12 months". He took the fingerprints nonetheless. Because of all this confusion, we did INFOPASS appointment. The day we visited to see USCIS officer for INFOPASS, he opened our case on his computer and he said you are scheduled for the interview on 19th Nov. 2012 and you should receive the letter in couple of days. We asked him about fingerprints and he couldn't answer why we had to take them again. My wife passed the interview on Nov. 19th 2012. To this day, we haven't had any answer on why they asked us to do fingerprints twice in span of 5 months.

  12. Fellow VJers... please help me understand my options...

    Here is the short version

    1. We (actually my spouse) applied in March 2012 for N-400.

    2. Fingerprint was done in April 2012.

    3. Due to delay in getting to the next step, we called USCIS and talked to Tier-2 case officer 2 weeks ago. He acknolwedged that Fingerprints were done and he didn't see any further actions on the file. He said he put in request to local office to look into case.

    4. Now, we got a letter in mail that our "Fingerprints were expired and need to be taken again". We got a location and date to get fingerprints done again.

    I am so pissed off right now that we have to do the process again. How can I speed this process up? Can I request 'expediated' or 'premium' processing to speed up the case? I don't want to wait another 5 months after fingerprints again. Please guide me if anyone has faced this and what are my best options?

  13. I am trying to call USCIS to find out why my naturalization interview is still pending after over 5 months of delay. How can I get to talk to "Tier 2 Officer" who will have at least knowledge of my case and can help decisively. I am trying to avoid talking to an operator who will just read back my case status, which I can do by going to USCIS website. Is there a special number or option to speak to Tier 2 officer?
