  1. I am in a similar situation. My Wife is a USC and she was working when she sponsored me abt 2 yrs back. Now she is not working however i have been working all this time. So the delay in my I130 & I485 is due to this situation apart from my pending name check? Any solution for this problem. We also went through our interview abt and year and half back.

  2. I have been employed before i got married. I was on my H1B. Moreover my wife is not working anymore. She used to work when we filled my application along with the AOS.But now she is not working.DOes this affect our case or is this what that is delaying our case.

    I had no problems in my interview. In and out in 15 min along with my wife. I guess they dont question seperately unless you go for a second interview or it might depend on the local office. My wife is the same race as i am but she is from a different country.

  3. Thanks for the reply guys. This october it will be 2 yrs since applied for I-485 & I-130. We have been married for abt 26 months now. Its surprising that I-130 is still pending based on my name check. I thought I-130 is regarding the sponsorer ( similar to I-140 for employment based). Even I-130 is pending for me. So not sure how long it will take. Does anyone know how to contact First Lady. Does anyone have the mail id so that i can mail FL or anyother concerned person.Its a good trick by USCIS to make money through (I-765 & I-131) every year by delaying the name check.

  4. I already did an infopass appointment,they say the same story,name check pending. I was just wondering if at all my wife has a right or way of withholding the procedure since she is the sponsorer. you never know,she might be thinking that i might leave her after i get my GC since we are from different countries and her family members keep on telling such stories that happenend to someone.Had i known before,i would have gone through an employment based processing rather than family based. At this stage,i can't go back to employment based GC since it might create a wrong impression for USCIS.So Just wondering if my wife can withhold procedings until further notice and is there a way for me to find out if she does?

    My I-485 & I-130 has been transferred from California to NBC in March 2007.I havent received any decision on either of these cases.Is anyone in the same boat as me?

    When I made an address change, My I-485 was LUD in July 2007 whereas I-130 was not. Does my wife has to apply for change of address on I-130 since she is the sponsorer?

    Does the approval of I130 depend on the Name Check beacuse my wife filed for my I-130 in Oct 2005 along with my I485 ,but i havent received the decision on I130 either?

  6. If one is married to a USC and has yet to receive his GC pending name check. If he receives the Permanent Residency card say after 3 years of marriage. Since being married for 3 yrs, can he apply for citizenship or does he have to wait 3 yrs from residency which would then be over 5 yrs of marrriage to get his citizenship.

I have applied for AR-11 change of address.My I-130 is still pending.I have made infopass appointments a couple of times but the end result is the same.Actually when i first changed my address,it was in apr 2007 through phone.so when i had a infopass appointment in Jun 2007,they told me that my address is not changed thoroughout.She said my case was awaiting to be assigned to an officer but since they have 2 different addresses of mine at diffenrent location she asked me to apply AR-11.I did that in Jun 2007 and havent heard back from them.Is there any sample letter that i can use to contact the senator or FL.Do i have to mail them or email them and what info do i need to include in my mail.Wat is the contact info ,where can i get it?

    H1B married to USC - July 2005 (applied in California)

    I-485 - applied in Oct 2005

    1st I-765 - approved Jan 2006

    1st I-131 - approved Jan 2006

    Interview - March 2006 ( successful with pending name check)

    1st Fingerprinting done in Dec 2005

    2nd Fingerprinting done in Nov 2006

    2nd I-765 - Jan 2007

    Moved to Florida in Jan 2007.

    I-485 transferred to NBC - March 2007

    Submitted Address change form - Jun 2007

    LUD on I-485 - July 2007

    I have put up 2 service request which says the same stuff- pending name check and it will take 6 months before i can contact them.Its been 21 months since my first fingerprinting and 10 months since 2nd fingerprinting but i dont know why my name check is taking so long.I dont even have a Conditional GC even though i am married to USC.Its been over 2 yrs for my marriage. My question is:

    1) is it usual that you dont get conditional GC when married to USC until ur name check is pending.

    2) How long do you think its gonna take from here on since the LUD on my I-485 was in Jul 2007

    3) Is the LUD due to the address change because if so why my I130 still show a LUD on Oct 2005.

    4) Is there a way to expedite the process.
