  1. Hi,

     

    we had filed i130 online in May’2021 and received the receipt the same day. In September 2021, we started getting a new status that “Case is being actively reviewed by US”.

     

    since our case went to NSC, and NSC is currently reviewing June’21 cases as per “Check cases processing times” , shall we go ahead and submit a “outside normal processing time” or wait for some more time?

    not sure how processing time status and “currently being reviewed status” are linked together.

     

    Appreciate a quick response.

    Yes. it could actually be middle name, but the i130 instructions clearly states to fill everything in the form. Thats why the dilemma with empty MIDDLE NAME as N/A is not getting feeded in the online system, and as per instruction one can't leave it blank.

    This question has been asked few times on this forum, however the answers have been more relevant to paper based filing rather than online filing the i130 petition.

     

    I am filing i130 form online, and i don't have a middle name.
    Now, as per the i130 instruction, we are suppose to fill everything in the form and not leave anything empty. On necessary sections, one can write "N/A" or "None" as per the instructions.

     

    Since i don't have a middle name, i am trying to fill it by "N/A", however the tool/online system doesn't allow me to do the same (as it doesn't accept "/" at all)

    I can't write "None", since that would make my name "JAMES NONE BOND" (e.g. James Bond).

     

    Neither i can write "NA" or "Not Applicable", since at the final review section the name would reflect as "JAMES NA BOND" or "JAMES NOT APPLICABLE BOND".

    In one of the old posts, someone recommended to use dash (-) , but the same would appear as "JAMES - BOND".

     

    Hence, i am confused how to proceed with the same. Would appreciate response/suggestion from folks/experts/attorneys who have filed it online and didn't receive any issues.

  4. Hi VJ Community Members,

     

    Had a quick question on "Mailing Address".
    My and my spouse both are living in India. In the i130 form - Page 2, Part 2, 10a to 10i , for Mailing address details should we mention India's address (as we are living here currently) or we can mention a relative's U.S. address (where we intend to live after the IR1 process)?

    Does it make any difference interms of communication with USCIS and overall turn around time for the process? Does USCIS send NOA1 and NOA2 and other communication to foreign addresses in the current COVID pandemic scenario?

  5. Hi,

     

    I am submitting my i130 petition package by mail (offline).  I have arranged all the documents as color photocopies. 
    Just wanted to check if that is fine or USCIS needs documents in black/white. I couldn't find any specific instructions for the same in the i130 instructions guide, hence thought to check on this forum.

     

    Another question, i have signed the petition with black ink. I hope that is fine and shouldn't be a problem.

  6. USCIS has recently released notifications for new forms, that needs to be used from 19th April,2021 onwards( this may vary based on different forms). I don't think they have released an updated form for i-130, however they have mentioned the below statement on the https://www.uscis.gov/i-130 page.

     

    "USCIS published new form editions for affected forms. Starting April 19, 2021, we will only accept the 03/10/21 editions. Until then, you can also use the prior editions specified on each form webpage."

  8. Hi Team,

     

    I would like to proceed with the DCF process to file for IR1/CR1 for my spouse in Delhi, India.
    Below are my few queries regarding the same:

     

    1. Is DCF still active across Embassy/Consulate in Delhi, India? Are they accepting DCF applications?
    2. What is the process to go for it? I have the form i130, i130A and supporting documents ready. What should be the next steps?

    3. Shall i take appointment at Embassy first, and visit there to submit the documents?

     

    Would appreciate if someone would provide clarity, provided things may have change post pandemic.
