  1. My US spouse has a written job offer in the US but as he has not started it yet he can't use that to be my sponsor can he- he would have to have the salary showing on his bank statements?

    No he can't, it might help to prove domicile - that's about it.

    Does my husband fill out a I-1864 then?

    They both fill out an I-864 - your Husband still has to be the primary sponsor. The I-864A would only apply if your Mother in Law is a household member.

    Monday interview looms ever closer.

    Question about the I-1864 ans I-1864A.......I am so confused!

    it is my mother-in-law that will.

  3. I have come across another question raised on another forum...

    Do I need an affidavit/ more evidence to take to the interview to prove I am in abona fide marriage?

    I have our marriage certificate from16 years ago, children's birth certificates etc. Do I need more?

    I have heard about people gathering photos, letters to each other, anniversary cards etc; but as well as that, having friends write letters to say that they verified their marriage. I'm not sure where the 'affidavit' bit came in...

    Has anyone here done all this/ needed all this?

  4. Having read the other thread one thing jumps out at me.

    The visa applicant told the Embassy staff the USC wasn't domiciled in the USA. That IMHO was a pretty stupid statement to make and one which the Embassy staff have to take note off. Especially as domicile is required.

    They take a pretty lenient view of what being domiciled is. My wife hadn't lived in the US for 10 years but had an Oregon driving licence with our sons address on it. They didn't even ask to see it. But if they are told the USC isn't domiciled what are they supposed to do.

    Lansbury, I don't understand this....

    In my case, On the I-160, I think that dh said he was domicile in the UK. How could he be applying through the London Embassy, if he wasn't domicile in the UK?? If he was domicile in the US he would have to apply out there, right?!

    Proof of leaving Job

    DH can't provide proof that he resigned his job- what actually happened was that he was only 3 months into a new job, and got written off for two weeks becuase of illness. During that 2 weeks we went to the US to look at houses, schools, and for him to have job interviews. When we got back there was aletter waiting saying the company were giving him one months notice and terminationg his employment. He wasn't bothered of course becuase he would be leaving anyway. But this letter would not prove his intending to leave his job in advance of his move to the US.

    Proof of Giving Up Rented

    This is what he has so far, to prove his ties to the US:

    he has a US bank account, that he's had for either 1 or 2 years (it has only recently been actively used though)

    he opened a 2nd bank account last week

    he has a US drivers licence

    he is registered to vote (at his parents address)

    So we can take his voters registration form, his bank statements, the written offer he made on the house, and I think we brought back letters that had been sent to him at his parents address....

    In addition,

    he has 4 interviews lined up when he goes back to the US next week for 5 days

    we put an offer in on a house we want to purchase- we have this offer in writing, but the negotiations are still ongoing so we don't -yet- have a house! But he is hoping to move this along next week.

    School Registration

    We have chosen the school but were told we couldn't register them until we could proove we were living in the district.

    I have been so careful to check we were doing everything right!!

    My concerns are-

    1/will they say my mother-in-law can't co-sponsor me because my husband is 'not an american citizen/ proving domicile'?!!

    2/we- I think, I'll check in a minute- put on the I-130 dh's place of residence as the UK. Was that the wrong thing to put???

    How could we have put his place of residence was the US, when it needed to be the UK in order to file at the US Embassy?

    Oh boy :( . Am getting myself worked up now! Thanks for the replies so far.

  6. Has anyone having their Embassy Interview during this last week been in this situation ?!

    US/UK married couple, living in UK, decide to move back together to US where USC mother lives......

    USC files for UKC at London Embassy, petition is approved.

    UKC files their part, all seems to go well until interview at London Embassy when the USC is told -I think I have this all correct- that

    she is not (regarded as) a USC because she is living in the UK, even though she has birth cert. etc to proove it...

    Embassy goes on to say that the USC should already be resident in the US and filing in the US on behalf of their partner...

    I have just read this on another forum- it appears to have happened today. I was hoping this poster was also on this forum but having looked, can't find her here.

    I am trying to see if this has happened to anyone else- even the US spouse's US immigration lawyers in London are baffled and have not seen this happen before! They can't understand why the US spouse's petition was approved, if they are now saying she filed incorrectly.

    Someone has posted a reply to this USC saying they wonder if the problem is that the sponsor to her UKC husband is resident in the US- he's wondering if the petitioner has to file in the same country that the sponsor is in?

    I am nervous now- my interview is on Monday!

    Has anyone heard of, or used, either HAVAS packing & Shipping, based in Hartfield, or DRAKE MARITIME Ltd, in Brentfordd

    We got a list of 'personal effects shippers' from the BIFA. Apparently they are not allowed to recommend anyone, but they sent us a list of about 20 names, all of who are registered with the BIFA.

    The only name I recognised on the list was Seven Seas Worldwide- has anyone used them?

  8. I had my medical today at Bentnick Mansions in London; at 10.30.

    I arrived at 10.30 and was asked first of all to hand over my photograph, passport, vaccination proof and the form I'd signed. Then I had to fill in a 2nd identical form- same questions but different font and layout- and sign a form to say I understood the implications of having a positive HIV result!

    Whoever said it is mostly waiting, was right! It was past 11.00 before I got called in by the doctor- male, young, german- he was very pleasant and welcoming but at times hard to understand.

    He went over the form I'd filled in, repeating the same questions -I'd answered no to everything so there were no 'complications'. I was then asked to strip to my underpants and lie on the couch. (I'd asked for a chaperone and she came in at this point.) He examined my throat, ears, listened to my chest and back, took my pulse on my feet, again on my wrist, took my blood pressure, examined my breasts for lumps and then had a quick look down below to check I was all female!

    (I asked him about this last bit afterwards- did they really get females who turned out to be males; he said yes, they'd had 3 this year already! But he said they really do that as a way of finding out about syphillis. hardly anyone admits 'yes' on the form when asked if they've had a sexually transmitted disease, but when they are asked to pull their underwear down they become nervous or agitated and refuse- he said that's a dead give away that they've had something!

    Just thought I'd share that with you....I'm nosy like that and I'm always finding out useless bits of information by asking questions!)

    Then he had me read from the eye chart, took blood to test for syphillis and HIV, and told me to get dressed. He then spent a while chatting to me- telling me about his work in tropical diseases, asking me about my family etc. Afterwards he said that was to 'get an idea of my mental state of mind- to see if I was angry, aggressive or agitated! Apparently anyone who fits that description is referred for a psychiatric evaluation, he showed me that he had ticked 'normal' on my form! As if I expected anything else :)

    I asked him what the Embassy were looking for- what would make them turn me down, and he said that, apart from HIV and Syphillis, and anyone who would be a danger to themselves or others, they were looking to see if I would be a drain on their resources. he gave an example of a woman aged 70 who put on her form that she was on an nhs waiting list to have a hip replacement- she'd been on it 8 months and was told it would be another year at least. She failed the medical and was turned down for her green card because 'she needed surgery and would be a drain on their resources'.

    It hadn;t really occurred to me that it was all about money- although I knew about the HIV and syphillis; I'm quite naive!

    That part was finished. I then waited another half hour before being called for my chest x-ray. Then I had to pay- although it was £170.00, not £180.00 as I had been told on the phone in early Jan when I booked it!

    I asked whether the results would be ready for the Embassy by Monday, which is when my interview is. the doctor said it usually took 2-3 days to get them back and that i should tell the receptionist to mark them as urgent.

    When I told the receptionist, she said-

    'no, it takes 5-6 working days to get your results back and they won't be ready for Monday, and the doctor does not understand how this works!!!' Then she said that if the results aren't at the Embassy on Monday, I won't be told whether I have been approved at the interview- they'll have to wait for the result before they can stamp my passport and send it to me.

    Which SUCKS!!

  9. Neil and I met in London, in 1986. He had come over on a student programme to study law and was working nights as a bartender in Chelsea. I went into the bar that night with my best friend- my grandfather had died that day and -this will sound horrible- but I went in to take my mind of it. (I was going to say celebrate...but..my grandfather had been very abusive physically and verbally to my monther, sister and me so yes, I was relieved and glad he was gone.)

    Anyway. I saw him and called him over to order a drink but he came over and said he was actually on his way to mop the mens room floor because someone had thrown up in there. He did come back to see if we had our drinks, and we got talking. It was instant attraction, but more I found him really interesting to talk to, a good listener and he also made me laugh.

    We met on March 10th, and were engaged by June 30th of 1986. But his visa then ran out and he had to go back to New York, after which a long and complicated engagement followed- we didn't get married until May 1991. His family didn't accept me for some years because I wasn't jewish -or american, they really wanted him to marry a nice jewish girl from New york and live locally! We put our wedding off in the hope of trying to win them over but realised it was going to happen. But then we had to postpone the wedding a 2nd time because I was in the Kings Cross Underground fire in November 1987. I was really ill afterwards and another lengthy seperation followed with me in England and him in New York.

    In the end though, we triumphed (yes, it does feel like that!!) and we 'eloped' and got married in Washington DC in 1991. It was only when I had our first child in 1993 that i met his family for the first time, whith a grandchild there, they welcomed me into the family.

    So, we have been married for over 16 years now. It has been a rocky road getting there but we feel like we can survive anything. having grown up abroad I've always wanted to live in the States, for the children to get to experience life there, but it has taken me a long time to persuade Neil to go. He's always loved living here because his job takes him to Europe alot; but he's looking forward to 'going home' now too.

    That's our story! It's nice to hear other peoples. It does seem more common now to meet on line, both his brother and sister met their spouses on an american dating site!

    I really hope someone who has already had their medical at Bentinck Mansions can help!!...

    I was sent a medical questionnaire form with the letter form the US Embassy, and told to take that to the appointment tomorrow. Are there any other medical forms I have to fill in at the appointment? Do I have to give them my GP's details?

    Also, I was told when I made the appt that charge incl vat is £180.00- can someone confirm this?

    On the 'Pricing Information' sheet it lists Item 3 - Bacteriological examination of sputum £90.00

    What the heck is that?! And will I need that? I have had all the injections done by my GP- except for varicella but I can't have that in this country can I?

    What about DNA Specimen Collection £85.00 and Drug & Alcohol Specimen Collection £40.00?

    Are these extras that I am unlikely to need done/ to pay for?

    And if my interview is next Monday, will the Embassy have had my results by then? I noticed that they said it can take 3 working days to get the results to the Embassy...if that's correct, they won't have it by Monday. Would that mean that the Embassy won't give me an answer on Monday?

    You will have to fill in another form at the medical, similar to the one you got with packet 3. There is also an aids form you have to sign. That's what the blood test is for. Your signing to say you understand this.

    Yes the medical is £180. No other extras unless you get vaccinations done there. You don't need to worry about the other items on the price list.

    You will be asked if you have had chicken pox. If you have, you don't need to worry about varicella. You don't have to give them your GP details.

    Hope it goes well for you. It goes very quick. You'll spend more time waiting.

  14. 1. You can check your mobile in the security hut, but it's an at-your-own-risk thing.

    2. We both went to the interview, for both the K-1 and DCF. No problems there.

    3. You need to take tax transcripts OR tax returns and w-2's for sponsor and co-sponsor. This is part of the I-864 instructions. It is there!

    4. You can get there no sooner than 1/2 hour before your appointment, they won't let you in the queue before then. They aren't kidding when they say you will be queueing in the rain if it's cr*ppy out, so make sure you bring an umbrella if it's raining!

    5. Yes, all can be paid in USD. We just paid by card.

    Okay, thanks to you both for all the info. I think I will take my other half with me...won't be as fun celebrating on my won! I'll just make sure he has his US passport with him.

    This has moved so fast in the last couple of weeks- we weren't prepared and haven't even arranged a shipper yet! But we're so excited and nothing's going to hold me back now. We're trying to see if we can get out there before the end of this month- I'm assuming of course that I'll pass the interview!

  16. My interview is going to be on Monday February 11th- I'm so excited!

    But a little nervous as well......I just hope I think of everything....

    A few questions that I hope you guys can help with...

    1. I gather I can't take my mobile into the Embassy? Is there a place there that I can leave it safely? I don't want to go all the way up there without one really...I'll have loads of people to call when i get out of the interview.

    2. Am not sure whether to go alone or with my other half....I know he's not required for the interview, but thought it would be nice to have a celebratory lunch or something....what did you guys do?

    3. What do i need to take in regards to his (he's the us citizen) filing his US taxes- do I need to take his tax transcripts or something? I have had no info on this from the embassy!

    4. My appt is 9.30 am. What time should I get there? How long should I expect to be there?

    5. I can pay all the fees in US dollars, right? Does this include the courier service, for which I have been quoted the price in pounds sterling?

    Any other tips or advice would be appreciated! Can I take water in with me , or is there a place to get a drink there? I take it that I can't take a coffee in there.....:(

  17. I'll venture so far as to say it's not unlikely, but that December packet 3-ers are getting mid February interviews now.

    The scheduling has picked up a notch since the holiday, so you may get lucky.

    I got lucky- I'm so happy!!

    I just got back from a trip arranging schools/ house etc....all falling into place;

    and a letter from the Embassy was waiting for me - my interview was set for Monday Feb 11th!!

    I wasn't expecting to get the letter before the end of the month, so this is a big surprise!

    Have my medical on Wednesday, that should be straight forward.

    If all goes well, I could be moving at the end of February. Although I haven't arranged the shipping yet......wish I had done that already now!!

  18. Am trying to work out - roughly- when my interview with the London Embassy might be scheduled for.....

    I sent Packet 3 back on Jan 10th -guaranteed to get there the next day; and told them that my medical examination is scheduled for Feb 6th. I also told them that I would 'not be available for the interview between Jan 16- Feb 4 because I would be away'.

    I'm hoing to get the interview early to mid February......does this sound vaguely possible to you wise folks out there? Is there any way of finding out beforehand? Other than waiting for the appointment letter?

    Anyone with a similiar timeline to me?

    Anyone with a crystal ball?!......

  19. What is the question you are asking. For us to explain what the Embassy means by original documents or what documents to produce to satisfy a particular part of the checklist.

    No, I know what is meant by 'original documents.' If this is just saying that all the documents i take with me need to be originals, That's fine, I know that.

    I am asking if question 9 is asking for any particular documents?

    Are they saying that I need to produce 'extra' documents (which must be originals) , to prove my relationship to my husband? I mean in addition to my marriage certificate, which they refer to in question 8.

    I have read of people taking to the interview boxes of letters, anniversary cards, photographs,and letters from friends saying they have known the couple for some years- all to prove that it is a valid relationship.

    I am wondering if this is what question 9. refers to? Do I need to take anything like that? (Have been married for 16 years and marriage cert. would show that of course.)
