    The Manila consulate is pushing, in their emails,  their new Inquiry page:  https://ph.usembassy.gov/visas/immigrant-visas/immigrant-visa-inquiry-form/   of which they seem not to directly respond to, but did take action on (after seven or more requests in a month) by sending a "new appointment" email to us.  Or was it because I sent an email to the White House.  

     

    Anyway, you have to have some kind of reason to expedite you case else you float in the backlog for months.....

I submitted an on-line Inquiry (https://ph.usembassy.gov/visas/immigrant-visas/immigrant-visa-inquiry-form) for a Case Status Update.  The only subtle response I got was that they changed the CEAC status date (https://ceac.state.gov/CEACStatTracker/Status.aspx) from 14 May 21 to 3 Jun 21.  I guess that's my case update - "changed the Refusal date".  I was only lucky even note this almost invisible update.  For informational purposes only.

  3. Just to update this story.  I just noticed my wife IR-1 went from DENIED (18 Mar 2021) to REFUSED (14 May 2021).  (Not even interviewed)

     

    At first I went into a panic.  The Denied was because she missed her interview date due to her medical requiring additional TB Sputum testing.  The Refused was one week after her final medical clearance was granted and uploaded.

     

    After thinking a few minutes:  Perhaps our expedite case is no longer qualified for expedite and after looking at YouTube videos, the Embassies are working on Jun 2020 NVC Fully Qualified cases....now.

     

    Since my wife was a Nov 2020 NVC FQ and we slipped ahead due to the travel ban and an expedite request; she has now been put back in the queue (wait your turn, don't ask questions).

     

    It's that the (assumed) generic explanation provided on the DENIED coding is just a bit to the side of extremely harsh, to say the least.  We got no instructions and there was not an interview, but they dish out the following words of wisdom to make us feel wanted......??  Here it is below...

     

    "A U.S. consular officer has adjudicated and refused your visa application. Please follow any instructions provided by the consular officer. If you were informed by the consular officer that your case was refused for administrative processing, your case will remain refused while undergoing such processing. You will receive another adjudication once such processing is complete. Please be advised that the processing time varies and that you will be contacted if additional information is needed. For more information, please visit TRAVEL.STATE.GOV or the website for the Embassy or Consulate at which you made your visa application.

    For more information, please visit TRAVEL.STATE.GOV."
     
     

     

     

  4. Just asking about good old Manila Consular Section.  Anybody had any recent contact or lack of contact with them?  I notice their email (ivmanilareplies@state.gov) inbox is now rejecting as:  FULL, not accepting NEW emails.  So they went to an on-line inquiry system https://ph.usembassy.gov/visas/immigrant-visas/immigrant-visa-inquiry-form/ .  But, seems they don't have the available manpower or priority to answer the mail.  Or maybe just not my mail... With the new system, you have no real proof of submission.  Having the wife express courier my written letter for interview to them tomorrow.

     

    We are IR1 and IR2.  Expedite approved 20 Dec 2020.  Interview 18 Mar 2021.  Step-son passed medical (3/4 Mar) and went to interview and got a 221(g) - "send back your passport on 2GO courier when mother is approved."  Wife failed x-ray (50% will, right...) and went to the sputum test procedure and waited the one week plus four days plus eight weeks.  Of course it was negative (over 90% are, right....) on 7 May.  SLEC said (after me asking) they uploaded results on the electronic medical system on 11 May.  Embassy showing no concern about the interview of the wife after four messages.  Too many, right...

     

    I did not realize the step-son has no right for immigration unless the parent is approved for immigration.  Now, I am still unsure about age-out versus Child Protection Act when its in the hands of NVC/Consular Officer and not USCIS.  He turns 21 on 23 Aug 2021.  We also have a FILAM son who needs to start 12th grade in the USA on or about 11 Aug.  I will probably have him fly by himself on or about 30 Jun if this continues to be a never ending saga.

  5. Looks like you had better ASKNVC.  Click the link on your CEAC account.  Also her NBI (1 year) and CENOMAR  (6 months) might need updating before interview??  Bring update, if needed, to interview.

     

    They gave me a bad comment on one civil document.  Some reviewers like the new name of PSA versus NSO seal on the documents.

     

    I have been in the Philippines since 2002.  Married 2003. Flying out Jan to Huntsville.  We are waiting on the interview date also.  But our case is young compared to yours.

     

     

  6. Just got a review note on my step-son's IR2 I-864 file.  Seems the review officer only looked at my Adjusted Gross Income on my IRS Form 1040.  The note claims my income is too low for my family size of four but will leave it up to the consular officer (Manila) to sort out.  I tried to point out in the remarks of the I-864, that Social Security Benefits recipients, such as myself,  don't get much of their SSA benefit taxed and that only the taxable amount is included in adjusted gross income for tax purposes.  Am I missing something?

     

    Summary:  My 1040 adjusted gross income was 30K, 32K is required.  But, if you add up my  two1099s (SSA and Army) you get 44K.  I am fully retired.  On top of this my fourth household member, a dual citizen son, age 17 gets his own SSA monthly benefit and its actually not a dependent for tax purposes.

     

    So I wrote a clarification letter to the Consular for my wife and step-son to carry on their interviews.

     

    Any words of wisdom??

    File your petition by mail with the USCIS Dallas Lockbox or online using the USCIS website. You can find additional filing information on the Form I-130 webpage.

    If you are a U.S. citizen, the Department of State may accept a petition from you if you are filing for your immediate relative (spouse, unmarried child under the age of 21, or parent (if you are 21 years of age or older) at a U.S. Embassy or Consulate in certain limited circumstances, as described in USCIS Policy Manual, Volume 6, Part B, Chapter 3. Please contact the U.S. Embassy or Consulate having jurisdiction over the area where you live for further information.

  9. Not sure about Thailand, but Homeland security for normal processing was removed from the U.S. Embassy in Manila and most embassies over year ago by Trump and mail-in is our normal here.  Of course if you have a bonifide emergency the embassy might entertain.  

     

    I believe I tried to file on-line at first, but there was a part about biometrics reporting in the U.S. that made me quit that procsess.

Mail in her I-130 and I-130A and supporting documents to Lewisville, Texas from Thailand.  This gets the clock running.  Once case is approved at USCIS and goes to NVC, you normally have to re-establish physical U.S. domicle before you can file the I-864 to NVC.  Of course you can submit a exception request to NVC at that time and risk denial.  I assume you will be the financial sponsor.  Your case will probably go to Nebraska and its 7 - 9.5 months waiting time.  However, there is a potential layoff of 13,400 USCIS on 30 Aug.  Hope this helps.  I am in the Philippines 18 years and filed our papers 10 Apr 2020.

  11. One more dumb question about the CFO and BID in Philippines.  Is my dual citizen filam son, age 17, born in the Philippines, never left the Philippines, with both passports, required to attend PDOS Peer Counseling and get the CFO stamp in his Philippine passport?  He has no U.S. immigrate visa nor is one required.

     

    I know that no sooner than 30 days prior to departure he must go to BID, with both passports and five 2x2 passport photos and (I guess) a NBI clearance to request an ECC-A clearance for his first departure from the Philippines.  When he goes thru airport immigration, he shows both passports? and the ECC-A clearance.  There comes the CFO questions listed above?
