    Ha... I just reread your post and counted back the months. We got his EAD (which was dated effective last October 25, 2005) in early April of this year, 2006. At that point, it was already 6 months old. We might as well have applied for a renewal the day after it arrived.

    Just posting because I woke up stressing at 3am.

    Drafting emails to more elected officials; the first round went out at 8pm.

    I hate this process.

    I doubt you will find an elected official that will convince USCIS to make an exception to their rules or to make an exception to the current employment authorization requirement. Your failure to renew at the proper time is not going to create an emergency for them. I'm not being mean--just honest. It appears that he will be taking a bit of unexpected time off.

  3. I've emailed every single elected official I can think of... and just sent out an 'urgent' update... we'll see what happens. I once had good luck when I lived in Indiana (and LOVED senator Lugar and his office) but have yet to hear a word from anyone in New York. Here's to hope.

    I was pretty pissed off to learn that hubby's EAD was backdated 2 months due to it being *approved pending biometrics*. I threw a fit when i saw that. Unfortunately, this happens frequently. Yours is even more extreme as far as backdating.

    It used to be that you could go to the local office to get an interim EAD (that was essentially nixed 9/1/06) however I do not believe a renewal can get an interim... moot point anyway, but this is what you may be thinking about as far as help at infopass for EADs.

    Have you contacted your elected officials re: AOS application? You have got to be way past the processing times by now. Thge only thing I can think of is Hisham got a name hit and they are trying to clear it prior to the interview. In our case we had the interview anyway.

  4. Thanks, Yodrak. But there's no such thing as walk-ins for EAD renewal? What do people walk in for, then? (He's gone twice trying to get further AOS info, trying to figure out why they cancelled our April interview and what else we should do, but they've never been able to tell him squat. Just wait. We already did the biometrics last November, almost a year ago, so what else can they want? And why was the EAD we got in April dated 10/05 to 10/06 instead of April to April for crying out loud?!)

    Not annoyed at you, just annoyed in general... Walk-in infopass appointments have been a total waste of time and money for us then. That's truly disturbing.

    There's no such thing as "walk-in renewals".

    Looks like Hisham may have out-foxed himself by not applying for renewal of his employment authorization several months ago, when he should have given that the AOS was uncertain. Even if the employer did accept photocopies, the photocopy would show that he's no longer EA.

The AP came in November, and the EAD finally came this May, but it was dated effective 10/25/05 to 10/25/06. (We had no clue why, and never got a decent answer through the disinformation line.) Then we got an AOS interview appointment in April of this year, but they sent a cancellation notice two weeks later and never sent a new appointment letter. Hisham's been to two Info-Pass appointments in NYC since then, but they've never had any new info. And so we wait.

    Meanwhile, at the beginning of this month he was offered a promotion at the job he got earlier this year (while he had a valid work card). When we realized that you have to send the original work card with the renewal application, we decided to hold onto it for the next couple of weeks, until it expired, since we didn't know when training would begin and figured they would ask to see it then, and since a coworker of his had commented that photocopies don't count. (That is, if they ask you to show a work card, she said, it has to be the real thing, they don't accept photocopies.) ....

  5. Hi there Christina, long time to see (or type, as the case may be). Maybe I got outdated info or had outdated paperwork, but I'd been under the impression that the original card had to be sent in with the renewal application. I'm currently looking things up online. Regardless, the renewal with the card enclosed is already in the mail and gone. That's too late to change; all we have is the front and back photocopy that I saved in our files. What I'm desperate to figure out is how EAD renewals work in person; do USCIS district offices typically issue any kind of stamp/evidence/receipt approval in person at a walk-in EAD renewal infopass appointment...?

    Unless there was some kind of new update to the EAD renewal forms/directions, I don't find it saying you have to send the card in.

    When we filed to renew Sujeet's EAD, we sent the renewal application 3 months before the EAD would expire(which was a waste of money since the GC was approved before the EAD expired. But it's always better to be safe than sorry).

    You only have to send a photocopy of the front and back of the EAD when you renew. See these instructions:

  6. I haven't been terribly active on VJ lately because of work. Or "overwork," I guess, is more like it. But if you want to be REALLY freaked out, go RIGHT NOW and check my latest post in the Working Before Green Card area. You'll poo in your pants, I swear, because we have an immigration process EAD Halloween nightmare in progress...

    Any VJ old-timers, I beg of you, please advise there.

    Now today his new boss told him to bring a valid work card on Wednesday (when he goes in for a new training program for the promotion). We mailed the renewal application last week, so the original card is now gone. It was expired as of the 25th of this month anyway.

    When Hicham told him earlier today that he didn't have the new one yet, the boss freaked out. He asked if Hisham at least had an I-94 with a work stamp. Hisham said yes, because he DOES have an I-94 in his Moroccan passport that's stamped and says that he's valid for parole until January 18, 2007.

    But today, when Hisham got home and told me about it, I grabbed his passport to check and I saw that his last I-94 (from a trip he took with his AP) doesn't actually say WORK authorized until January 07, it says PAROLE authorized until 1/07. So then it was MY turn to freak out...

    CLIMAX:

    I'm currently trying to schedule an Info-Pass appointment for tomorrow or Wednesday for him, because he NEEDS that renewal NOW, or else he'll probably get terminated (let alone losing his promotion) on Wednesday, because I'm really scared that "parole" probably doesn't mean you can work...

    Are walk-in renewals typically granted on the same day...?????

    I'm just looking for some support, I guess.

    We submitted Hisham's AOS, AP and EAD forms last August... by which I mean August 2005. AP was approved late last year. His EAD finally showed up this April. But we have had NO action or feedback at all on his AOS since he went to get his fingerprint appointment done last November.

    I've called the hotline once per month, typically, ever since February. No help, of course. We had them "run a check" on it and "issue a referral number" months ago, but no update ever came. We've done two info-pass appointments since; the first was a "just keep waiting" in May and, at the second, the NYC Federal Plaza computer system crashed right before his number came up (and after a 2 hour trip and 2 more hours of waiting). We haven't resecheduled since that happened, last month, just because taking a day off to make the trip is such a hassle. Especially when you're losing hope, you know?

    We got an interview appointment letter back in April, but then a cancellation notice came. The cancellation said that a new interview date would be assigned, and that we'd be notified by mail. No mail ever came.

    I don't know... This is really beginning to feel *beyond* ridiculous. But I know the system can take forever, so am I being too antsy? Should we find some way to go raise heck, or just force ourselves to keep being patient...?

    I'm honestly at a loss. Just wondered what the rest of you think.

    First, Hisham and I send congratulations on your relationship and your decision to file. Things may seem to take forever, but time always passes like molasses when you're separated from someone you love. (F)

    Let me also say, from experience, that waiting -- while horrible -- does work out in the end. Hisham and I are living proof of that. Sometimes, we were both terribly lonely. I agree, that part does suck. But putting up with the wait and doing things rationally (especially when your education is at stake) is worth it, because finishing your degree is an investment not only in your own future but also in your future as a couple.

    I too am working on an advanced degree, which is why H and I had to file the K-1 and have him move here instead of me just running off to Morocco. Since H never made it to college himself (yet), my being able to get a really good job anywhere in the world, if need be, is really important. H used to have this attitude (maybe your sweetie does too...?) that wherever we were, and whatever happened, he'd just go out and get two jobs (or three, or four if need be) and somehow everything would be fine. Well, spending a year and a half in New York, paying NY bills with a wife in grad school, sure did cure him of that delusion! :D He understands now that being financially/educationally conservative and taking our time was for the best... We've even decided, mutually, to put off starting a family until I've finished all coursework, wow.

    Don't play around with finishing your education, Christina. Let him know that it's important to you. As long as you guys have plans in motion and a timeline in mind, the happy reunion will keep getting closer. Figure out, with him, what you two need to do to make the waiting work. Then work hard, be strong, and start crossing off the days...

    Thank you all for the support and encouragement. The Algerian ecomony is not doing too well, and it is extremely difficult for an illegal immigrant in Spain to get any kind of (steady) work. My fiancee's decision to leave Algeria was personal, and he still feels that in time it will be the right one.

    One of the many things my fiancee has taught me is that we should all be extremely thankful for the many opportunities we have in this county. I cannot imagine how difficult it must be to live in a country where you are unable to find work and unable to travel, to look for better opportunities. We are in love, and both know in our hearts that its best for me here to study. But like I said, there are some nights when you just feel really down, and need support, and that is what I was looking for on these boards. I don't really get this support from friends or family, who really cannot understand my situation at all.

    Thanks again, and I'll start filling in my timeline when we apply within the next few weeks.

  10. Sorry that you are facing such frustrating difficulties.

    I have no advice, besides to suggest that the police certificate is not the most important part of an application. Do what you can, and ask others who have been in similar situations for their advice. Tell him to ask around, too. Provided that you both have all of the other required info, perhaps you can find a way to submit your papers without his having to return to Algeria.

  11. I think I remember seeing a post here once about when cancelled infopass appointments become available for others to take...

    H and I wanted an appt for next week but couldn't get a slot in NYC until the 30th. If people cancel their appts for next week, when do those slots open up on the infopass scheduler again...? I tried to find the answer through search here but couldn't, sorry. So if anybody remembers what day of week/time of day the USCIS infopass appointment availablility gets updated online, please remind me... MANY THANKS!

  12. By the way is it true that women going through ME/NA don't go through AR or AP???

    I've never heard of a Moroccan female facing the same extra, post-fiancee visa interview period of background checks that Moroccan men typically do, but that's just what I've noticed casually. Some women in Maroc and other MENA countries may have gone through it (in K1 or K3 cases) and I just never noticed... anybody else care to comment?

    PS: The K3 process for women might be different than what I've noticed with K1s... good luck finding answers.

  13. Ummm.... so, why hasn't he received his EAD/AP yet? Maybe I missed something?

    AP was approved late last fall (see sig). EAD NOA1 came last fall saying to wait for a Biometics appointment letter... and no letter ever came. We called the NVC three times starting in January and supposedly had a "check" issued on his EAD case status in February, or so said an NVC guy. The NVC guy said a letter about the status check would come in 4-6 weeks, but no letter ever came. So in March we got a letter for his AOS interview to be held in mid-April, but then a cancellation letter arrived one week before. At an InfoPass appointment that same week, a woman at Federal Plaza in NYC said that the EAD had been approved months before (wish somebody could have told us that at the NVC when we called the three times before...!) His EAD card finally came two weeks ago... with a valid date from October '05 to this October.

    So all three -- AP, EAD, and AOS -- went to Chicago last August, and all we have to show for it since two weeks ago is his AP and an EAD card that'll expire in 6 months.

    Turds. All of them.

    The NVC can suck my... umm, thumb. :thumbs: Yeah.

    Anyway. That's the whole story. If anybody else has any clue what's been going on in New York recently, I'd love to know.
