  1. I had my Biometrics done yesterday which went smoothly and when I got home I had another dreadful big envelope from USCIS.

    With little surprise I opened it and found another rejection letter for my EAD!!!

    I sent the form downloaded from the USCIS website the second time around and still got rejected.

    Now, when I send it in the third time it's going to come back because it expires 08/31/08...

    The same thing happened to me a while ago,we also download the EAD form the USCIS website,but later on they sent me a rejected letter saying the version of the form i used is no longer accepted.Well there 's nothing you can do but send the new form they give you . BTW,i just got a Boimeterice letter for the EAD .Good luck with you ~

  2. I have a question for you guys....

    We received our NOA for I-485 but that was it. Did you get NOA's for all 3 (AOS, EAD, and AP)?? Or did they all come separately? We did file for all 3 at the same time but we only got the NOA for AOS today....nothing for EAD & AP (yet).

    Hey,it seems pretty much the same thing happen to us , we apply I-485,I-131,I-765,but so far i only got the first two notices,still no I-765 notice yet.I had my finger print done for I-485 two days a ago,i asked the officer there,he said that happens some time that people don't get all the notices at the same time,he think i should hear from the I-765 notice soon and also most of the time if i already have the finger print done once,the I-765 appoinment will be taken care of later on .Hopefully that would really happen ,good luck with your case:)

  3. I-485, I-765, and I-131 are handled seperatly so sometimes NOA letters will come at different times.

    From reading USCIS has been consolidating biometrics, so the I-485 bio may take care of I-765.

    I wouldn't be so concerned. If you got a Biometric's appointment then it's good. But if you are really concern then go ahead and call their 1800 number and see what they tell you.

    I agree don't be too worried if you have the Biometrics Notice then you can be comforatble knowing your process is moving along smoothly.

    You are right,we shouldn't worry to much ,we will find out in Aug,6. :P

  4. Well, that is true that you cannot or they would not do anything until 30 days have passed. Also, they wouldn't issue a biometric letter without having your I-485 checked and put in the system. It would not go in the system without a I-130, so I think I would wait a little bit longer before doing anything.

    Unless she married outside of the 90 days - there is no I-130 in this case. Regardless I fail to see how this answers the question she asked.

    lyly - I would think the most annoying part of not receiving your EAD NOA would be not being able to combine your biometrics into one visit.

    We married in the state.You are right about the EAD NOA is really the main thing annoys us now.We just have to wait and see what happen in the biometric appointment.

    Thank you for the reply.We are still waiting for the EAD NOTICE,haven't come yet.We all think they though we only apply AOS and Travel Document.The only thing i hope they can tell us something about my EAD notice when i have my fingerprint done in Aug,6.

Until today ,i finally figured out why we got a RFE our REF on AUG.9.It actually didn't request us any futher evidence,they mailed that RFE to us because of this Public Notice made in 2006.I hope this might help some people if they also got a same RFE like ours,as i knew one other people also got this,anyway i am happy i know the answer to that so-call RFE.This bugged me for a while.Good luck wtih your NOA2 guys:)

    Lyly, I have two *possible* explanations as to why you received a RFE.

    (1). The I-129F you submitted was not the most recent form they expected to receive, and therefore they issued this RFE as a matter of standard procedure. You can check if this is the case by looking at a photocopy of the I-129F you submitted. Check to the version of the i-129F you submitted. The version is listed in the bottom right hand corner of each page.

    The current version as of today is "Form I-129F (Rev. 07/30/07) Y"

    The prior version, which is also still accepted is "Form I-129F (Rev. 11/24/06) N"

    If the version you submitted does not have either the current or prior version text exactly in the bottom right hand corner, USCIS will issue the RFE you received as standard procedure.

    (2) Even though you submitted the correct version of the form, the USCIS adjudicator put in by mistake that you submitted an older version of the form, and therefore an RFE was issued.

    No matter what the reason is, I advise you to complete the RFE thoroughly, make a photocopy for your records, and send it back ASAP with some method that has tracking.

    I even have a third reason -

    (3) If you printed the I-129F so that the version was cut off (probably due to printer margins) they will probably be required to issue a RFE as well, as they cannot see the specific version you submitted.

    thank you very much for providing me so many infomation,but none of them above messed our I129F up.again,we didn't require for a RFE. if we got a RFE,the USCIS website will show that.we prepare a lot eviden when we apply for the visa. they requested us to refill 2 questions ,that sounds ridiculous!anyway ,we sent again ,and what's see what they gonna ask for again.

    Are you sure they said you missed answering all of those questions?? I can't see them intentionally claiming this unless there really was some kind of mistake. Is it possible that you sent them one of your copies that wasn't finished or something? That's pretty bold of them to lie like that. Wouldn't it have been easier for them to claim your petition was missing or something, I mean if they were looking to lie and clear up some space. Very strange. Did you get this notice in the mail or in your email or what? Can you call them and get clarification?

    1.They think we missed answering those questions i listed before.

    2.Three people checked it before we sent it,nothing seemed missing at all.

    3.We got a post mail from HSD,not via email.but i have to montion my other friend got this notice via email .both of us were told to fill those missing part out and send it back,and they will handle it within 2 weeks.

Guys,We had very hard time today ,after waiting for NOA2 for 100 days,today we got a mail from Homeland Security Department.We was told that we missed filing something in I129F,this was ridiculous.I checked it ,and my fiance checked,and so did his mom .Three of us checked before sent the packege and nothing seemed missing.And what was smelling even fishy is one of my friends ,the same thing happened to them last week,they also filed in vermont .when she told me that,i felt very soory to them and hopefully nothing like that would happen to us,unfortunately,it happened.#######!they did this to us.We didn't hire a lawer to deal with our k1 visa,but my friend did.And the lawer told them lately a lot of customers complain the same stuff happend to them.We are not suckers ,why the hell they gave us such a lame excuse to delay our case!!!!
