Hi everyone! I’m in need of some advice as our situation has changed.
Shortly after I filed the I-130 for my husband (he lived outside the US/never been in the US before, I live in the US) he applied for an H2B work visa and got approved for it. He’s now in the US working for the company that sponsored his visa in a different state from where I live.
I spoke to my attorney about AOS and she advised we shouldn’t do it yet until he’s physically living with me because we run the risk of USCIS believing it is a fraudulent marriage. We have proof of all the times I’ve visited him in Mexico as I do have friends and family down there as well along with all the other evidence we sent off with our I-130. We also don’t want to get into trouble if he just moves over here with me while still being under contract with the sponsoring company.
Should we wait to file AOS or should we go ahead and do it now? His contract expires the end of November which I estimate it’ll be around the time he will be scheduled for an interview if we file soon. And of course, we want to be together as soon as we can!

It took us 6 weeks to get our NOA1 in the mail. Don't worry, you should be getting it soon hopefully.

Oh no, that's not for the approval. That was 6 weeks of waiting to get our received receipt. I'm sure we've still got many more months of waiting for an approval. 😕

Finally, after 6 weeks of waiting and waiting, received the NOA1 yesterday.
Sent: 2/26/21
PD: 3/8/21
Received NOA1: 4/12/21
Texas Service Center (although it says Nebraska online
)

Mine was received on 3/5 in Phoenix. I talked to someone on the 30th and they said it wasn't in the system either. The next day I got a text that it had been received and got an electronic receipt number. Did you file the G-1145 form with your i130? The G-1145 is the form to opt into e-notifications.
I don't think we did, I should have though. I just checked my bank account today and they just cashed the check. Hopefully I'll get a receipt here soon!

Mine was received 3/3 at the Phoenix lockbox, no receipt yet, spoke to someone and they said it's not in the system yet. I'm trying my best to be patient... 😔

Hello! Our I-130 was mailed 2/25/21 to the Phoenix lockbox. Tracking # says it was received by USCIS 3/3/21, but I haven't received the NOA1 yet. Hopefully soon
