  1. Okay now this just seems gto be getting ridiculous.

    I have been watching the April filers to get a feel for when the May ones will be coming through and it seems they did the first week of April then just stopped!!!

    We are feeling so frustrated as I end my job at the end of August with the hope that we can get approved by the end of September.

    Does anyone have any idea why it appears others who got approved did it less than 90 days and now its well over 100 ??

    just seems crazy, and I'm sure lots of people are feeling like us, but if anyone has managed to figure this out or get an answer on the phone off CSC please let us know so we can replan our move.

    Thanks :unsure:

  2. Yeah that is exactly what I was meaning,

    If anyone overstays in the UK more than 6 months there is absolutely no way of extending any further for ANY reason.

    Am I right ?> Also from everyones posts I gather the following;

    1. We cannot be detained at the airport just maximum is have or passport stamped restricting my fiance's return

    2. My fiance's overstay does NOT affect my K1 fiance visa for the US.

    Sorry for restating just wanted to make sure, many thanks :huh:

  3. :huh: Is anyone having any luck with answers by calling in?

    We have tried a couple of times but they simply say it is pending.

    I know my timeline estimate now says begining of September however I am just like everyone here and want it approved already :P

    I say we all fly to our respective Processing Centers and take over :protest:

    If anyone gets approved from now pleaes post it here so we can see what date USCIS is working on, thanks

  4. ^_^ Many thanks for all those comments people,

    We have taken them all on board and they cover everything that we need and more. I realise there is no exact answer as it all depends on who is at the desk when you pass through I guess, however your words of wisdom and reassurance are a REALLY big help to us.

    My fiancee and her daughter and I are very worried however we feel a great ease at what has been said.

    THanks again from the bottom of our hearts. (L)

  5. Sorry you misunderstand me, I mean six months is allowed for a visit to the UK without a specific visa.

    I am aware that my immigration to the US should not be affected by this, this question is purely about what will happen at the airport when we come to leave and how they will react when they see my US fiancee has overstayed in England.

    Many thanks for all the comments though.

  6. Many thanks for your quick response;

    My fiancee says that her brother does not keep his pay stubbs, and gets paid weekly therefore asking for six months worth from his employer might be an ordeal. Do you think we can get by without these.

    Also if they did file jointly, where on the form is his wife suppose to sign the form ?? sorry were idiots many thanks for your help.

    With him not being self employed and actually working for a company could he not get away with only his most recent tax return or do you think this is too risky.

    Once again many thanks

  7. Hi I have the following question,'

    Due to the fact my fiancee has no employment and we are applying for a US K1 petition we are using her brother as a co-sponsor for the petition on the I-134.

    Q1. Her brother has a wife and children and even though he has all the information( tax returns, above poverty level, employment history etc) I recall reading somewhere that the co-sponsor must have his wife also sign the petition?

    If this is true she is willing to do this however we cannot see anywhere on the form to sign?

    Q2. Although he does not work for himself, should we still arrange for the past three years of his tax returns to be included in the submission ?

    Q3. Bank history required.

    Upon going to the bank to get an officer of the bank to give the;

    Date account opened

    Total amount deposited for the past year

    Present balance

    The bank officer said that they dont do it and have to send it off to their legal department for adjudication and then they send it back to us.

    Has anyone else had this problem or was the person at the bank just not wanting to deal with us ?

    Many thanks for any help supplied.

  8. :help: Hi,

    My fiance is with me in the UK while we wait for the US K1 visa to be approved. Unfortunately it has not been approved within the 6 months allowed however due to the fact we have her daughter in school and don't want to have to leave each other they are still here after close to 11 months.

    The question is what will happen when we do come to leave with me holding a K1 (fingers crossed).

    She has never tried to work while in the UK and both have been totally supported by me.

    ON the biometrics form we put that they were living with her Mom due to the fact that at that time we thought they would be travelling back and that is where they would have been staying.

    We thought about getting married here however it was not an option without them leaving according to a rubbish lawyer who we consulted.

    SO basically thats it. - they are here with me waiting it out.

    Any ideas? or has anyone actually faced this situation.

    I realise by the letter of the law they could be banned from coming back to the UK for a while (maybe a year I think) but how does this happen ?

    Please help :unsure:

  9. Thanks for that information, The reason I was taken to jail was due to the fact that we were both intoxicated and apparently Texas state whenever called to a domestic dispute with alcohol always takes the male off to jail and presses charges itself due to the fact the wife might be too afraid to. They were going to take my wife off to jail too at the time due to the fact that she was totally drunk however I begged them to just take me due to the fact she had two small children who would need to be taken care of.

    I guess you never called the police on whomever you are refering to, or not knowing your circumstances I am not sure why your husband was not jailed for any length of time if you would like to pm me I will talk you through further what I was told if it is still a concern of yours.

    Thanks again for the information,

  10. Many thanks for that link.

    I signed up on it and paid for a search using my full name including middle name and date of birth and it said there were no records of me.

    I hope this means that every thing will be okay. I printed it off to take with me when I finally get an interview.

    Many thanks again for helping me

  11. Also, I have read through the I-134 and there are a few boxes which I think my fiance's brother will struggle with.

    Where it says relationship to sponsor , what does he put ?

    Also box 10 where it says I have submitted a visa petition to the bureau on behalf of....should he put my name or put none as officially it is his sister who has filed.

    Also should he click box 11 as intending to make contributions ?

    Sorry for all the questions we are just thankful for any help you can give as we do not want anything to go wrong.

    Many thanks

    :unsure:

  12. I dont have a police clearance from Texas , only for the UK. However I do have a notarised copy of the Class C from Texas, would this be enough as I heard its actually hard to get a 'police certificate' in Texas for a person who is not present.

    I was not sentenced to any jail time or anything as far as the 6 month ruling is concerned.

    would this be sufficient ?

  13. My situation is as follows;

    I previously fell in love with a texan woman (I am from the UK). I moved to Texas and eventually managed to get my temporary visa after the k3 etc. However as it turned out she was only after me for the money I had at that time and wanted the marriage to (in her mind) get a claim to it.

    Once we were married she started an affair of which I find out about. She realised it would look bad to get rid of me having come to a different country and the fact that I still did everything for her and so she basically called the police and made a claim about me threatening her. I was taken of to jail and given a state appointed lawyer and given a class C misdemeanor by the Judge. Due to the fact that she then took out a restraining order I returned home. (She moved the other guy in the next day after my arrest). She took me for $100,000 and still asked for money, which i sent for her children upon return to the UK even though she was living with the other guy. I kick myself now but love can make you do stupid things :(

    So basically I have a US social security number and Alien number which i filed in on the new visa application form.

    I am now engaged to a wonderful Floridian woman and we have petitioned for the k1 visa. However although I make good money in the UK presently, she does not work and cannot support me.

    So given the facts above, does anyone have any advice to watch out for with regard to what I think are our two tricky points:

    Affadavit of support (her brother is willing to be a co sponsor and earns around $80,000 a year)

    and my class C misdemeanor

    Many thanks for any advice

    P.s. we are waiting for our NOA2 presently from california.
