Utter incompetence. Definitely dispute the fees. In Nevada, it goes to arbritration and an attorney hear's both sides. If your attorney has any self respect he will return all monies to you at arbritration or sooner to get this resolved.
I have had a similar experience with an ignorant immigration attorney. She told me that my assests alone was enough and that I did not need a joint sponsor. Even though I had no income, no work history. When my wife got her interview date, the ignorant immigration attorney said that was a "good sign". I thought to myself, this attorney is clueless. As expected, the U.S. consular refused the visa saying I needed a joint sponsor.

My brother double crossed us twice about being a joint sponsor for my wife. The first time when it was time to submit the joint sponsr, and the second time when he assured us he would joint sponsor us if my assets only would not be considered and the visa refused after the interview. We felt misled and lied to. So I know how you feel.
I would urge your wife to talk to her parents and explain the risk is minimal. If that does not work, ask a friend.
If your wife gets a job, I am not sure how long she has to be employed to then sponsor you herself. The U.S. consular's decision is subjective so maybe you contact the embassy you are dealing with and ask them.
Good luck!!

If the joint sponsor I submit is accepted, does the embassy notify my wife that her visa is approved? Or does she have to make an appointment and be told in person?
Note: She was told everything was fine except for the need of a joint sponsor.

I am unable to find a joint sponsor. Family member has changed his mind and will not joint sponsor my wife. Too "risky" he says. Friends have no desire to help either. I have a job offer that pays 70k starting in April. How long before I can submit that as proof of support?
-
Thanks. I wish they'd give information, any information at all, about when they would or wouldn't accept assets in place of income.
Its up to the U.S. consular. Yes, I easily had enough assets to be approved but unfortunately the U.S. consular in Nairobi refused the visa petition. I have been retired so I had no recent work history.
I have a job offer that would start in April. Anyone know how long I have to be working before I could submit that as proof of support. Having trouble finding a joint sponsor.

Just got an approval today based entirely on assets (and less assets than you, but still more than enough for the requirement). I'm very sorry it was rejected for you; I wish I had some clue why that could be. Best of luck with regrouping and moving forward from this setback.
Congrats on you being approved. I had 217k cash with 12 months bank statements. The USCIS says the U.S. consular "may" consider assets. In our case, the consular did not consider it and looked at my no income. We are a family of four so that may have factored in to it.

Thank you for your answer. So CRBA approved even without you there and no DNA test anything? Wow. Nice.
Yes, no DNA testing in our case. Very thankful for that. I was living in Kenya for the first seven months of wife's pregnancy. That may have made the difference in not having to do a DNA test.

Not surprised but still crushed....I had a joint sponsor lined up but he backed out at the very last second when an immigration attorney told him it was not necessary. I submitted 200k in assets. But since I had no income I thought a joint sponsor would still be needed. I was right and the immigration attorney was clueless.
My wife was also crushed as she took the 9 hour bus ride back home. All I could get out of her was send the joint sponsor forms via DHL. Anyone here go through the same scenario at the interview stage? What steps did you take after securing the joint sponsor? Thanks in advance.

Congratulations on the CRBA. can you please share your CRBA processing background. Much appreciated. Please share the interview details and what documents they asked and stuff like that.
I am the US citizen father living in the USA. I sent my wife Forms DS-2029...DS-3053...DS-11...notarized copy of passpoort(bio page)...Wife brought the forms with Birth certificate of child, one passport size photo of baby, and wife's passport to the CRBA appointment.
She then had an interview with U.S consular. Many questions were asked: How did you meet. What was the timeframe from when you first met to the time you married. Where is your husband. Why is he not here. Have you applied for your immigrant visa.

An attorney will take your money and thats about it.

Hmmm don't have you on the spreadsheet and you don;t have an updated timeline. What is your case complete and date you got ur interview date?
Congratulations by the way.
Thanks...I was informed January 3rd case was complete, file being forwarded to Nairobi. I tried to update my case and got an error message. I gave up and just posted my wife's interview date. I took 60 days for NVC to review all submitted documents and notify me of case complete. Very happy I did this on my own with the great help of VJ posters who provided valuable info on how to fill out all the forms.

Interview date is February 12. I had tried to post in the February interviews in January but the thread had already closed.

Mission Accomplished. CRBA and passport in hand. That was the easy part. Now comes the visa interview for the wife

I am also doing assets only as I have no job. I hope the reason they are not accepting the assets is that you did not send in the 6 months of bank statements. If you did, then I am screwed.
-
2 months old they not gonna let you to get a CRBA. cuz your baby so young so better to wait until your baby is on 5 months.
Not true. The CRBA instructions encourages parents to file a CRBA as soon as possible after the baby is born.

The U.S. Embassy-Nairobi does not require DS-5507 if baby was born to married parents. Out of wedlock, DS-5507 MUST be filed.
-
The U.S. Embassy(Nairobi) says DS-5507 must be filled out but in parentheses it says child born out of wedlock This would indicate form DS-5507 is not for child born in wedlock.
Anyone turn in your paperwork without DS-5507?

How is somebody to know that if they moved during their infant years? The govt. must of changed this because the last time I did this I did not have to go back in history but for a few years.
Anyone else in the same situation of not knowing precisely when you moved and where you were at during your childhood?

My wife gave birth in Kenya. We expect her CR-1 interview within a couple of months. Do we need to get the CRBA and passport done before the interview?
-
They don't ask many questions. They just hand you a letter saying to get a DNA test(Whomever is the U.S. citizen). Thats the way it went down in our case.
