I thought the AP/EAD are handled entirely by the center (e.g. the National Benefits Center) rather than the local field offices. Maybe yours is faster because you’re not doing AOS by marriage though.

Yeah, but what made these cases happen fast was that they had the biometrics done within a month of applying (in MKE), if you see other cases back from June, you’ll see that people get their EAD + AP a couple of weeks after biometrics. In my case, it was a few months because of the RFIE and the month it took me to gather all the docs.

Did you request an expedite? This seems to be moving quite a bit faster than others.

No expedite. I believe it has to do with Milwaukee. Things are very very quiet here. The whole MKE metro area has less than a million people, also, when my parents went for their biometrics, My mom was talking to the agent (she's very chatty) and they were telling her that things have been awfully quiet in the Field Office, and that they were thinking that it was because of Covid. Funny how some other offices are just bursting with cases.

  3. Update: EAD case status changed to “New Card is Being Produced”. For both cases of my parents.
AP remains as “my case is received”. But I guess it doesn’t matter because it’s a combo card? Either way, they’re more interested in working than traveling at this point.

Hopefully the I-485 case status changes soon to  Ready to Schedule Interview.

It's for the medical, right? When did your parents had their medical in your country before coming to the US?

We still gathering our supporting documents for the I-944.  Hopefully later this month we will send it.

You're almost going to have the schedule for interview. Goodluck

Thank you! And Yes, I-693 is the medical.

They haven’t had medical yet, for AOS you must do it inside the US with a USCIS designated civil surgeon. I’ll schedule them an appointment as soon as the status for I-485 changes to “Case is ready for interview scheduling”

  5. As expected, we received the RFIE on 11/21/2020. It gave us 87 days to return form i-944 along with all supporting evidence and a copy of all pages of the RFIE letter. We only received one for my mom, my dad’s account was updated to “RFIE sent” a couple of days later so I’m expecting it somewhere next week. I already sent mom’s school credentials to World Education Services here in Milwaukee, so I’m hoping to continue translating the rest of the documents while WES takes care of the evaluation.

  6. So this morning I was pleasantly surprised by USPS informed delivery with 4 letters from USCIS  2 for my mom & 2 for my dad.

j just opened them and they’re the biometric appointments for both of them (10/23), notice day was 10/3. They’re both in the same day at the same time. For both of them one appointment was for I-485 & the other was for I-485 & I-765.

Seems like thing are marching with the regular speed.

  7. Question about the I-944. I did not file it originally, but I'm starting to prepare for it in case we receive the I-944. One big concern I have is that my parents have never lived in the US, they came to visit in March and we applied AOS on August, so they have no US income, tax returns, or anything like that. Most of their financials (as I imagine most immigrants coming from countries in development) are not really comparable to the US poverty line, so I'm real worried about income and assets here. I believe we can provide most of the info for my parents:

-Education (bachelors for my mom  & high school for my dad)

-Certifications (my mom is a certified insurance agent in Mexico, my dad has some technical certifications in welding and such)

-We have statements from Mexican Social Security Administration showing my dad has worked for the last 30 years

-They're both under 60, no major health concerns

-We have the letters from transunion & experian of no credit history

-No tax returns or W2 since they don't work in Mexico. My mom declares taxes since she is self-employed, but my dad has always paid taxes through payroll, in Mexico, you don't do individual taxes unless you are self employed, taxes are sort of your employer's responsibility.

-Their assets are minimal, they still owe their house, probably have less than 20K USD in equity and they don't have any sorts of savings except for their retirement savings which are about $100K USD

-They're not eligible for US health insurance but my mom, being an insurance agent has a major medical expense insurance from a Mexican company, it only covers emergencies in US, not medical conditions except for emergencies.

-The biggest negative factor they got going for them is that their income would probably amount to only  $2.5K a year (yeah, it's pretty rough for them down in Mexico, hence why're they're trying to immigrate)

What's their real shot at getting their I-944 approved with that low of a salary and not enough savings to compensate for this? I feel this is ridiculous for most latin american countries, in Mexico, an engineer with a degree would probably make somewhere around 15K to 20K a year, and those are the high earners. I just don't see how they would expect my parents to earn over 27K a year.

Do I have a shot by painting a good picture with the rest of the documents I talked about? Also, my I-864 is strong but I don't know how much would that help their case for the I-944.

I’m just going to remain hopeful until I get an RFE

It certainly seems bad, It doesn't fully explain what would happen to those of us between the Jul 29 & Sept 11 timeframe. In some areas seems like we will be getting an RFE for I-944, there is only one small shine of hope in all this mess:

"We will not re-adjudicate any applications and petitions that were approved following the issuance of the July 29, 2020, injunction continuing until the date of this notice."

Not sure if that can be interpreted to our advantage or disadvantage. I guess I'll start translating a bulk-load of documents from Spanish...

  9. Never-mind I just got bombed with texts and emails, summary, priority date (not that it matters for immediate relatives would be 08/31/2020)

    For one parent
-1 email and text for: Your fingerprint fee was received

-1 email and text for: Form 1-130 case received

-1 email and text for: Form 1-131 case received

-1 email and text for: Form 1-765 case received

    For the other
-1 email and text for: Your fingerprint fee was received

-1 email and text for: Form 1-130 case received

-1 email and text for: Form 1-131 case received

-1 email and text for: Form 1-765 case received

  10. Just got one text message and one email with a case number of one of my 2 parents (not sure which). (It's funny how USCIS usually responds and sends updates during weekends or after hours) The reason why I only got 1 and not 3 messages is probably my fault, since I only included one form G-1145 per case, and I put it right after the cover letter, instead of putting one on each individual form.

I checked the case status online hoping I could get some clue of which parent that was, still no clue for which parent this was but it's curious how they're acknowledging they received form I-131, and not i-765, I-130 or I-485. Should this matter? Is this random? Either way, it's a good sign, right, right?

Another update, the charge posted on 9/18. I also got a fraud alert text from my bank on 9/19 and had to reply verifying that it was an authorized charge.

Still waiting on text notifications with case numbers for the I-485, 765, and 131.

Note that we did not include the I-944 in our package (mailed 8/31, delivered 9/1). In its place we included a printout of the USCIS website alert on the I-485 page and highlighted the following portion:

We also referenced that in the cover letter.

My payments were also posted, I have not received any email or text message though. At least it’s comforting to know it’s the same for everyone else. I knew these application would be slower than everything else I’ve filed with USCIS.

It’s only a bit worrying that we don’t have NOA’s or case numbers since both my parents’ I-94 expired on 09/05/20. So we have nothing to prove they’re staying on a “pending AOS” status

    Hi all,

Tomorrow I will be filing again for the I-485 Adjustment of Status.  I sent the package last month, but the first package went cold and was never delivered by the USPS (I used Priority Mail as well).  I contacted them and they can't seem to help me anymore.  So I'm mailing a 2nd package.  I put a stop payment on the first one in case they ever receive it.  I am so mad right now with the USPS that I will never use them again.  Using UPS this time as I find them more reliable.  It's been a month since I mailed out the first package so I think it's safe to say the other one is pretty much gone for good.

I just hope the first package doesn't fall into the wrong hands.....

Double check the revision you’re sending of I-765, there was a new version on 8/25/2020 so if you sent your package last month odds are the one you filled was the old one.

@erick_6921Thank you very much for sharing. I'm Jan 2020 MKE filer. No word after biometrics in February.

Hang in there. Seems like my case is offset from yours by 2 months, so probably you’ll be getting your interview this month. If not, I do suggest writing to your congressman, I’ll never know if this was a coincidence or if it helped them see my file. Only thing I can tell you is that right after the interview notice, things will move fast for your case.
