  1. If they've lost it, can you obtain another one from the Jordanian consulate?

    I called NVC today to check on the status of my husband's case. They told me the Affadavit of Support was reviewed and good to go, but that with the DS-230 I am missing the police clearance for Jordan. I sent the police clearance so I said it can't be missing. I even point out that my husband has not been in Jordan for a year yet, not until December. They said its close enough and that he must have it. So the guy said he will have his supervisor review the packet to see if there is a police clearance and I can call back in 10 to 15 days. That is crazy, it took them 6 days to review the whole thing, why that long to look for a police clearance?

    Any advice please?

  2. If the Portuguese embassy will help to obtain the police certificate, then that's what you have to do.

    I am working on an IR1 and we sent or DS-230 and got an RFE. We need to obtain a police report for portugal. My wife and I lived their for 2 year while I was in the military. I called the embassy in the azores where we lived and they had no idea what to do which concerns me greatly as this is the last thing we need to get our case completed and an interview date. My wife contacted the Portuguese consulate in japan and they said she would have to fly to tokyo we are trying to figure out how can we manage that with her job and our finances. Any help or advice would be much appreciated.

It's best to directly ask the consulate exactly what they will accept under these circumstances. i.e. will they allow you to have the k3 interview with photocopies of documents if the original documents are in transit from NVC? The answer might be different for different consulates. If you don't have copies of documents they would find acceptable at the time of the k3 interview, then it might be best to postpone the k3 interview date unless they can confirm with you that the IV paperwork is already at the consulate and they will allow you to follow that route.

    In our case, we had thankfully obtained multiple copies of police clearances, birth certificates, marriage certificates, tax transcripts (both for I-134 and I-864), certified copies of divorce decree, etc.... our IV paperwork had not yet reached the consulate at the time of the k3 interview. The timing wasn't quite perfect! However, we were still able to follow the CR visa route because the k3 visa had not yet had final approval from the CO by the afternoon,

    So if I reading these right the worst that can happen is that you have to either call them before your K3 interview if the CR1 paperwork is not at the embassy yet, and tell them you want to persue the CR1 and perhaps have a delay, and you might have to wait longer for the interview. (That is what worries me.) This waiting this has gone too long!

    I still don't know how they would expect you to have orginals for both K3 at the embassy and CR1 at the NVC. Has this happened to anyone else? Do they accept copies if you tell them that the orginals are at NVC?

  4. The consulate books k3 and CR interviews differently and has a slightly different procedures and forms for each one. The I-130 and I-129F are separate at this point in the process (they parted ways at USCIS). Maybe I'm wrong, but I believe they won't actually switch the visa interview classification in advance of you actually going to the interview. Therefore, you have to pay the k3 visa fee and have the necessary forms ready before you even get to the point at which you can request to have the CR visa instead of the k3 visa. The conversion is done at the discretion of the consular officials, buts is usually honored. If they happen to have the I-130 at hand when you go to the prescreener window for the k3 prescreening, then you will probably be in luck! No need to have additional copies of documents if they allow you to take up the CR visa right there and then. However, if they don't have the I-130 right there in front of them (e.g. it's still in transit or is inconveniently filed away somewhere) then you might be in trouble.

    That's why it's a good idea to have confirmation from the consulate that they have the required documents before going to the interview (if you don't have extra copies). Otherwise you could risk being turned away.

    if your K3 interview date has been changed to CR1, why would you have to submit documents related to K-3?

    For e.g. one difference between K-3 and CR1 is I-134. I would think you don't have to submit I-134 because I-864 has already been submitted to NVC. Also, there should be no need to submit DS-156 because that is not relevant for CR-1

  5. Only the embassy can provide you with the tracking # unless your spouse paid for the shipping, in which case your spouse already has the tracking #.

    There was a similar case in New Delhi in November 2007 for K-3.

    The benificary called the USE after one week of submitting the documents asked for at VFS Jalandhar. She alled at 10:00 AM.

    They told her her visa is approved.

    Do not worry. Your wife will get her visa within two weeks.

    They just want to vefify the documents.

  6. Unless the embassy tells you explicitly that you don't need to bring further documents because they already have them, you will likely have to supply additional copies before having the k3 interview.

    You could always clarify this by calling the embassy, but my guess is that they will insist that you bring documents specific to the k3 interview no matter how illogical it sounds. You will likely have two choices:

    1) Obtain additional copies of the required documents.

    2) Cancel the k3 interview and go instead with the CR interview date.

    It depends on which of these can be accomplished first.

    It's always risky relying on a single copy of each document.

    This is where I'm confused. All my originals are with NVC right now for the IR-1 visa. She has packet 3 for the K-3. If she goes ahead and returns packet 3, she doesn't really have the documents requested because they are all at NVC. So it would really be impossible for her to get the K-3 visa without the original marriage certificate etc. Is this right, or am I missing something?
  7. Since it's not normally included in the original I-130 submission, USCIS and NVC will just assume they don't have it. Once the package arrives at NVC and it's time for the DS-230 to be sent, you could always ask them to search amongst the I-130 documents.

    However, if the police clearance expires before NVC requests it, you will have to get another one anyway. At this time it would be good for you to find out for what length of time they are current before expiring to give you some idea of what to expect.

    I sent mine in for the I - 130...now I'm reading that I will have to bring one to the interview. I'm not really sure what to do. I am assuming that I will have to go back and get another one done once I receive my NOA2 (I've already received my receipt for the K-3 and I -130) Does anyone else know?

  8. Do they have a tracking number or some other confirmation of delivery that they can provide you?

    Otherwise they have to be willing to resend it if it is lost or possibly send it to an alternative address. Maybe you should also verify that there isn't an error in the address they have on file at the embassy.

    Today My HUsband CAll to WAShinton DC and asked why mywife havent my packet till now..

    they said on 18-09-2008 packet 3.5 maild to ur wife address..

    but problem i that i do not have or receive any pakage any method to contact quickly..

  9. It's generally up to the CO reviewing your case, but the usual policy is to drop the k3 visa if the CR1 petition has already arrived. However, you still have to prepare all of the documents and visa fees required for the k3 interview as a matter of formality because they have a standard system of processing for each time of interview appointment.

    You might also be given the option to transfer to the CR1 visa even if the package arrives after the k3 interview, provided it is in transit. This happened in my case. However, that would mean that your spouse would need to return to the embassy to sign the DS-230 in front of a CO.

    I have a little question on time line for New Dehli.

    My K3 Petition for my husband is at New Dehli. He is still waiting for the interview letter and information on medical etc.

    My CR1 Petition is at NVC awaiting the DS 230 packet.

    What happens if they schedule a K3 visa interview for my husband and the CR1 petition arrives before that. Will they automatically dropped the K3 and use the CR1. Would they use the same interview date or reschedule. Can he use the medical packet for the K3 for the CR1.

    All the orginal documents that are required are going to the NVC. I assume they would forward that to the embassy.

    What if the CR1 petition does not arrive before he needs to submit the DS 230 packet to the embassy.

    I am want to take the route that is less time and hassle.

    Please help.

  10. Really sorry to hear that, but at least they haven't sent it back to USCIS, which means it's not denied outright. I guess the DoS needs to conduct an investigation in order to confirm that she is not the other person. At least they've given you a time frame. Hopefully that's an overestimate.

    At this point I would strongly advice involving your congressman or ####### Cheney or someone? Explain the mistaken identity clearly to them and hopefully there might be some extra leverage applied in your case.

    i was wondering if anyone had this happen to them. ineligible to receive visa. must send to state department for review. time 3 months.

    they said to my wife that someone with same name is in U.S. illegally. crazy thing!!!! i cant believe that these guys are so in incompentant in our government. i live in arizona and i see many illegals all over the place.

    but with that said i would like to find out best course of action

  11. On Friday, it took roughly 90 minutes or so for my wife to emerge from customs at LAX POE after the plane officially "landed."

    About 30 minutes of that time was spent queuing in order to have her CR visa processed (LAX is busy). The actual time spent in front of the immigration officer was mere seconds. The bulk of the 90 minutes was probably spent taxiing, getting off the plane (747s take longer than other planes), walking the miles from the gate, queuing in visitor immigration lines, collecting baggage & going through customs. From my experience, baggage claim is very slow at LAX.

    On the other hand, I have heard stories about immigrants being detained for hours with extensive rounds of questioning. Might be a good idea to check through some of the POE reviews in order to get a more general perception. It could be that "hours of questioning" are a relatively rare occurrence?

    I think 5-6 hours was intended to allow for the worst case scenario. For most it will take a small fraction of this time.

    I love to hear that small fraction time. What is it?

    Anyone who has done POE, could you share?

  12. Whoever will be the agent (often the petitioner) should retain original copies of documents for eventually sending to NVC when requested. Make sure the documents (e.g. police clearances) don't expire.

    quik question here...do i have to keep all the ORIGINAL documents with me ( marriage cert,birth cert, etc..) to sent it to nvc...or my wife should keep it in india and take it to the consulate in india....PLEASE let me knw..

    i just called the vermont service center...nothing new...sos...told me call bak in 30 to 45 day from now....

    i dont wanna check anymore....

  13. Technically your case is still within the processing time, even though some have been lucky to have their petitions approved in much less time. You need to wait at least another 35 days before calling USCIS to enquire about the delay. Hopefully your case will be approved before then.

    The USCIS site also stated "6 months" up until the latter part of 2007, after which a massive backlog developed as a result of the hike in processing fees in July 2007. The whole process became topsy turvy at that point. Many cases submitted in July 2007 were put into long term storage and forgotten for as much as a year while USCIS concentrated on approving more recent 2008 petitions.

  14. Not sure anyone will be able to compare PsOE.

    Applicants typically only ever get to experience one POE: the one they pass through.

    My guess is that the experience is more likely to depend on the friendliness of immigration officer than anything else.

    Looking for the experienced to give some insight as to the best U.S point of entrry with a K1

    Since I wont be able to fly to Manila myself and travel with my Honey, I want to make it as easy as possible for entry for her.

    I'm in Florida, so she will have at least 1 connection. But what's best LAX, Chicago, San Francisco, Kennedy ?????

  15. If you keep switching between maiden and married names, that will cause much confusion. If you've decided from now on to use the married name, it's best that you stick with it. It's more important that the names and signatures on the visa application form and passport are consistent. After all, would you want to run the risk of the visa and passport being in different names?

    Thanks for the reply, I had used my maiden name on my signature for G325a and so i don't know if it's ok to use my married name now on my DS230 :wacko: I want to use married name but worried it won't get accepted since it won't match the signature on G325a.

    But I have not signed my updated passport though, still wondering whether to sign using the same maiden name signature or to use married name now.

    I have been sending emails to NVC for the ls two weeks.but i m not recieving the automated response email.

    emails are sent at nvcinquiry@state.gov yahoo notifies me that the email has been sent but there i no response.

    a few weeks ago whenever i sent any email.it would immediately send back an automated response email but not now.

    what can i do

    i tried mailing from different websites but couldnt succeed.

    can anynone tell me whaat could b the problem??

    i sent a lot emails because there was no response everytime for our case

    and only one email for my aunt's case from a different website(they would reply but now).

  17. I was only wondering why you posted your question on the forum for CR/IR visas as opposed to that for k1 visas, since you applied for a k1 visa. I didn't realize you were applying for a k1 visa at first, although that doesn't change the fact that your fiance needs to go to NSO.

    My fiancee will go to the NSO and get the "Certificate of No Marriage" (cenomar) She can then take it to the embassy Mon thru Thurs between 1 and 2 PM and deliver it to windows 17 thru 20. It's not on the list of required documents and there were no check marks on the laundry list of required documents on the white form she received. There was a diagonal mark from top left to bottom right and the CO signature at the bottom. The woman I spoke to at the embassy would not/could not confirm that the cenomar was the only document required. We'll see.

    I believe the cenomar is unique to the Philippines because, as I understand, the government does not allow or recognize divorce

    There is a required seminar for immigrating Filipinos. They have to have their visa/passport stamped showing they completed the session.

    Ninjarocket, I waded through dozens of posts, timelines and graphics on other threads and found no answers. I posted here because I did a search, "pink slips blue slips" and this is where it led me. This is only the second time I've asked a question on this website and each time people have been quite helpful. I've read a lot of useful general info on the site but navigating the site with a specific purpose in mind has been daunting for me

  18. The upgrade is done vis the regular USCIS help line. No need to send a fax. They will ask you for the date and number of the certificate by phone.
