  1. As long as marriage was within the 90 days of the I-94, you are fine.

NOTE: the expiration date on the K-1 visa is the date that entry to the USA has to be by, it has NOTHING to do with AOS. The K-1 is VOIDED the moment is is used to enter the USA.

You may want to update profile from K-1 visa to "AOS Pending" http://www.visajourney.com/forums/index.ph...rCP&CODE=01

thanks for your help! i updated to AOS Pending ;)

  2. I have yet to find a good substitute for the Kraft pizza dough/sauce in a box mix :(

chef boyardee (sp.?) makes one. i've been in canada for 5 years, though, so who knows if they still make it anymore. last time i bought it, i bought it at save a lot/more for less, whatever it's called now. they had it in stock all the time.

  3. i don't know if anyone's mentioned this yet, but i think the period for financial liability in canada for a spousal sponsor is 10 years, regardless of whether they stay married or not. this means that, even after a divorce, if this man decides to go on welfare or social assistance at anytime in this 10-year period, the woman must pay it all back. i'm guessing she may not listen to reason, but maybe you can dissuade her from actually marrying the guy and instead, bringing him to canada on a fiancé visa. i am not 100% sure, but the period of liability for that sponsorship may be shorter.

  4. the same thing happened to us!!! my fiancé watched the dude write down "u.s. visa", we sent it out with the check, then got the check back like 2 weeks later. there was a letter saying that they don't charge for police certificates for canadian immigration purposes. we called the number on the letter and he left them a message telling them that it was for a u.s. visa and that they had sent his check back. we got a call a day or 2 later from some lady, he explained what happened to her and she told him that he had called the main reception desk and gave him the better number to call. she told him that they are super busy and that's probably why they made the mistake and also, that they were taking about 5 days to return messages. so, he calls and nobody ever returned called back. so we just left it at that, thinking maybe they corrected it and decided not to bother with him returning the check to them. we just got the prints a couple days ago and now instead of saying "canadian immigration", they say "landed permanent resident status". i guess that's good enough for me, cause technically that's what he's on the way to with the K-1.

  5. hi all, my family in the u.s. is currently assembling some documents for the I-134, to co-sponsor my fiancé for me. are the I-134's to be sent back with packet 3 or are they due at the time of the interview? i just don't want to collect everything too early and have it outdated at interview time. also, we've got about 2 months left to wait on my fiancé's RCMP check and i'm wondering what time that is due, as well.

    thanks! :)

  6. When I had mine done, (I didn't need the fingerprints part, but thought everyone needed them, so I ended up sending it anyways,) they stated on their website that it takes upwards of 120 days to get the results back.

When they responded to my email inquiry, they responded calling me a "Mr." and even had my last name spelled wrong.

they screwed up on my fiancé's too. the dude at rcmp clearly checked the box for u.s. immigration, but after we sent it out, we got a notice in the mail saying they don't make you pay for canadian immigration or citzenship purposes. don't know how they screwed that up, considering he used his canadian passport for i.d. obviously, he's not applying for canadian citzenship. hope this doesn't screw things up. we called them to correct it, but they never called back--it's been almost 3 weeks. i'm guessing it will come back looking the same, no matter what it's for. at least, i hope so.

  7. thanks guys! also, wondering if anyone had any problems with the rcmp sending their check back? ours was sent back stating that we didn't need to pay for police checks based on canadian immigration or passports, though the officer at the station clearly checked off "us visa". don't know if this will cause a problem, but we called them just in case. we got a call back the next day from a lady saying that we had called the main switchboard and gave us the correct number to call. she said they were so far behind that it would take around 5 days to receive a call back. it's been 2 weeks and they still haven't called. maybe they're not calling because it's not important.

  8. hi all,

my fiancé just got his fingerprints for his police check done about a month ago. the rcmp website says it'll be about 4 months. i notice that most of the government timelines for things here in canada are only half of the projection time. has anyone else applied for the fingerprint one and how long did it take to get it back?

    thanks

  9. another idea: can a lawyer help you with your denial mess? i know lawyers are evil and all, but in this case, it might not be a bad idea. hell, i'm thinking of hiring my own once we have to do AOS. i see too many horror stories on here and everytime i've called USCIS, they've told me seriously inaccurate information. i kinda regretted hiring a lawyer, but now i'm kinda glad, because i don't think immigration will jerk me around now.

  10. there are 2 ways to immigrate to canada as a spouse: either from within the country, or outside of the country. i did it from within the country, so i'm not sure what the rules are since both of you are outside of canada. the total process costs about $2,000 CDN and from within canada, takes about a year. however, you only have to file one packet of papers and at the end, you get your interview and permanent residence card. no adjustment of status #######. you will not be able to work for about 7 months using this method, but i was able to cross into the US everyday for work. www.cic.gc.ca feel free to ask me any other questions. the website isn't that great.

  11. no, i moved here back in 2003. i didn't have a passport until canada immigration made me get one for my permanent residency. then they stamped it when i became landed in 2004 and i haven't gotten a stamp since. they don't stamp it for me at the border and i've always driven, so no plane passes or itineraries. i've only been in the u.s. maybe 3 times in the past 3 years, too.

Do you have any proof of boarding passes, flight itineraries, bus tickets, passport stamps, etc. from the USC last crossing into Canada?

  12. just wondering if there are any USC's living with their fiancé(é)s in canada and what you sent with your application to prove your relationship. we sent our townhouse lease dated last june, maybe 2 pictures, a couple recent bills and bank statements with both our names and address on it. we also sent a form from work dated january 2005 that lists me as my fiancé's beneficiary. now we are getting an RFE asking us to prove our relationship . they also want to know when our last meeting was, lol. on top of that, both of our last two residences match and we both work at the same job. does anyone know what more they may want? or did anyone not receive an RFE and if so, what evidence did you include? thanks in advance

  13. My fiancee and I are getting more and more worried that her ex-boyfriend won't sign a "consent to immigrate" form or vary the custody and access court order. If we are denied a K2 visa, then I'm going to have to move to Canada, but still work in the US. Is that possible?

If we don't get that form before our interview, will the visa be outright denied, or could it possibly be approved pending receipt of it? The consulate in Montreal has not ever mentioned that such a form is necessary, but many of you on here has said it is.

I'm more stressed today after going to speak with duty counsel with Kristy than before. Do we look for an immigration attorney now, or a family law one? In the States or in Canada?

    :help:

it is possible to cross the border for work while living in canada. i did it for a year and a half, no problems, though, i would suggest getting a nexus right away, because it does take awhile and there are odd times when traffic's so bad you'll be late to work. there are 2 options in your case if you're looking into immigrating to canada. you can apply as a fiancé or as a spouse, if you are married. you can either apply while living outside or inside of canada. to apply from inside, all you have to do is go to the POE and tell them that you plan to apply to immigrate and they will issue you a temporary residence permit on the spot, which is usually valid from 6-12 months. it will take about a year and about $2,000 to become landed, but unlike US immigration it's just one step and you're an official permanent resident. let me know if you have any more questions. i'm an LPR here.

  14. I live in Canada also and had the same trouble. I called the number for Homeland Security and they connected me directly. I also asked for the phone number, telling them my situation and she gave me 1-202-272-1874. This is for the Vermont Service Center. I told them that their number doesn't work from Canada and they had a hard time believing it. oh well, I hope that number helps.

ah, yes 202-272-1874. that's the one. they gave me 2 numbers that i had been transferred to during my call to the department of state. wasn't sure what they were, but i called that one and sure enough, it's uscis. thanks!

  15. does anybody know how to contact USCIS from canada. the 1-800 # isn't accessible from here. will (202) 663-1225 from the department of state work or is there another number? i need to check on an RFE i haven't received yet.

    thanks!

  16. What is REF for? I was living with my boyfriend for a long time while I was at school in the US. I used to live in the apartment by myself, but it was not very safe and his family and my boyfriend asked me to live together. And I sent a lot of document sent from my university to my boyfriend address. I am planning to ask my boyfriend's mom to write a note that I was living with them and in loved with my boyfriend. I wonder living together is not very good? I think a lot of people live with their fiances before they marry.

i don't think there will be a problem with that, sunshine. it might actually work to your advantage. it's just further proof for uscis that your relationship is true. :D

  17. OMG! :o they can't be serious! i got an RFE! wow, i've only been living in canada with my fiancé for almost 3 years. we even enclosed a paper dated december 2005 naming me as his benificiary on his work benefits. what more do they want!?!:angry::angry:

YES...BUT THE GOOD SIDE OF IT IS AT LEAST YOU HAVE A LIVE BODY LOOKING AT YOUR PAPERWORK :dance::dance:

    Scott

i guess you're right, scott. i guess i was just a bit aggravated . and i'm in suspense, can't imagine what it could be.

  18. lyric, i am sorry to hear about your situation. feel free to ask me any questions about canadian immigration. i am a landed permanent resident in canada. it's about $2,000 before it's over and it will be about 10 months before you are able to work.

  19. Here's here!!!! He almost got arrested at the airport (Dorval), but he made it here. *rests head in hands*

Réjean had these spiked gauntlets that he tried to bring with him. He called TSA to inquire about them and checked the website to see if he was allowed to bring them on the plane, and he was given the go-ahead. When he got to the airport, though, security accused him of trying to bring a weapon onboard, threatened to arrest him, and ultimately ended in them confiscating them. Which is a shame since they cost him $400. They also broke the lock on his guitar case, but that's because Réjean forgot to unlock it before it was inspected.

Oddly enough, they didn't confiscate his bullet belt...

ahh! that sucks! i had that happen to me the first time i came to canada. canada customs confiscated my 2 spiked bracelets and a collar. they said they were gonna send them to "the crown" to be destroyed. at least they were only worth about $50 and not $400 :o but they were totally cool about it. they didn't try to charge me or anything.
