  1. Yes I had an RFE on I-485, but the first guy I spoke to said that it does not affect my I-765 timeline.

    I have read in other posts that the 90 days for EAD is reset if you get an RFE. Does that include my RFE for my I-485?

    Basically, anyone got any ideas how long or anything I can do to make sure I get my EAD? Now that they have the RFE for the I-485 does it normally come quick?

    Its been almost three weeks since they received my RFE answer and my case has still not been 'touched' despite phoning.

    Please help

  2. Hi everyone,

    I am still waiting on my EAD, and its been since April 3rd, 2008 (150 days) they received it.

    I read through the USCIS website and it says to call if I-765 has been over 90 days.

    I called a few times, once a guy said that the case needed elevating as it has been so long and he would transfer me to someone higher.

    When she came on the phone she asked if I had an I-485 pending, I said yes. She then proceeded to say that it was due to this that I hadn't received it.

    But I specifically told the previous guy and he said the two are totally INDEPENDENT and that I should have received it by now. I repeated this to her and she just kept saying it was because of the I-485. I said but that makes no sense! she hung up on me.

    I tried calling back the other day and got a young sounding woman who basically said the website was wrong that it takes a lot longer than 90 days and that they are currently processing April1, 2008. I asled if there was anything I could do, she said no.

    I am wondering why you get such a variety of answers and if there is anything I can do.

    Please help, I need to work to support my family.

  3. I filed my I-485 and my I 765 which was received on April 3, 2008. I did get an RFE for the I-485 which I returned over a month ago.

    I phoned USCIS and said that my I -765 was over the 90 day wait period and that I had received nothing with regard the I 765 since April 3rd.

    The first person was very helpful and I even asked if this was because of my RFE for the AOS. He said no the two are seperate and I should have heard about the I-765 by now and he would have to escalate it and put me on hold to speak to someone else.

    When the next lady answered she said that the delay was because of the RFE. THis baffled me and I said but your colleague said the two forms are totally separate. She got very short with me and repeated what she had said about the RFE. So I repeated the question about the two being independant. She repated the RFE statement. So I asked her, Are the two independant - Yes or No? She said yes they are! I repeated this back to her - So the two ARE independent. She said "Yes".

    Then she continued to say but you got an RFE for the I 485 and they have been waiting for that, Just as I said "but that makes no sense" she hung up on me!

    Don't know wether to phone back or not. Has anyone else had similar experiences?

  4. I did the same in the Brandon area. They told me the same thing that at first it is for three months i.e. when the I-94 expires. To come back and bring the receipt notice and they would renew for one year with the 'temporary' designation.

    However wehn I received the DL in the mail it was for a year and said temporary. Don't know why this happened but I think the rule is as above.

    I received my biometrics appt today for 05/06/08. Has anyone any ideas how long after that I would receive my EAD card? Just a rough guess would be nice to know.

  5. JUst a quick one.

    I have my SSN and also my Alien number and a Florida drivers license which expires in one years time.

    But my question is this, I need to get a full EAD before 5 May 2008 when my 90 day temporary one expires.

    What is the biometrics appointment for ? (I haven't been given a date for it yet) but i thought that it was for the EAD card. I realise I must be wrong but what is it for and what do you do afterwards to get the EAD ?

    Sorry even though I've done this before and have an old expired one I can't recall how on earth I did it! all seems a blur :wacko:

  6. THanks fpr the input and advice everyone. It is helpful, but just a further thought; given that I am my families only income and have got a job already is there any form to file to speed up the EAD card at aleast on some sort of humanitarian level so we don't starve to death :unsure:

    Surely I can't be the only one who is the only income for my family and who doesn't have savings to keep me going in the meantime. There must be something to speed it up ?? isn't there ??

  7. Hey there, Im in a big bind. I came to Tampa getting the temp EAD stamp at POE and luckily found a job in Tampa.

    However I couldn't file my AOS and EAD stuff because I had to wait for a duplicate NOA2 for my I-129F. Even though I filed a request and paid an extra $340 for the duplicate approval they took forever and I finally got it in March 2008 (took three months just to send the duplicate).

    Now I am filing for AOS and worried that I will have to stop working due to my I-94 expiring on 5th May 2008.

    Anyone any ideas ? would an infopass appointment help at all ? anyone ?

    I really don't want (and can't afford) to stop working again for any length of time as I am our only income.

    I really need the EAD..... :unsure:

  8. Okay here goes, I have been waiting for a duplicate approval for the I-129f seen as how we managed to loose the original, so now I am two months into being here after the POE. only one month left on my I-94.

    However my main problem is this, I came in through JFK in order to get the three month temporary employment authorization due to the fact that I am the only income for my family (US citizen wife and step daughter).

    I luckily did manage to find work. However we cannot afford to have me stop working, and due to the delay waiting for the duplicate Im afraid I may not get the EAD in time (5 May 2008 is the end of I-94).

    Could anyone suggest the best way to get the EAD before this time runs out ?

    I have finished my paperwork and I am going to file the following;

    Included in my pack is the following

    1. I-485 Application to adjust to Register permanent residence or Adjust status

    - Copy of passport identification page

    - Copy of Visa

    - Copy of I-94 (front and back)

    - Fiancé Visa I-797 Notice of action (approval Notice for I-129F)

    - Marriage Certificate (within 90 Days of entry)

    - Note on Texas (lived over 12 months)

    o Texas clean criminal report enquiry result

    o UK Police clearance letter

    2. I-765 Application for Employment Authorization

    - Copy of previous Employment Authorization Card

    3. G-325A Biographic Information

    4. Copy of medical immunizations from Knightsbridge Doctors London.

    5. Copy of birth certificate

    6. I-865 Primary Sponsor

    a. Tax return most recent

    7. I-865 Joint Sponsor

    a. Tax return most recent

    anything else I need ?? and are we still filing at Chicago ? :( Please help with any advice about the EAD also,

    My question is this, seen as how if you apply for both at the same time you only have to pay about 980$ instead of paying individually, can I still file for the EAD online? and seciond question , could I still apply for my EAD now while waiting for the duplicate before applying for my AOS??

  11. thanks for all the help, we definitely don't have our copy in our paperwork as it was lost soon after receiving it.

    I could print out the online status as being approved. However as you say I gave the big brown envelope pack to the officer at the POE.

    Maybe if I make an infopass appointment and go talk to the local office they could help ?? what do you think ??

    Q1 :wacko:

    I have been approved got my visa and am now in the US with my fiance, soon to be married on Valentines day.

    However we lost the NOA2 we got in NOvember, so immediately filed the I824 request for a duplicate (and another $340) which is what the lady at USCIS california told us to do. BUT now I am in the USA trying to file AOS and hoped the duplicate NOA2 would be through by now seen as how its been two months. (they cashed the 340$ check).

    We called the USCIS helpline and they said it could take 7 months as that is the processing time reported on the website for this form. I explained that I think I need it for AOS filing and she was no help at all and basically all she said was use infopass to get an interview at my local office.

    I cannot afford to wait 7 months for this without my EAD or AOS.Anyone have any ideas ?? :help:

    Also Q2.

    It says the EAD can be filed for online and the AOS has to be mailed. If the two have to be filed together is it possible to file one online and the other in the mail or will this just confuse them (given the joint filing fee situation).
