  2. I have had my last squabble with my husband regarding immigration. I think 3 years in any immigration system is more than cruel and unusual punishment. While I have always questioned his motivation and he has always responded that he is naturally a procrastinator, we have fought about immigration since the beginning of our marriage.

    The last few weeks have been us making plans to move the kid, dog and him here this summer. I have been pushing him to get all his paperwork in order (get a new criminal records thing done since the first one might very well expire before he ever makes it to the interview, get his shots updated, etc) and he has been dragging his feet. He claims that there is no point in doing it early because it might expire. The original plan was for me to fly to Toronto, rent a car, pick everyone and their stuff up, drive to Detroit, switch cars (yes, you can do this btw) and finish the drive to Phoenix where hubby would stay as a visitor as long as allowed or until he had to return to Canada for medicals, interviews, or his citizenship processing. I did the math, that roadtrip would run ~$3100. Its definitely cheaper to fly but the dog was the problem. I was leaning towards finding the dog a new home in Toronto, but he wasn't having it, so I dropped that from the list of viable options. The dog can fly via Air Canada except between June - September for $150 with his paid ticket. Regardless, since all 3 of us would be living on my income alone, its not like there will be tons of extra cash to afford multiple trips back and forth for him to Canada to get stuff done. So, we were down to him waiting until he could bring the dog via air or making the trip via road. But, and a big but, I wasn't going to arrange any of this until his paperwork was all in (do I need to mention that I have been waiting for him to get a translation of his birth certificate since February?) My paperwork is done. I have an employment letter, my tax transcripts, and can print off pay stubs the day I need them. My I-864EZ is completed, it just needs a signature.

    His perspective: it will get one when it needs to get done. He, and I quote, "Doesn't do what I don't want to do and I hate when you tell me what to do!"

    So, after he slams me with some horrible emails, name calling, etc, I booked a flight for my son for right after school gets out and sent my husband (soon to be my next ex) the confirmation. All he has to do is get the kid to the airport in time. My husband can do whatever. I am tired of living in limbo and if he wants to come down here, he can make his own way, with or without the dog or he can stay whereever he likes for as long as he likes. Bottom line: I don't even care anymore. But hell if I am going to spend 3-4 days stuck in a car for this jerk off not to mention, I feel no obligation to bend over backwards for him anymore.

    Perhaps I am just not the marrying kind. Perhaps I am just tired of living this way. Perhaps Immigration got the best of me (can't use the word 'us' here because he has been rather disinterested from both processes we went through). I feel like if I don't do everything, nothing gets done and he is a dependent of mine rather than a partner. Perhaps me and him are just too different and we were both too stupid to figure it out earlier. Peraps I equate his 'procrastination' with a lack of caring or concern.

    I am just done. I am not going to withdraw my petition, but I am not going to do anything about it either. No phone calls, no tracking, no checking the USCIS site, nothing. He wants to come, he can do everything or anything or nothing. I just don't care what he does or doesn't do. I am going to Western Union him some funds that he had transferred down here earlier and call it even or at least try to cut my losses. End of story.

    Thanks for letting vent and unless there is some dramatic turn of events, I don't see any need to come here anymore.

  3. Thanks Trail! I guess we are not out anything if we do try and it is denied or stalled since we are not gaining any ground anyway. Hopefully, the I-130 will be approved prior to December 2008.

  4. Did USCIS stop processing I-130 applications (ie not issuing NOA-1s) for a period of 4 months when you applied? Not to be rude, but things are a bit different since you applied 3.5 years ago. I was initially expecting a 1 year process when I first applied as well, but 7 months later, I have modified my plan and am thinking closer to 2 years.

  5. My husband is planning on coming to stay with me next month and stay until the term of his I-94 (presumably 6 months so ~December 2008). Our I-130 is still pending with USCIS and it was assigned to an adjudicator over 1 month ago and the petition has not received any attention since that date. If the I-130 is approved while he is still here on the I-94, is it possible to apply for AOS after the approval? Or is there really any point to trying to anyway?

    We are literally stuck in our process. We cannot get any assistance from our senator's office until August 2008 and I doubt there is any real help to be had from that direction anyway. We originally had planned on pursuing the IR-1 and skip the rest of USCIS involvement in our lives after it was approved, but its been so long now, I don't know what to do anymore. I am also considering filing a I-129 to get some action on my file, but it seems silly after waiting for so long.

    Suggestions?

    basically all I am going to say is how rediculous it is that VSC has not moved I-130 processing dates for 3 months and the month before that they only moved to go BACKWARD. and that FAMILY visas are far behind work and fiancee VISAs and that family should be priority.

    Also I will state how long we have all been waiting (in DAYS..) and that noone cares about us.

  7. I called CSC today since they updated the dates on the website to November 2007. I was informed that my petition was assigned to an officer for adjudication. So, it is now off some shelf and moved into some other pile. I refuse to get excited about this since I think the USCIS employee on the phone was just humoring me.

    The other services rely on the commercial airlines and subject to their restrictions, so looks like we are down to driving from Toronto to Phoenix (again). Ick!

  9. can someone give me an idea of when my case would be approved? i mailed it on 3-31-08 and i got a NOA1 on 4-8-08, touched on 4-11-08. my case is at CSC, please give me an idea so i can try my process for NVC. thanks

  10. I have two things to note here:

    I lived in Toronto for 2 years (pending immigration with no work authorization the entire time). When I first arrived, I didn't think the CIC process would be so drawn out, so I contacted a couple recruiters and interviewed quite a bit. I got alot of the same responses "We definitely have a position for you, call us after you have your work authorization." Interestingly though, I interviewed with a couple employers who stated that they required more "Canadian" experience and did not qualify. What I found amusing is that I was interviewing for tax positions doing U.S. corporate income tax for Canadian companies. Those are the same tax forms I have years of experience with. Go figure...

    When I decided to leave Canada and withdraw my CIC application and instead sponsor my husband into the U.S., I started looking for work long distance. I was flown down for an interview 1 week after submitting a resume and offered the job the next day, complete with relocation benefits. I was moved in, working, and feeling productive less than 1 month after starting my job search.

    Like everyone has said, it depends on the area and your occupation. Generally, for any kind of skilled labor, it is easy to find a decent job just about anywhere here.

  11. I am not sure how you can fit #3 into your situation. Clearly, your wife's pregnancy is under your (or both of your) control and your ability to travel back to the U.S. is available. I would think #3 would apply more to things such as natural disaster, war, etc that would prevent you from activating/re-entry on the visa within its time limits. In my opinion, you have 2 options: 1) move to the U.S. and activate/reenter or 2) stay in her home country and start over from scratch when you are ready.
