  1. it sounds like this my might be all they need and u should be getting good news soon, if they saw something wrong you would not have gotten bio appoint ment, they simply want to update his fingerprints and and pic. i heard of a case like this earlier this year here in san diego and after a couple days after the bio appoint she got her welcome email. i don't recall the name of the person but it was here on visajourney. as long as everything is on the up and up you should be fine.

  3. wow, i guess i'm in trouble i just took a pic of my wife changing my 1.5 year daughter i wanted to get an embarassing pic of her. this is ridiculous.

  4. If she's eligible to check box 2A (been in the US with her green card for five years), then she should check that instead of box 2B. If she checks box 2A, her marriage is not needed for the naturalization process, so she does not need to provide any evidence relating to the bona fide nature of her marriage.

    See the "Document Checklist" at the back of the M-476 (get the M-476 from the USCIS website, or google for it). It sounds likely that she only needs to send the N-400, her passport-style photos, and a photocopy of the front and rear of her green card. The document checklist contains a list of other things that might be needed, but each one is preceed by a condition, like "if you are applying based on..." , or "if you answered yes to...". Read the whole document checklist and see if any of the extra items are required for her particular case.

  5. i'm wondering if it's safe to travel with the 1 yr extention that's written on NOA. i want to go back home for Christmas and i can't decide if to buy the ticket or not since i don't know if the 10 yr GC will come by then. is it safe (that is can I return in the country) only with the extention notice? thx.

    yes it is safe to travel with noa1, ive used it about 5 times to get back in already. i've only had issues one time the guy was a rookie, he called his supervisor for approval.

    i'm helping my aunt fill out and apply for citizenship(n400). i have a question though. does she have to send any kind of evidence other than just copies of green card and a couple pics? i read the guide and it doesn't mention anything. she's been a PR since 07/15/04 is still married to her USC husband one and only marriage, they have moved a lot though. does she need to send in proof of residence or bring it to the interview? or anything else at all? she is applying for being a PR for 5 years. she didn't know she could apply at 3 years.

    any help would be greatly appreciated. TY

  7. you don't need a lawyer, just file the aos package with ead and ap together, it only takes about 3 months approx if everything is in order. as long as he didn't intent on staying your fine and within the law. most of the time they won't even bring that up at the interview. look at my timeline i was in the same boat my wife was pregnant and everything went great and did spent money on lawyer i saved it for the baby. read the guides and do you homework about the proof like pictures bills etc.. so you're ready at interview. and don't get freaked out if you get RFE almost everyone gets RFE's for taxes. just resend them. good luck.

    Kindly read through, I am sure it will provide you some help, and obviously, will keep your spirits high. Here is my story!

    Came to USA on K3: _________________________ April, 06

    Temp GC recieved: __________________________ Sept, 06

    Removal conditions applied: ___________________ June, 08

    Fingure prints done: __________________________ Aug, 08

    Touched many times between : ________________ April, 09 and July, 09 but no help.

    N-400 applied: ______________________________ June, 09

    Now here is the issue, which I found out by reading different stories online. I also found the manual of immigrations officers, guiding them to how to conduct an interview and what red flags to look at. Our red flags were as follows;

    Age difference 20 years _____________ red flag raises when its more than 5 years

    No children ________________________ red flag 2

    One of spouse above 50 _____________ red flag 3

    Different culture ____________________ I am a Pakistani she is a German Red flag 4

    Different religion ____________________ She converted to Islam after marriage red flag 5 on previous religion

    No formal marriage ceremony _________ red flag 6

    Not enough pictures ________________ red flag 7

    I am from swat Pakistan _____________ big red flag 8

    No joint property ___________________ red flag 9

    No life, health or other insurances _____ red flag 10

    No Will from either side ______________ red flag 11

    There were three more red flags, which can not be put into words. Hence, there was more than enough evidence to reject our case. Interview scheduled a month ago, I also prepared my self for deportation. We arrived 25 minute late for interview. Finally, interview started and these are the questions we were asked;

    What have you got for me?

    I gave him bank statements and some reference letters.

    He asked for pictures

    I gave him what I had, may be 5

    He went out to make photo copies and I said I got more proof ( because she did not start asking us questions, which we were well prepared for)

    He said no you got enough evidence, you are approved (SHOCKED US, hardly said thanks, could not deliver words).

    He said oops, I would also have approved your N-400 now, but its not mature yet, still another month to go (bad for me).

    He further added, I will get your file for N-400 and will send you a call soon, no need to bring spouse again, get prepared for test.

    We came out happily, with smiles on our faces.

    Our case would never have got approved, if there was no support from ALLAH.

    If you don't know, then please don't "think." You may be totally or partially right or you may be totally or partially wrong, but it doesn't matter, because speculation muddies the waters. What if you're wrong and somebody follows your advice?

    As was stated before, I urge the OP to contact ICE for a second opinion (beyond that of USCIS) and to file a report.

    ok mr tbone... i know you don't have any financial responsibility.. only the OP knows if he was used or not, it doesn't matter unless they are married its out of his hands. the only reason to contact ice would be to cause harm becausese he got hurt. and i doubt they would even consider anything because he doesn't even know where she is, she could be back in her country for all we know.

  10. Alls I can say is I listed our USC daughter and got a RFE for USCIS wanting $80 for her biometrics. It took us 3 + months to get it straightened out. Had to get our senator to finally get the petition moving again.It does say list ALL children but they mean children who need conditions removed.

    It does say that in the instructions.

    DON'T list USC children in Part 5.

    at what point in your process did you received the RFE? i made same mistake, i just checked the instructions and it states to list all conditional resident children not USC's. i just did my bio hopefully ii don't get RFE.

    I got the RFE in about 3 weeks. LOTS of people have put their USC kids and didn't have any problems. For some reason they screwed up with our case.

    yes that sucks...glad u got it all squared away and got GC.. hope i'm good. i didn't even state that she was a usc i just listed our address there isn't enough room. i guess will see. thanks for the quick response.

  11. hi guys, i just saw another posting about this, maybe someone who is approve can shine in. part five of i751 says list all children on form, but on the instructions it says list all conditional resident children. i of course just following the list all children listed my USC daughter i already had my bio and was wondering if anybody else got RFE's and at what point in the process did it happen?i filed 07/27/09 i had my bio 09/04/09 i got all my noa's no problem.

    thanks for any advice.
