  1. Hi Sunny11,

    I've seen you replied to someone regarding I-130 upgrade. I can't really afford for the answer so that brought me to this forum. 

    My husband and I had our AOS interview 02/02/2021 resulting the interview was completed but case must be reviewed. We were very confident approval but the interviewing officer told us he needs the physical file of our I-130 petition which was perviously approved and forwarded NVC NH. Please help advice what is my next step. We have been married for 3.8 years. I did upgraded I-130 right away after my LPR husband has became USC but why the local office who conducted our interview don't have our I-130 file but have only its approval I sent in along with the complete packet of AOS.

    ++++++++ Questions I recently asked on I-130 forum++++++

    My AOS marriage based interview was completed, but the case must be reviewed (Initial Review). 06/2017, my LPR husband filed I-130 before I-485 (non-concurring), receipt 09/15/2017, approved 06/25/2019. (Beneficiary, me decided to file AOS within US)

     

    We had our AOS interview last week, it was short but went smoothly. We felt very confident—per officer’s verbally told us that he was satisfied with our case.

     

    Because our I-130 was already approved, but the officer told us that still needed our physical file of I-130 from other location prior to finalizing my AOS application. We didn’t bother asking what location.

     

    (I-130 upgrade) We notified NVC National Visa Center and NBC National Benefit Center right away after my spouse became USC. The complete packet AOS we submitted was included the copy of I-130 approval notice.

     

    I am a Canadian, born in Thailand. NVC New Hampshire had notified us back in 2017 that our I-130 case will be forwarded to US embassy in Thailand where I don’t have any tie with my birthplace no more since immigrated to Canada. When typed in the  NVC case number+invoice id sent from NVC NH, I see my I-130 case has been ready for an interview at US Embassy, Thailand since 2017.

     

    “My questions”

    1. Any Ideas, where is my physical I-130 located, NBC, NVC New Hampshire or US Embassy Thailand?

    2. How how long does it take after the USCIS local officer has requested the physical file I-130 from above locations?

     

    Any advice or sharing similar experience is greatly appreciated.

  2. My case is F1 category. unmarried son and daughter US citizen after interview CO demand 221g we sent it. after receiving 221g they demand DNA we did. last update on CEAC was 30 july and case status is ready. how much time it will take ? 

    kindly answer.

    my interview was 02/08/2018 in USA Embassy during my interview VO ask Some questions about my travel plan etc after that kept  my passport and gave  me a white paper 221-G same day  i got email from the consulate NIV section .to send my details past travel history family details etc. after submitting the documents received a phone call from USA Embassy for a interview again by 04/09/2018.

    during second interview VO asked me some more questions end of my interview they did not give back my passport .few days ago i email to them and ask my case status !👇

    1)i just would like to know they count 60-90 days from first interview or from the second interview ?   

     2) if they kept passport is that good sing - how many chance's to approved Visa ?

  4. Hi penguin! I noticed you are Irish! I am a dual Irish/UK citizen (lived most of my life in Northern Ireland) and my wife is American. We married 2 months ago. I've been here in the US on an O-1 visa the past year and a half and it expires in Mar2018. I'm looking through the options of the best way to continue living here. Options include trying for another O-1 visa / an AOS and obtain a GC / return to Northern Ireland and apply for a spousal visa from there. I am shooting a movie in Morocco Jan+Feb so I can't apply for an AOS right this moment as leaving the country would cancel it. I could return to the states immediately after filming and apply then but then I only have a week or so left on my O-1 visa!

     

    All options are troubling as the AOS could leave me here in the States past my visa expiry date unable to work or leave until everything is processed, and returning back to NI would mean a long time separated from my wife, house, life etc.

    I'm wondering if there is anything in the US-Ireland relations that speed the processes along so we won't have to be separated for too long. Do processing times differ depending on nationality? Or is it possible to go through the US embassy in Dublin or is there a different type of work visa available to the Irish that would allow me to return and work in the States sooner?

     

    I'm going to see a lawyer on Tuesday to get some help on what to do but any help would be greatly appreciated as you are a pro on here!

      To be honest I haven't been keeping up with the specific Irish stuff since I got US citizenship, but hard the privileges have decreased quite a bit. It sounds to me like a renewal of the O visa may be your best option, but I'd recommend asking on the forums and see what suggestions the experienced members come up with

  5. Hello, I was wondering If I could ask you a question? You seem to have a great deal of knowledge on this forum. I am the petitioner/sponsor for my spouse. We submitted concurrent filing of form i-130, i-485, and i-765 on 12/12/16 and was received by USCIS on 12/20/2016. I received RFE on 1/20 because I made a mistake and left Sponsor/Petitioner name blank on one section of i-864. I corrected it and mailed revised i-864 back today. Now reading a bit more on the forums I came across a topic regarding who can and can't use form i-864EZ. I meet all requirements under "Who should file form i-864EZ" but used the longer/standard version of i-864.

     

    Am i "required" to fill out i-864EZ since I meet all the requirements or will they accept form i-864? Now I'm concerned they will reject my response to their RFE letter. What happens if they do? Will I be given another chance to correct and re-submit? Hopefully they accept the standard i-864 form and the i-864EZ is just optional if you meet all the requirements. I could find a clear answer any either of the instructions for both forms. Any help is greatly appreciated! Thank you

      You can always fill in the I-864, so that should not be an issue.
      BTW, posting such questions on the forum will generally get you a quicker answer :)

  6. Hello, I was on a tourist visa and just married my US citizen husband. Can anybody help me on what is the first step to process my papers to become a permanent resident?
