My son who came with me originally on a K2-visa are waiting for our 10 yr green cards. We already went for our biometrics. He is thinking about returning to Canada to work for awhile temporarily. Can he do this? Will this affect him receiving his green card? Please help if anyone knows. Thank you.

I am currently a permanent resident and it is my understanding that I can renew my permanent residency and it will last for 10 years. Does anyone know how to go about this? Please help!! Thanks.

It's not necessary for her husband to attend the interview.
He can if he wants though.
Good luck!
Thank you soooo much for the quick response, it is much appreciated.

My cousin is going through the K3 process. She lives in Canada so her interview will be in Montreal. She is the beneficiary. My question is: Does her husband the petitioner have to attend the interview? Thanks for your help!!

My son and I received our Greencards on June 6/08... Can anyone tell me if this is all we need to travel? Do we still need our passports and advanced parole? I'm sure that I don't need advanced parole anymore but I'm not sure about our passports. Thank you.

YES this is NOT a problem.
All a Canadian needs to go to the Bahamas is a valid passport, NO visa required, and when returning to the USA you need to show the AP to officer at the US POE.
Thank you so much for your response.......!!

Can someone please tell me if it's o.k. to travel with my advance parole to the Bahamas. I've gone to Canada and back and had no problems but I wasn't sure about going to the Bahamas. My advance parole is for multiple uses. Thank you.

My now wife came over on a K1 visa. According to the guide, you should wait a couple weeks after entry into the US before applying for a Social Security (SS) card. Well, due to circumstances that was difficult to change, we had the wedding about two weeks after she came here.
No, problem, I thought, we would just go to the SS office after the wedding and apply for a number. Well, the officer there told us that since we were married, the K1 visa was no longer valid and that we would have to wait until after she got her work authorization documentation to ally for the SS card. I was not amused.
I've since filed for the AOS and work authorization (and she has even had her biometrics done), but her not having a SS card is causing problems. She can't get a driver's license, and I can't file my taxes jointly.
Any advice? Was I told wrong? Should I expect the work authorization docs soon?
Thanks

As you can see from my timeline, I got married Oct-12 and applied for a SSN Nov-7. I showed them my passport with K-1 Visa & I-94 and my marriage certificate. My application was processed with my married name and I received my card within 2 weeks - NO FUSS. I'm of the understanding that it is the I-94 that drives eligibility up to 2 weeks prior to expiry.
I tried applying in my married name but the system wouldn't accept it so they filed my SSN in my maiden name. The only problem is I can't work with this SSN, it states on it that I have to have EAD approval. So they told me when I get my EAD to go back with that and my marriage certificate to remove the conditions and put it in my married name on it.

How long after the biometrics appt. should I receive my advanced parole? Can anyone help? Thanks.
-
Im guessing its because I got the bio letter then a request for initial evidence, which I sent in and they received yesterday..
Sorry if this is a dumb question but how do you know if you've been touched? Where do you check for this. Thanks.
-
By gosh...you mean that $1010 wasn't a waste??? This is like the best Weds ever
Thanks for the reminder about the Marriage Cert....I have changed my name and my Canadian passport is indeed in the maiden name
Cheerio
My son and I had our biometrics today with no problems. I didn't know about the marriage certificate, thank God they didn't ask me for one. Hope all went well with your appointment.

I mailed my package out on January 2nd. My checks were cashed on January 10th.
Mailed our package January 2nd also. NOA was January 8th and our Biometrics appointments are January 30th for myself and my son.......!!

I received my NOA's for my I-485, I-131 and I-765. On the I-485 it states the amount received $1010.00 but on the I-131 and I-765 it says $0.00. Is this correct? I specified on my cheque and my cover letter the amounts for each application. Thanks if anyone can help.

Form I-130 #22
2 parts
22. Complete the information below if your relative is in the United States and will apply for adjustment of status.
A. Your relative is in the United States and will apply for adjustment of status to that of a lawful permanent resident at the USCIS office in:
Fill in with City and State
B. If your relative is not eligible for adjustment of status, he or she will apply for a visa abroad at the American consular post in:
Fill in with City and State
My wife and I live in Los Angeles, CA. She is here in the US on OPT and we'll be filing for her AOS and submitting all the forms in together. Since I'm filing everything together the instructions say to mail to the Chicago Lockbox. However, for part a) do I fill in with Chicago, IL or put Los Angeles, CA or there is another California service center in the form instructions with a Laguna Niguel, CA address? Which one is correct?
For part B since I've filled in part A then part B is not applicable, right?
Form I-485 Part 3 : Were you inspected by a U.S. Immigration Officer?
I checked Yes because she had to go through immigration for her last US entry. I assume majority of the people entering the US legally will check Yes for this question. Just want to confirm.
I'm not sure about the I-130 because I applied for a I-129F. For form I-485 part 3 you do check Yes.

They cashed both mine and my sons cheques today (thursday, Jan 10/08).........yeah!!

People have waited for more than a month for check to get cashed. This in the norm since USCIS got hammered with petitions last summer.

Thank you so much for setting my mind at ease. I got delivery confirmation on January 4/08 from the post office. I was worried because my K1 visa expires on Jan 18/08. The link you sent me states that as long as they receive it in their mailroom in time then it will be o.k. Thanks again for the info.

I know it's only been 8 days since I sent my pack but I got delivery confirmation on January 4/08 and they still haven't cashed mine and my sons cheque. I've looked at similar timelines and it seems like their cheques were cashed fairly soon after they sent their pack. Can anyone set my mind at ease? What is the average waiting time for USCIS to cash the cheques and send a NOA? Thanks.

Knowbody got any idea???
I've just recently received my AP documents. Yes, you tick "d" as you have done. I also put unknown for date of travel etc, but I stated why I wanted the AP in my letter. I have elderly parents back home and I wanted the AP in case there was an emergency and I needed to travel without it affecting my AOS.
Is there a sample somewhere of the seperate piece of paper explaining how you qualify for advance parole? I'm not sure what I'm supposed to write on this paper.

How much time do you have to file for adjustment of status after you get your K1visa? I entered the United States on my K1-visa and they gave me and I-94. Thanks.
-
As far as I am aware of, the 1 year date is a hard and fast rule... I would wait for an RFE but I would also be prepared as I would certainly expect one.
Thanks. Here's hoping I don't have to. I can't see what difference eleven days would make. I'm most likely in the same health as I was then.
Do you know if that would hold back my EAD or AP as well?
Thank you so much everyone for all of your help.

Actually there is a departure record, it's just not a stamp -- it's the I-94 in your passport. They're supposed to take it out of your passport when you leave. Then it's sent to the authorities as proof of your departure. They also take it out of your passport when you get your green card.
The arrival record is what you hand over to the immigration officer when you arrive in the US. It's the large part you filled out yourself on the plane. They keep it for their records as well, so you won't find it in your passport.
Thank you for much for the explanation. It makes sense now because I didn't enter by air, I came by land so I didn't have to fill out the arrival part. They just stapled the departure part in my passport. Thanks again for the help.

I had my medical in August 2007 in Canada. I was given a sealed envelope and a "Vaccination Documentation Medical Worksheet Two" that's what the top of the paper says. According to information on both VJ and the USCIS website because I had my medical less than a year ago I don't need a medical just an I-693a vaccination supplement. I compared my document that I received from the doctor to the I693a and it almost looks identical except for what it is called. Can I use the vaccination sheet I was given or do I need to get an I693a?

Do I check a. in part 1. "I am the petitioner. I filed or am filing for the immigration of my relatives". In the instructions it states "if you are the petitioner who is filing or who has already filed Form I-130", technically my husband filed and I-129F for me and my son. Just want to make sure I check the correct box. None of the other boxes seem to pertain to me. Thanks.

...Did you file before the new prices? I can't remember when they came into effect.
Yes.
Ty so much for all the information, it's been very helpful.

He was thinking for a few months. Thank you for your response. We looked online and found out that it is 6 months he can stay out of the country. Any longer and he would lose his permanent residence.
