  1. Hi fellows

So my wife got her IR1 and i just paid her green card fee on USCIS

I've recently moved to a new place so the address listed on her i130/i864 is will not be used to receive her green card.

I remember i entered my new address when i paid the 220 fee on USCIS two days ago, however, i can't remember if it was for a billing address or confirming the receiving address

So my question is, since i've already paid the fee, at her POE of end of this month, can she still update the green card receiving address with the staff over there?

If she updated at POE,  is there any way to make sure that the staff correctly updated our new address after her entry?

    Thanks.

  2. Hi fellows

We just got our cases DQed at NVC this weekend.

I'm wondering as of August 2021, how long does it take to schedule an interview at Guangzhou from DQ?

And how long does it take to receive the visa/passport after the interview?

    Thanks.

  3. Hi

I've submitted all required document for NVC on the CEAC by 5/10.

I've noticed the NVC is currently reviewing cases/docs received on early April.

Based on this, anyone have ideas about how long will it take to schedule the interview at Guangzhou consultant?

My wife's has to make a decision on when she will quit her job and attend that interview.

    thanks.

  4. Hi everyone.

I've paid both AOS and IV on Wedsneday  last week. I just checked today on NVC website for my cases status, it says NVC has received my payment, and tells me to complete my DS260.

But when I login into CEAC, it still says it's in process for both AOS and IV. On the guide given by the welcome letter, it says the wait for like a week for the payment to be processed.

What should I do for situation like this?

Unless a tax expert corrects me, his income will all be shown on his personal tax return.  He's both an owner and employee of that corporation.

    Okay thanks for the info.

Any idea about the back log of Guangzhou embassy interview scheduling?

Assuming I can submit all files and DS260 within this/next week after NVC processed my payments, how long will take them to schedule the interview?

Total household size in this case would be 6.  Should not count you.

Does  your father really file two separate tax returns?  Is his business Sole Proprietership, Corporation, C Corporation, Partnership.  Details matter to the answer.

He does have two separate tax files, one for his personal and one for his business. He said his business is S corporation.

    Thanks.

  7. Hi everyone

For the taxes from 2018-2020, I used to file it under my dads tax. Our current household size is 6(excluding incoming immigrant).

But starting this year, I have a steady income since January and I'm planning to file my own tax this time.

The question is, since my father is the joint sponsor, what would be his house hold size to put on I864 to meet the poverty guideline ?

Do I need to count myself in for his section of # of dependents? Even I started to file my own tax this year? I know he didn't include my for his 2020 tax (so for 2020 it's size of 5).

Also, my father owns a small business, is it okay to use both his personal and business tax returns for I864?

So on his I864 would it be total of 6 or 7 including the incoming immigrant?

  8. Hi everyone.

So this week, I've received a letter from USCIS titled I797 saying my application for I130 is approved and is transferred to NVC

And two days later I've also received an email from NVC start with "Thank you for your interest in immigrating to the United States of America.".

I got some questions regarding further actions, explanations will be sincerely appreciated.

    1. Is the I797 = NOA2 letter?

    2. Does that email from NVC that contains my new case number and invoice number = the Welcome Letter? I suppose that Welcome letter should include anything additional documents that I need to submit to them (the I864 etc.) but it didn't say anything about the documents that I owned. So this email is not the "packet" supposed to be sent out to me right?

    3. Does that mean I can start paying NVC the fee and start filling out the I864 by login to CEAC with those case numbers?

    4. I've also heard there's need to collect fingerprints, is it for me or both my wife and I? IF I travel abroad to visit my wife soon, can that be done at the consultant/embassy in China?

    5. Also according to the Pre-Interview forms list, it's also asking for OF169, OF230, birth certificate and police certificates, are those needed from me or my beneficiary or both? I'm a naturalized citizen of US, is it okay to use my naturalization certificate?

    Please help

    Thank you very much.

Hey do you mean you got ur NOA1 and still waiting on your NOA2?

Any thing should be prepared during the wait?

No, while the K3 may officially remain on the books as viable; in practice, it's not viable at all.  Procedural changes at USCIS and State Department since the K3 first came into existence have now rendered it virtually unobtainable.

Really? is there a source about this change? can you please elaborate more on this?

Okay the beneficiary is NOT in the USA?

    correct

If the beneficiary is currently in the US then an I-485 can be filed.

Sure you can file the I-129F but it doesn't make the I-130 approval faster.  And of you were to get a K3 you would end up paying more for a process that takes the longer to get a green card than an normal spousal.

I was wondering because the estimation of i130 gets delayed every week from the email sent by visajourney. So I thought would it be nice to just have my spouse come USA asap while we wait for the i130 NO2.

The I-485 is only filed if you're filing for adjustment of status.  Are you currently in the USA?

yes, and my spouse is outside USA

  13. Hi everyone

So, i"ve filed my i130 ONLINE back in early June and received my NOA1in the following week.

As for my online process, should i file i485 as soon as possible or should i wait for my NO2 to come?

Is it beneficial to apply for a K3 while wait for the NO2 of i130? (Potomac center is being super slow and my new estimation is May of 2021), has anyone been through this path?

    Any advice?

    Thanks.

Does it normally move that quickly?  From everything I have read that this is unusually fast.  We thought maybe 6 months until approval.

We were hoping it would take longer, as with everything going on, we were hoping to not move until after January of 2022.  Plus, we are not living on my wife's country of birth and it will take us time to get the documents we need from Egypt as it might involve a flight to Cairo to get some things.  As of right now, China has 14 day quarantines and its a real hassle to go in and out.

How long can we keep our case at the NVC level?

Are you able to go to China right now? Aren’t they still banning entry ?

If you are seeking a visa, you don't submit ANYTHING else at this time and will NEVER submit an I-485.  If you are already IN THE USA, and are applying to adjust status, the answer is different.  Please clarify.

I'm apply CR1 visa for my spouse. Currently, she's not in USA.

Some people says there's concurrently filling happening right in June (where you can send I130 along with adjust of status forms like i495 i864s), but i don't really know if that policy applies to online submission of I-130.

My joint sponsor and I  have already completed entering info on paper version of i864 and i864A.

  16. Hello everyone

I've just completed the submission of the I-130 online along with my payments today.

The next steps seems a bit confusing.

Do I need to send out I485 I864 I864A I944 I765 in ONE package after I received further notice from the USCIS?

    Or

Can I send the paper version of these forms the next day even before any notice from USCIS?

The current status of my case says "Your benefit request has been accepted and is under review"

Please help, I've been getting different answers regarding this second step of forms.

    Thank you.

No, because you have zero income to combine with him.  Not one of my first few hundred rodeos on this.

    okay

So for the part "Income you are using from any other person who was counted in your household size, under part 6 of I-864"

Is it necessary to still include my father's income/info even though he's doing the joint sponsor's route?

    Thanks.

One I-864 from each of you.  Dad is the Joint Sponsor.  If Dad is married filing a joint tax return, then his spouse needs to provide and sign an I-864a whether she/he has any income or not.  Petitioner is always primary sponsor, income or not.

    Thanks for responding

Is it possible to go with the other route? Where I have my father just fill out the I-864A form since me and him are in the same household, so there's no need for the "joint sponsor"

  19. Hello

I'm planning on apply the CR1 visa for my wife in China.

My taxes were along with my father (I'm accounted as his dependent). However, I'm currently in medical school so my income is zero, so I need my father to become my joint sponsor.

The confusing part is, since we are in same household, does my father need to complete another form of i864 as a joint sponsor? Or can I just add his name under the i864 form that I need to fill out (the section where it says income you are using from any other person who was counted in your household size).
