  1. Congrats!! Did you have any change from Refused to Administrative Processing? My fiance had medical 4/26 and interview 4/27 and was told approved pending medical
  2. Hopping on to say my fiancé had his k1 interview April 27th after his medical April 26th, was approved pending medical results. Case status showed refused as of April 28th. Called the medical place and they confirmed they sent his results over on May 4th. Case status then updated to Administrative Processing on May 9th. Really hoping we see it issued soon as he took a gamble and booked flights for June 1st and our wedding is planned for late June
  3. Thank you so much for your detailed reply on this topic! It is super helpful when I feel there's not always a clear right answer about what's likely to get approved vs denied. I have a separate question regarding the last three years amounts on tax returns- how do I show it was foreign income? I was abroad in 2020 and with the FIEC it makes it look like my total income was zero. Any tips on that?
  4. Either way one still has to provide tax returns for one year, correct? It's just how that income is categorized, ie self employment income on schedule C or whatever it looks like to do a w2 as an LLC and show the business tax returns as well? What would be the advantage of setting it up the LLC way if it doesn't inherebtly show more stability?
  5. I'm currently a sole proprietorship. I'll look into the LLC thing! Would I still mark self employed on the I864 if I'm an employee (of myself) with a W2?
  6. So helpful to hear! Do you think that it's a red flag to change jobs during this process, or no? It's to make more money, tbh, but no guarantees USCIS would see that as reasonable.

If I stay with my current employer working one day a week and make $9k from my employer and $51k from SE, then as long as I'm not somehow taking 37k in deductions (I won't), I'd still have AGI above the poverty guideline minimum and won't have left my current job. Does that sufficiently indicate stability? Most I could keep up with my current employer would be going from 30 hours a week to 16. I'm just trying to fit the logistics of my life into the hoops USCIS requires jumping through.

So, if I worked like 1day/8 hours a week for my current employer (at $23/hr), and made 50k of "other income" through self employment, that's figured into line 9 of my 1040 putting my total income at around $60k. Is that considered more stable? Or does it have to be that I make 125% of poverty guidelines through my employer regardless of how much SE income I have? I understand on paper "starting a business" seems unstable, but reality is I am doing the same role while SE with a contract that guarantees my hours/income. It's just about what I can prove to USCIS I suppose!! Are you saying at GC interview, don't bring updated I864 and wait for them to request it so I can file 2022 taxes and use that as evidence? I would keep my job until filing but would really prefer not to stay all the way until the interview.
  9. Ah, is it that we can't schedule it ourselves? So if USCIS schedules it in November/December I'd be in trouble? I suppose like @Boiler says I could wait to file, but don't want to delay the beneficiary's EAD more more necessary. Fair enough! I'm the one filing, so if I don't take deductions that put me below the minimum would I be okay? My last three years of income are all fine, they're also all a mix of employed and self employed. Though one of the last two years will include foreign income and the tax return is so complicated 🤦🏼‍♀️ I do the same job hourly for $23/hour vs when I do it as a contractor I make $65/hour, again with almost no expenses. It just seems silly I'd have to continue making less and spending more time/money commuting to prove to USCIS that I make enough money. 🙄 Thank you for your advise and caution though, I definitely don't want to put my case in jeopardy!
  10. My lease is up in a few months and I won't be able to commute from my new place of living to my current job, so it's not really an option. If I file i864 in July with my current job, quit a few weeks after when I move, and assume my interview not would be before January 2023, could I then use my 2022 tax returns to prove I meet the guidelines when they ask for an updated I864? What if I provide bank statements from a business account showing income vs expenses? I have seriously almost no expenses. I should make around $65k total in 2022, and AGI should still be fine.
  11. Hey all! I am struggling to figure out the timing of a few things for a AOS based on a K1 visa, wedding planned for June 2022 and filing shortly after. I currently work part time for an hourly employer and am also part time self employed as an independent contractor/sole proprietor (which I started the end of 2021). I am planning to quit my employed position in the next few months, but am wondering if I should wait until filing the I 864. So, a few questions: 1. If I filed using current income from my employer (knowing I'll be quitting soon), would I need to somehow update my I864 to say I've left that job? 2. If I quit my job before filing my I864, can I file using my self employed income alone? I would make more than 125% of poverty guidelines in 2022 and can demonstrate with biweekly paid invoices, but my 2021 tax return would reflect primarily my hourly job with only a few months of self employed income (totaling like $6k). I absolutely DO NOT have anyone I can ask to Co-Sponser. What's my best option?
  12. We got NOA2 and just booked an interview today - earliest available was April 6th but we couldn't get a medical appointment until April 26th (first available was April 25th). See my timeline for more details about NVC process!
  13. Similar to loads of people - our case status changed to "In Transit" on Tuesday and "Ready" today Just booked his interview for April 27th! His medical (booked on Monday but could have called earlier) is for April 26th, so I know his visa won't be approved the day of but he didn't want to travel down from Scotland to London twice. Anyone else done it this way for London? Wondering how long it will take until he can fly to the US after the interview.
  14. Hey all! Got my NVC # when I called today 😊 Case received March 11, NOA2 March 1 so fairly quickly! I've got almost everything together so I'm anxious if anyone ( @DeeJess ?) has a copy of the email from the NVC or London's P3? So fair I've filled out ds-160 and prepped all documents for the medical and interview besides the payment confirmation. Hoping to call and book a medical tomorrow, but do we need to have the NVC email or some sort of physical letter for that? Thanks all, hoping things go quickly for everyone 💕
