Hi y'all, got an RFE for my spouse's I-864 "because it has one or more deficiencies." I'm filling out the new one and realized that because we filed the I-485/I-864 in 2022, and the RFE came in 2023, I may have to now file my 2022 taxes before I can do anything with this, because there's now a new year included in "the last three tax years." So... do I need to do my 2022 taxes first? My 2022 taxes are going to suck because one of my previous employers doesn't want to send me my W-2 and I'm going to have to fight them over it lol, which is the only reason I'm not just doing my 2022 taxes right now to be safe... I CAN'T do them yet. :')

Your visa is in final processing. If you have not received it in more than 10 working days, please see the webpage for contact information of the embassy or consulate where you submitted your application.
For more information, please visit U.S. Consulate General Rio de Janeiro.
WOOHOO!!! My fiancé's interview was Feb 8th and his medical exam was Feb 14th. Visa finally issued March 16th, apparently! So we're just waiting on him to actually receive his stuff in the mail. So happy. Soooo freaking happy!!!

I am totally confused.
AFAIK, and I went thyotgh the process, nothing about the entire K-1 process is online.
It's confusing to us too.
When he scheduled his interview online, the site also had him schedule his ASC appointment. He scheduled it for the day before the interview in the same city the interview is in (Rio de Janeiro, Brazil) and received an email confirmation of both the interview date and the ASC date. I can't find anything online about this happening for other people, so I'm wondering if it's specific to how the Rio Embassy is handling things or something like that...
-
Hi Rio friends, feeling kind of crazy right now. Did you schedule your ASC appointments online along with your interviews? If so, did you receive a I-797C notice in the mail confirming the date you'd scheduled? How did this get handled at your ASC appointment? My fiance has his ASC appointment in about 2 hours (and his interview tomorrow) and we're only just now realizing that the I-797C biometrics interview scheduling is a separate form and isn't his email confirmation of his appointment, so we're a bit panicked.
-
Hi all -- My fiance scheduled his ASC appointment himself online alongside his interview. He never received a I-797C related to it and we thought that was normal because he has an email receipt showing what date and time the scheduled appointment is, along with his confirmed payment. His ASC appointment is in 2 hours and we're now really confused/scrambling to try to figure out what happened.
I've read online that other people have been able to contact USCIS to get a PDF of their I-797C biometrics letter, but that's about a biometrics letter that ASSIGNS you an appointment, not about one that confirms an appointment you scheduled yourself online. Please help, we're a bit panicked lol.
Is it normal to not have a I-797C if you schedule the appointment yourself? Is this a Brazil-specific thing? I can't get through to USCIS on the phone (shocker), so I'm hoping for some clarification from you guys. Thank you so much!

@ori8 Appointments for February 8th & 15th are available right now!!
You are an ANGEL, I'm going to cry!!! We got a spot for the 8th and were able to FINALLY get a cash payment to work (literally every credit card I tried was declined, including ones with travel notices... but we managed to do a wire transfer and then pay cash). Such a relief. THANK YOU!!! ❤️❤️❤️

@ori8 We just scheduled our interview for 01 FEB 2022! There were only 2 other time slots available. I hope you're able to grab one of them!!
I'm so happy for you!!! ❤️ And thank you for the quote notification, I got into the system and tried to schedule but my card was declined.
By the time I got off the phone with my bank to unfreeze my card (because they declined it for fraud since it's a Brazilian payment... whoops) the site was already out of appointments. RIP. I'll keep my eye open for the next round of openings!!

Question on scheduling, has anyone dealt with "No appointments available" before and if so how long did it take for appointments to show up? We've been checking regularly for 4 business days now and nothing has come up yet.

I made a doctor appointment in Belo Horizonte, they seem to have availability for sooner than that.
However, I scheduled my interview early last week and the earliest date I had was for the first days of January 2022. So unless there are some people rescheduling, I don't think you will be able to bring your fiancé this year. Maybe the doctor availability has to do with the interview availability? Have you scheduled your interview?
Damn, we were going to schedule after work today and I was hoping they'd still have late November/early December slots open T__T But it's fine if it ends up being next year, that just means NEXT Christmas/Hanukkah/New Year will be our first one together and we get a whole year to plan for it
I feel so lucky to have y'all as a resource so we can get a better idea of how things are going before we actually get into the guts of scheduling. I'll update here/my timeline when we get our dates scheduled!

The Embassy sent us the interview info packet today after two emails over two weeks.
However, it looks like the SP doctor isn't taking any new appointments until February 2022. Have any of y'all had success scheduling at the other doctors recently? Or any advice on how to follow-up with doctors offices in a sufficiently annoying but not TOO annoying way to try to get an appointment sooner? I'd really like my fiancé here before the end of the year if at all possible, but I know everyone else feels the same way, so it might not be possible... but still hoping to try! I will gladly fly him to BH or Brasilia if I have to.

I reached out to them a few times, they usually got back within 3-5 business days. I would ping them again if there is still no response.
@All - we just had our interview today and she was approved! We're over the moon. The interview was painless, we were careful to have all the requested documents in order, along with additional supports just in case. Thanks to everyone here for the solidarity and information sharing. Best of luck through this process - the first of many more hahaha.
So happy for you, and thank you for the advice! We will ping them again today. I'm so glad for you and your fiancé. Congratulations!!! ❤️

You wait. The doctor won't schedule you without the go-ahead email from the consulate.
Thank you!! ❤️ That helps, we were getting confused about whether we were slowing ourselves down by continuing to wait or something. Appreciate the help!

Hi gang -- CEAC status tracker says our case is Ready. Does this mean we can go ahead and schedule our interview, or do we need to still wait for the information packet from the embassy? I already emailed them requesting the packet (3 days ago, I'm hoping they get back to us today).

I called NVC this morning and got my Rio de Janeiro case #. My case arrived at the NVC on Sept 28 (NOA2 Sept 9) and the person I spoke with said it's already out of administrative processing and should go to the consulate in the next batch.
I'm SOOOO excited!! It doesn't feel real!!!

Case Status changed to "Ready" today!!! 🎉🎈✨
3 months ago I thought the likelihood of getting to this stage this year was extremely low (if not impossible). Brazil had a HUGE backlog and people were waiting at NVC for over a year. But all of a sudden, things started moving fast and here we are. Stay strong and positive everyone!!
I'm so happy for you two and I feel so much more hope for my fiancé and I because we have similar NOA2 dates!! Thank you for inspiring us!! ❤️

I'm really feeling the highest highs and the lowest lows with this process -- I went from having a complete breakdown a few days ago at the thought of our mistimed expedite request taking weeks longer to jumping for joy last night when we got our NOA2!! I'm so happy!! Thank you so much for your support, everyone. Every time I saw someone post "We got our NOA2! Don't lose hope, you'll get yours soon too!" I'd think, "yeah, right. You're just being positive because you already HAVE yours." Now I get it. It really does come so much sooner than you expect and it's such a weight off your chest. Praying everyone waiting gets yours ASAP.

Sorry to come in here and vent, but I'm just so tired. I requested an expedite due to increasingly bad health issues in mid July and all it did was set my case back. Basically, due to a bunch of weird communication issues on USCIS's end (that I did my absolute best to avoid -- I called them regularly to ask about my case, asked my Congressman's office to follow up for me when USCIS took way longer than usual to acknowledge the request, etc.) it might take at least another six weeks to get our NOA2 -- even if the expedite is approved.
And I was an early January filer, so if I had never made the expedite request, we would have our NOA2 by now.
I feel like such an idiot. I know it's not my fault and that I couldn't have known the expedite would have these delays, or have known that January cases would be processed so soon, but it still FEELS like my fault. My health is getting worse and worse from the stress of it all. I'm trying to keep myself occupied by doing whatever I can (more immigration paperwork, cleaning the house, etc.) in the meantime, but my health issues involve a lot of fatigue, pain, and depression, which all make it very hard to get anything done. I'm getting treatment, but it's not helping yet. I feel like I'm trapped in a cycle of trying really hard to improve things and then watching them backfire... It's just so exhausting.
Sorry, just needed to get this off my chest somewhere to people who will understand how frustrating it is. My partner has been nothing but supportive, thankfully. I just feel like I have to talk about this somewhere else to make it stop circulating endlessly in my brain.

Hi all -- My fiancé will change his legal gender (currently female, changing to male) and legal full name at some point after he arrives in the states. I'm trying to figure out what point in the adjustment process it would be easiest for him to change it.
I was wondering if rolling the first/middle name change into the marriage last name change would work best? We plan to pick a new last name together for both of us and switch to it together a few months after we get married. But I think he'd be okay with taking my last name for now if that would make it easier to change his first/middle (and then we both change our last names later on).
If anyone has had experience with this, or with changing legal gender marker during the adjustment of status process, please let me know. I really appreciate any assistance! ^^

You need to get Rio to request the file
Thank you! So that means that once USCIS sends it to NVC, I would request an expedite through the Rio embassy itself and then they would request the file from NVC? I don't submit an expedite to NVC itself?
-
I keep seeing people on VJ say that if you get an expedite approved at USCIS, it doesn't affect anything but USCIS and you'll have to request a new expedite at NVC and then at the embassy.
Is this true?
If so, how does this work for K-1 visas? I've seen several posts that K-1 visa's CAN'T be expedited at NVC because they're "automatically" expedited, but my understanding is that NVC doesn't process your case until the embassy is ready to receive it... and my embassy (Rio de Janeiro) isn't receiving any cases that aren't "emergencies" (which I assume means manually expedited rather than just "it's a K-1"). So... how do I get my case to the embassy if I can't expedite it? This is all so confusing lol. I appreciate any guidance.

Mailed mine Jan 5th, just received WAC. They tried to cash the cash 3/4 and 3/5 but it bounced both times (I wrote it from the wrong account) so I think I'll be getting a rejection and have to resubmit, but they're definitely eating through cases.
They tried cashing it AGAIN today and my bank courtesy paid it!!! So we're on track still, I think! I'm really going to cry from joy lmao. It's so terrifying realizing you screwed something up in this crazy process!

Just updating in case anyone ends up backreading this for a similar issue -- USCIS tried a third time this morning and my bank processed it as courtesy pay! So I think our original timeline is on track. I could cry from joy, lol. So it does seem like USCIS might try a third time in rapid succession if they feel like it.

Oh hell yes! Thank you! I'll hold off on filing to give myself a minute to breathe then lol. Much appreciated info!
