    of course! ..  So that was a bit chaotic. We still don't know 100% why. Might be due to refugees and student visas being process. here the timeline:

     

    - DQ to interview appointement:   1 month

    - DQ to medical:   2 weeks

    - rescheduilng appointement: 2 tries (first time consulate did not respond to email, second time they responded within 1 day) and after two weeks we were able to reschedule (get a 2 weeks earlier appointement date).

    - from appointement to interview:   original 2 months, after rescheduling 1.5 months

    - from interview to visa package received:   4 days

     

    I also updated our timeline to the newest state :).

     

    This whole process was MUCH longer than expected. I saw a lot of poeple going from DQ to interview in just about 1 month. For us it took 2.5 months. Probably due to a variety of reasons. I wish you guys good luck with everything!

    Hi! I am already in the US now and everything worked as expected. I went to the medical without the interview letter. In fact i went there without even having gotten the invitation. So they send my information to the embassy even though i didnt bave an appointment yet. But it did not seem to be a problem. The consulate hat my medial information already there when I was there for the interview!

  3. Hi good & bad news here: another VISA appointment arrived here (Germany/Frankfurt consulate). Interview date is pretty late (for my taste, on average here in Germany it seemed like before July most people got an interview within 3-5 weeks).  Interview date is Sept. 26th, DQ was June 28th.

     

    I sent a request for expedition. We'll see if it helps in any sort of way..

  5. Hi everyone,

     

    I am currently waiting for my Interview at the US consulate in Frankfurt/Germany and I have to register my document delivery address with them (https://ustraveldocs.com/de/de-iv-documentdelivery.asp). For the rest of my time here in Germany, me and my family are living at a different address than what was specified in the DS260. Does that "matter" which address I specify there or should the address specified in DS260 and the document delivery address be the same? For example it is different than my registered address in Germany.

    In Germany on average you seem to get your interview within 30-40 days. So Oct. appointment would be way too late for me. On their webpage the doctors write that "because of the situation, Germany consulate also accepts medical after the interview" But That would be too late for me.

    my situation is the following:

     

    - I got DQ'd last week

    - I called the four official German doctors available for the medical exam upfront, but I am only able to get an appointment already next week in Munich. Otherwise I would have to wait until October for an appointment, which is crazy.

    - I might not have the invitation letter (I think you only get an email these days? nothing written?) for the medical exam yet, but the doctor only states they need the "case number issued by the consulate".

     

    So my question now is: is the case number issued by the consulate the same as the one issued by NVC? If that's not the case. What would I do? Any poeple here who have more experience with the Frankfurt consulate and medical exam in Germany? thank you so much :).

    You're right, we got approved on Friday. We turned in the new documents on April 19th. So you guys should hear from them Monday or Tuesday I guess? I am keeping my finger crossed for you guys!

     

    If everything works out 100% onwards from now I might still be able to bring my daughter to her first school day ;).

     

    We didn't get another message which said that we should consider getting a joint sponsor even though we're doing an asset only approach. Maybe they didn't do that as they already sent us this message with the last RFE.

    I´ve seen a few recent cases of people who got RFEs and then DQs a few days after submitting the requested evidence so maybe we dont go to the back of the line after all. Fingers crossed.

    Yes!  we did :) in Fact. Just to be sure we submitted several more documents. I submitted every document with a comment that we only do this for the RFE, but think that it isn't relevant for the case itself due to our asset only approach. Hoping that this approach makes it easier to expedite the case.

     

    So overall we submitted:

     

    - Statement about evidence of income under "Proof of Work" and that we can not provide evidence for US-based income, but that we provide our foreign income even though we know that it doesn't matter and instead we are using our assets.

    - 2 statements, that we also can not provide W2 or 1099 Forms  under the respective labels (We don't need these as we're not filing jointly. But we read in other threads that they wanted this.. so now we just want to  be 100% sure we don't get another RFE)

    - Uploaded past job confirmations under "proof of work" and bank statements for the income (all based in Germany, so for the interview they won't play any role at all...)

    - Uploaded a updated Bank Statement about our assets, as we are in the process of moving them to the US and also mention this in the statement about evidence of income. We thought it might help..

     

    We think that probably just the statement for "evidence of income" uploaded under proof of work would have been enough. But we thought that as we're probably resetting the waiting clock we could upload the other things as well just to be sure.

     

    Next thing we are going to try now is submitting a request to expedite our document approval. Maybe this will work in Germany and with a little bit of luck it'll speed things up. We are on a tight schedule where children need to go to schools they have already been  approved to at end of August... Maybe the fact, that this still seems to be like an error from NVC + the school thing will convince them to speed things up a bit...

When I asked to expedite cause the actually approval form CEAC was just taking to long, they approve to expedite. My wife interview and they have taken her docs, but they said we need to submit update 1040 and W2 of mines or affidavit ( I think its really on the affidavit cause I don’t need to claim my Japan income. I filled my 1040 as unemployed) 

    How long did the approval take for you when you sent the request to expedite? I am wondering if I could do the same thing and expedite the process, stating that our children already have a spot in schools and we will probably loose them if we don't manage to be there on time.. Did you mention the "silliness" of the RFE that you got in the request?

It looks like anytime your current income listed on the I864 is below the poverty guidelines, you need to upload something under the PROOF OF CURRENT OR SELF EMPLOYMENT document category.     The NVC lady told me that they dont even look at assets, only the embassy evaluates that documentation. Basically, the NVC only does clerical work. You just need to upload documents under the right catergories to get DQed.

    Yeah.. I am so sorry for you and us 😥  I guess we'll now provide multiple statements for all possible cases and additionally provide proof of income for foreign based income & jobs. This is just ridiculous. Doing all of this while it doesn't matter anyways, as we're using our assets. I'll keep posting here about our progress on this..

    Can you give us some hints what that statement looks like for you? Do you have any source fomr other forum threads giving hints on how they wrote a statement and it worked?

     

    Right now I am thinking we would basically write and upload a signed letter along the lines of:

    In this letter I provide an explanation for why I cannot provide evidence of income or employment as required by the Case FE Review note from 12-Apr-2022.

     

    I have not worked in the United States since 2008 and therefore cannot provide a W2 or other proof of US-based income.

     

    We have enough assets without current US-based income to support our case. Additionally we provided the IRS tax return transcripts which also show that we do not have a US-based income in the last several years. We are aware that the final decision is to be made by the consular office in Germany.

    - Additionally, should we provide some evidence for the foreign income which is mentioned in the tax return transcripts, even though it doesn't count and is labeled as  foreign income anyways?

    Well "great" is open to interpretation... they said the waiting clock will likely be reset for us. We called this number:  (603) 334-0700. Which you can find here:

    waiting time was approx. 2 hours. We called them about 1min. after they opened.

    It is even more frustrating for me because I had lawyers helping me with the documentation and still didn´t get DQed. I´m waiting for some clarification from the lawyer on what to do regarding the evidence of income but he has already suggested adding a joint sponsor.

     

    His exact reply was "USCIS has been difficult lately with accepting the appropriately-filed requirements.  I tend to agree that a joint sponsor doesn't necessarily make sense here, but it is just easier to do what USCIS asks."

     

    I will post any other updates here. 

    Soo...  we just called. They say they require us to provide a written statement labeled as "proof of current or self employment" uploaded in "Additional AOS Supporting Documentation" (And that's even though we provided a written statement in the AoS Form already). That statement should contain an explanation why we can not provide the evidence... So our plan right now is to provide that statement and see what happens. Maybe we'll not be put back in the waiting line with some luck.

    Not enough information to form an opinion.  Sounds like an error was made either by the petitioner on the affidavit or by NVC.  For assets to work, they must be liquid, and adequate evidence must be provided.  Case note 1 can simply be ignored, if the assets are liquid and properly documented.  Case note 2 is best cleared up with a phone call.  Since there is no income, there is no evidence of income to provide.

    Thx, yes, our assets are liquid (mostly cash & stocks) and we provided numerous bank statements and additional signed letters from the bank managers to prove their existence. I also checked the IRS transcripts again and its pretty clear in them that there doesn't exist any income on the petitioners side except for one year with a small amount of foreign income. I will report back here after our call on Monday (I hope we'll get through).

    Yes, I stated zero in the I-864 for the salary. Additionally we added a comment in the comment section which states:

    I am earning a foreign income,
    therefore I set this value to zero as
    it is not contributing towards our US-
    based household income.

    I wonder if there is a chance we can just tell them on the phone to proceed "as is" as we're doing an asset-only approach and the evidence for income isn't required anyways...

    No, we did not do this, do you think we should? We submitted IRS transcripts from the last couple years downloaded from IRS webpage. From what I understand in the other forum thread that you sent, that should be enough.

     

    What we did is the following:

    • We have IRS transcripts, some of them report foreign income.
    • We have written a note in the AoS Form, that the petitioners current job is based in germany, and therefore we set the current income in the form to zero.

    Maybe they are confused by the fact that in some IRS transcripts income is reported (below poverty) but no mention of W2 and didn't check that the income was foreign?

     

    Additionally, if we submit additional documents I am concerned that the waiting clock is reset and introduce unnecessary waiting times.. So if they say the AoS was accepted..  will they continue processing our documents, and we can eventually schedule an interview nevertheless?
