  1. I was just looking at my passport where they stapled my I94 and stamped it and noticed that I only have a departure record not an arrival record. It is stamped saying I was admitted and the date. Were they supposed to attach the arrival record also? I saw a sample online of what the arrival record looks like (much more personal information than the departure record) and I know it's not attached in my passport.

There is no such thing as a departure record, they will not stamp your passport when you leave the US. You should have a stamp on your passport with the date and your POE, and attached your I-94 form.

It says "departure number" in the top left corner of the I94. I was just wondering if anyone else has the same paper stapled to their passport book. I'm only questioning this because I saw a sample I94 online and part of it looks different from what I have. Just trying to make sure I have all the proper documentation. Thanks for input.

  3. What about the expected length of trip on I131 application Part 3? I have a 20 year old son in Canada that I would like to visit on different occasions so I don't know when or how long my trips will be. There is also a question in Part 3 of the I131 that asks if i am applying for an Advance Parole and if so skip to part 7. If that's the case I'm not sure how to fill out part 7. It wants me to explain how I qualify. I've looked at the sample in Example forms but it doesn't have anything filled in that part. I've also tried looking at other posts but haven't found the answer i'm looking for. Thanks for your help.

  4. You can put down any date you choose. It doesn't necessarily mean you will be given AP by that date, but there's very little importance to the date you put.

My daughter wanted to go to Canada for Thanksgiving the year we applied for her AOS and AP, but it wasn't granted in time. So, she just used the AP to go to Canada after that for her birthday.

What about the expected length of trip? I realize it probably isn't important but I want to fill it out properly. I have a 20 year old son in Canada that I would like to visit on different occasions so I don't know when or how long my trips will be. Thanks for your help.

  5. Great example. I used a cover letter because I am paranoid and like to be organized. I think it may have helped a little.

Me too. I always use cover letters for everything and sometimes it is more for my own record, but also to ensure that I can back up my claim of sending something should it be questioned in any way.

Mine is slightly different from Jen's above... I kind of did it "all in one" and it worked ok for me.

Thanks for your help everyone!! :)

P.S. I notice that the fees are different? Did you file before the new prices? I can't remember when they came into effect.

  6. Don't worry about not having an SSN for your AOS - a lot of people usually apply for it afterwards to save the hassle of changing it over to the married name. I'm personally waiting for my SSN verification, but that isn't going to stop me from filing AOS!

Depending on what state you live in, you might require an SSN before you can get a DL. Check your state DMV requirements.

Thank you. I think I'd like to apply for the SSN, only because I don't want to leave anything blank on the I485 form. The problem is I have a 15 year old son and to apply for a SSN for him it requires that I first apply for an EAD which when I apply for AOS it is included. I'm so confused.......lol. Is there anyone I can call at USCIS for help?

  7. Has anyone checked into dual citizenship for the new babies to be, or for anyone who has already had a baby?

I'm going to look into it before our baby is born but was wondering if anyone else has thought of this.

    Patricia

Our baby was born in Canada on July 5, 2007. On our way to Montreal for our interview we went to the Toronto consulate to apply for citizenship for the baby. While I was waiting for my visa the babies citizenship also came in the mail in Canada. He now has dual citizenship.

  8. I know there is a parking lot just up the street from the Consulate on Rue St. Alexandre. We parked a bit up from that (neither of us can remember the street name - it could be in my Montreal review though..) but there are parking lots in the area of the consulate (for a fee of course - we recall around 20-30$ for the day). We took a car and just got near the area and parked where we could find parking! Should not be a problem!

Great!! Thank you so much for responding.

    Lisa

When you get approved (only two more days to go ), please let us know about your experience at the consulate and, of course, the parking situation. I too was thinking of driving up the 401 and autoroute for the interview and then returning the same day.

I will definately post our experience when I get approved (positive thinking) and also let you know about the parking. Wish me luck everyone!!

    Bonne Chance!!!!

Ty so much, it helped, we got approved.....yeah and received the visas on the 15th of October.

  11. They want good financial evidence of income, IRS returns are excellent evidence of what income was for prior Year, you can use IRS transcripts, in place of the returns. (1040 is a return the W-2 is a form provided by employer that has the numbers used on the 1040, the 1040 needs the W-2 to prove the numbers on the 1040(Return).

The directions included with the I-134 are quite old, and USCIS has not bothered updateing them because USCIS has no use for the form, only the consulates use the I-134.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.

    • I-134 signed and notarized.

    • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html

    • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)

    • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.

    • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

Also consider this you WILL have to provide the IRS return data later for the I-864 used for adjustment of status.

How long does it take to gather this info? We are running out of time... he'll have to mail this stuff to me and won't be able to do so until tomorrow if he can get it in that short of a time frame, and I'll have to receive it by Monday morning at the very latest!

I just looked up the info on the I-864. It states in the section on how to fill out the form that you need the most recent tax return. "If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years." So you really only need the most recent year.

  12. I have my interview on Tuesday October 10, 2007. We are driving and just wondering if anyone knows if there is close parking to the consulate? All of the reviews I've read it seems that everyone has stayed at hotels and walked. Thanks.

  13. I have a problem when reading others posts, when I try to add a decent reply it turns out to be about Sharon and myself especially if I see Sharon's and or my name or reference to us there or something just clicks a reaction and I am no longer comfortable with that because it takes away from the original posters intent to share their reviews, passions and frustrations. I would like to make pertinent comments to others posts but right now that does not seem to be the case or in my case not possible because I am presently to involved in Sharon' and my little corner of the universe.

To everyone that I managed to dull or take away from their joy with my posts within theirs I am sorry and apologize it was not my intent to do so. In time I will return to my senses and be more mindful of others and their emotional voyage through this same process.

Don't be so hard on yourself. I don't think any of us would act any differently if we were in your situation. Our hearts go out to you. Good luck and stay positive, you are in our prayers.

  14. We received our NOA2 last week. Does my fiancee's daughter who is 8 years old need the police report done as well? I know she needs the 5 passport photos and the medical exam in Lima, but I have no idea about the police report for a minor. Is there anything else we need to do other than that for a minor child. Ohh, she is also getting the notarized letter from the biological father allowing the daughter to come to the states. Any advice is greatly appreciated.

No you don't only for children over 18. I have 2 boys 15 and 20 and only the 20 year old and myself needed the police report.

  15. Yup. All "ties to Canada" rules apply, though. He can even cross with the visa in his passport as long as he makes it clear to them that he's not using it until a later date. Totally up to the officer as to whether they allow him to or not, though.

I just called U.S. Customs at the Ambassador Bridge (Detroit/Windsor) and the customs officer that answered said that you have to activate it right away. She said as a matter of fact, I'm not supposed to even be crossing the border at all during the process. I think it's ridiculous, how are you supposed to keep an ongoing relationship if they don't want you to cross the border to see your fiance.

  16. you'll get your b/c back and the other docs.......you'll make copies for them. the only things they keep in their original form is the police check and medical :)

oh and you'll want to write the tracking number from your nvelope so in the event your passport/visa gets misplaced then they can trace it

What about proof of ongoing relationship, even though we already sent it, do they really want more. My fiance is going with me and my son and our newborn son. If our newborn son isn't proof of an ongoing relationship, I don't know what is.......lol.

  17. Our approach is will be the same. Getting married (tentively Nov 24) about 1.5 weeks after POE and then we'll go from there. I don't drive myself, so not worried about the DMV for now. I'm interested in unpacking, finalizing the wedding plans and then off we go!

YAY honeymoon @ a Virginia mountain cabin :D

Is anyone else out there going batty over trying to plan a small wedding and get the details right? I'm not sure if it isn't more complicated to have something small and intimate then something big....everyone knows the spiel about big church, big hall, lots of drinks and people blah blah...but planning for small and intimate takes on a whole knew lvl of attention to detail.

Family & friends were originally slightly taken aback by the fact that we don't want to wait too long before getting married, but for us it's a matter of logistics and money and we want to get the AOS process started!

    Anyhoo - cheers folks

    Marriage license ---> marriage ---> AOS ---> SSN ---> DL/bank/others

I just noticed you have the same interview date in Montreal as I do........:)!! You are right about getting married right away. That's what we plan on doing so we can get the AOS process started too. We plan on a ceremony in Florida in March 2008. But for now it will just be city hall.

  18. Hi lisa,

I understand now that you are concerned about at least 1 of your sons 'aging out' while waiting to adjust status.

I found a thread that might be helpful to you, people in the same situation (link below).

In particular there is a post from a member - ljs - who has this in their timeline: "Nov 14 2006 ~Montreal interview (expedited due to child aging out) SUCCESS :) "

Perhaps this is a possible avenue for you? Anyway hopefully you will find some answers in this thread, perhaps you can also private message ljs.

    Children turning 21

    Cheers!

    Hi Trailmix,

I've seen that thread but thank you very much for sending it. I've been discussing things with my 20 yr old son and I think he is going to stay in Canada. During this process he started a full-time job making very good money. It's not going to be worth it for him to take a chance coming with me and his brothers. I'm not sure if I should notify Montreal that he won't be at the interview or not. I'm scared to do anything to screw up my interview date......lol. Thanks for all your help.
