    No. The first time around we just submitted the I-130s and I-485s no 765s but we're rejected due to some error. The second time around we submitted with the 765s. The 765 were only one rejected. Sorry for the confusion. 

  2. Our children 765's were rejected and I received the notifications today in the mail. Apparently due to improper payment. I was under the impression that if filed together with the I-130s and I-485 there was no fee. 🤷‍♂️

     

    Ours were received by USCIS on August 15 and we filed the right forms at the time. 

     

    Didn't get notification that the other forms were rejected.

    I have created 3 tickets with USPS each telling me that there is nothing they can do and that last scan was August 7th and it is currently being delivered. It has been almost 3 weeks exactly since I mailed it. 

    Wow! That is a long time waiting. Let's hope that it was delivered and the post office never marked it as delivered.

    You can contact the USPS and just wait a day or two more before calling the USCIS. Good luck!

    That's encouraging! I'm waiting on a callback from USPS. Crossing our fingers! 

     

  5. If sending an application packet to the Chicago Lockbox, I would consider using any carrier other than the US Postal Service. We shipped ours last Friday, August 7th by priority mail (overnight not available for some reason) and it still shows the below message.  

     

    "Your package will arrive later than expected, but is still on its way. It is currently in transit to the next facility.

     

    USPS Premium Tracking™ Available 

    In-Transit

     

    August 13, 2020

    In Transit, Arriving Late"

     

    It was supposed to arrive on Tuesday. we are beyond upset and nervous. 

     

    I hope it is not lost. 

     

     

  6. Just resent the application packet today. Should be there on Monday or Tuesday. I didn't send the I-944's hoping they won't change the current ruling not to send the 944 over the weekend. I hear that as long as the package is postmarked on or after July 29th, you don't need it. I guess the same applies if they start requesting the 944 again, as long as the package is postmarked before they do I should be fine, correct?

    Right now, not much you can do with the exception of waiting. Seems like an expired I-94 is not grounds for rejection or denial as it isn't a factor for immediate relatives of US Citizen. We re-submitting tomorrow without I-944 as the form is no longer available and not required for the time being. Of course things can change and they may require it in the very near future. Good luck.

So, if you wish to file without the I-944, I suggest that you mail the application ASAP, to be sure it gets received before the appeals court enable the USCIS to again require the form.

    The appeals court just reversed the injunction. Seems like the 944 will be back on at any time. Ridiculous!

  9. Seems like the filing category selected was wrong on Part 2 of the 485. We had selected 2b. but after reading the instructions it seems like a stepchild is considered a child of a US Citizen for immigration purposes so we selected 2a (as selected on the I-130). Also the I-864 needed to be one each per person/child. We had submitted the one prepared for my wife. Also on the 864 on Part 3, Q1, you do not check the box 2 and do not list anyone else since they will be principal immigrants and require a separate I-130, I-485 and I-864. This time we will also submit 765 in order to get social security cards for the kids. Thankfully, USCIS rescinded the I-944 for now and they recommend not sending the 944 for now (direct statement on the USCIS site).

     

    I may be wrong on my assertions above and wouldn't mind a second set of eyes on this.

    I am trying to help a family friend. They are adjusting from a B2. The mother's application has already been accepted and is being processed, but the minor child's keeps getting rejected.

     

    When it was first filed (with the mother's applications), it was filed with the 485, 864 and the 944 but it was rejected with the same letter below.

    They also tried the 485 and the 864 (no 944), then they tried the 485 and 944 (no 864). Looking through the instructions they do not appear to qualify to file the 864 EZ.

    Maybe USCIS made a mistake the first time and what should be filed is the 485, 864 and 944?

    Any help would be greatly appreciated.

    We received the exact same letter for both my step-kids. We are now trying to figure out what is wrong? We submitted everything that was requested in the instructions. This is very frustrating.
