    its pretty basic but has to be paper filed as the online sites don't understand the ITIN and allow for scanning supporting documents like marriage certificate

    Thank you for this side inputs. Your such a good soul! I will be working on it today and get my husband do it the rest me to get  my ITIN in replacement of a SSN and get our income tax return submitted and get it expedited.

    he needs to file a W7 for the ITIN application and a form 2555 for any foreign income to exclude any amount for u of $108,700 or under if doing MFJ

    I am so grateful for your suggested option. I will definitely check into our IRS office here and try my luck. The link you sent is very helpful. I will follow the given instructions there to acquire ITIN because at this point I couldn’t get any SSN number.

    i ask as if u were able to marry by end of 2021,  husband could file 1040 x to amend 2021 tax returns n apply for the ITIN

    it is a slow process but could be faster than the EAD card

     

    with the ITIN u can be added to his bank account (federal laws although some banks have their set of rules) 

     

     

    Hi.. thanks for the feedback first of all. 
     

    I came in the US on the 10th of December 2021. Got married on the 14th. We decided to do that to at least get tax refund as a married man in year 2021. 
     

    IRS wants that I submit a SSN number in April which I did not have. Unfortunately, by the time I knew that I could get a SSN number for non work reason, my 1-94 and my K1 visa have expired.

     

    That leaves me to wait for the EAD and my husband have applied for a tax return filing extension. I really don’t know how long the wait will be but have tried to contact USCIS. Not successful. 
     

    So I wrote here in the hope I could find options through the community’s experiences.

     

    I will check the option you wrote here. So thank you for that.

    But would they issue me a ITIN or tax number without any valid 1-94 and K1? 
     

    It’s frustrating when they can’t even issue temporary immigration status that is valid for for drivers license, bank account and tax purposes.

    Technically the date that matters I believe is the date on your I-94, not the K-1 visa (as the visa's purpose was moot as soon as you entered the U.S.) but regardless it looks like you will have to wait for the EAD (work permit) now to get your SSN. Your husband does not need an SSN to file taxes but you will need to get an ITIN (Individual Taxpayer Identification Number). This is a number specifically for tax purposes that non-residents and resident aliens who cannot get an SSN use to file. 


    I was able to add my husband to my bank account without an SSN. They had to add him as a foreign resident to do that. Basically it is the option used for people who bank in the U.S. but are not citizens/LPRs. Talk to the bank and see what they can do.

     

    Depending on your state, you likely will not be able to get a driver's license until you obtain the SSN. That's what my husband had to do (we live in Alabama).

     

    Unfortunately this is one of the possible downsides of getting a K-1. You have to apply for your SSN very quickly upon entering the U.S. - waiting often results in the SSA being unable to issue the SSN as it is too late. In our case we got very unlucky and were told the first we applied too soon (which wasn't true) and when we tried again, we were told it was too late.

    Thank you for these information and insights. Looks like I would need to wait. My application were received March 22, 2022 although I have submitted in February 2022.

     

    To get my EAD, how long is the processing time at this point. Any realistic estimate? 10 months or longer? 😢

  6. Hello All,   

     

    Need help. To be able for me to get a SSN Number for non-work reason, I applied for the Form SS-5 UF at the Social Security Administration in Tullahoma, TN.  I needed that SSN number in order to apply for drivers license, open a bank account and submit my husbands income tax submission to IRS to be able to get his refund for 2021.  Again, the accountant needed a SSN Number.

     

    The Social Security office in Tullahoma was ready to give me the SSN. Number until she noticed that my K1 Visa is expiring in 3 days at the time I got that appointment.  She said the processing will take them 2 weeks and I would need a valid Visa. I have a K1 visa that expired in May 15th.  

     

    How do I get a SSN Number with this issue?  Is there any other option available for me to get a SSN Number for non work reason?

    We have called last Friday, 24th of September and learned about that they have not received our petition yet.  No file.  So we have sent an Email as per recommendation of NVC to nvcresearch@state.gov.  Our NOA2 approval doc scanned and sent.  We are still awaiting for our NVC Number to continue process.  That means it is the 9th week, no NVC number as of to date.  Frustrating.  Thank you for responding.

    We faced and currently facing the same thing. We have two I-130s going through the process, one approved June 17h. We were told 90 days from USCIS and call back after that. We received the email from NVC on September 15th. Our other approval was July 8th and we are still waiting to receive an email from NVC. We have contacted our senator to help. We have placed service tickets with USCIS and at this point its just a waiting game. 

    Hello Mrs. Williams,  thank you for responding. I appreciate that.  I have the I-129 F for K1 visa.  I am not sure if that is the same waiting time period?

    Our NOA2 was approved on July 24, 2021 and since then no file at NVC, meaning USCIS hasn't sent out our file?  First, we called after 6 weeks and told us to wait 60 days.  Today, we called again and they said they have not received our file from USCIS.

     

    I just posted a public inquiry.  Anyone who could give us option and tell us what we could do at this point?  Is it better to directly contact the Embassy in Frankfurt, Germany or won't make any sense?  

     

    I'd appreciate any advise.

  10. Our NOA2 has been approved on July 26th 2021.  We have called NVC and they said they have not received anything from USCIS.  I checked the processing times and it seems to me like USCIS sends the document to NVC within 30 days.  Our case is now 60 days since approval from USCIS.

     

    We were recommended to email NVC and to search our file.  Is there anybody who could tell us what are our options and how long will this search lasts?  Our NOA2 is valid until 11/22/2021.  Help.

I had tonsils removals, some watery cyst on neck and 2 mole removals and i have paperwork from all, i’ll bring them but i never heard anybody from my country ever needing this kind of paperwork on medical. Just vaccinations records and doctor’s note i mentioned earlier if person had mental issues in past.

When I checked the immigration processing, for CSA, currently it is December 3 ... :o  I wonder what is going on????US Travel ban has been up indefinite...due to Delta Variant... Trying to be positive but if the visa processing will be delayed even more...This is all getting really ridiculous and unbearable:cry:

    Thank you for clarifying...I already doubted that my question wasn't asked properly... This helps me to compare which consulates outside the US are processing visa and scheduling interviews... i guess, I will be frustrated as well if my NOA1 is from September 14, 2020.

    My responsible consulate is Frankfurt, Germany... We are November 30 2020 filer. Still awaiting NOA2.  But hoping a reply will come by Aug 2 as per notice by USCIS.

     

    Questions after receiving a NOA2 from USCIS:

    • What is the appropriate action to do? 
    • When to complete and finish a DS160?
    • When do I start compiling documents, like affidavit of support, a new letter of intent for marriage, copies and original docs like birth certificate? Tons listed on the site to compile. :( I am the beneficiary.  
    • Who compiles the documents?  Me or my Petitioner?
    • Will these be submitted to the Embassy together with the DS160?

     

    I understand that the DS 160 can wait a bit...I am just concern when is the best time to prepare and compile the documents so as not to incur more delay in submitting thereby getting an interview date?  

     

    I would appreciate a reply from this supportive community.  Thank you.
