  1. Hi everyone GC in hand today ! EAD actually got lost at my old address cause I had a forwarded address. Anyhoo just some specifics on my case so to helps put things in perspective. 
     

    Follow to join with my husband on Eb2 with I-140 

    - followed up with my congressman in October because of an erroneous denial in my initial filing. This error by Uscis  pushed my application later by 8 mons

    - congressman really helped and pushed for me to get my EAD

    - received an RFE on Nov 17th with questions about my original BC , proof of marriage etc 

    - submitted response Dec 23 

    - EAD approved on Jan 5th - got lost in mail

    - 10 year GC approved on Jan 12th - in hand today 

     

    I believe I didn’t need an interview because it was employment based and I was married to my husband before he became a GC holder.

    That’s awesome! Glad that worked out for you. I tried walking intwice as I have surgery on the same day but they were very adamant. Told me I could come back after my surgery

    You missed the opportunity of filing for AOS with the new last name. If the IO at the interview changes it for you, you should receive your green card with the new name. If not, you will have to file for an I-90 and pay the fee to get a replacement card with the new name.

     

    The issue that I see is that if you applied for a SSN on the 765 form, your SSN will come with the maiden name and you will only be able to change it after getting another immigration document with the new last name. That means that if you need to get a driver's license here, it will need to match your SSN. Your will have to file taxes with your maiden name.

     

    Understand that when you fill out the application you're asked for your current legal name, so if you write down your maiden name, to USCIS it means you never wanted to change your last name.

    I am yet to apply for my SSN so I’ll ask the interviewer to change it and then move forward with my new last name on the SSN doc.

    As to the GC and Canadian passport name not matching, that is no big deal.  My wife travels that way all the time (first with a GC and now with a US Passport) and she has never had an issue.  She always takes a copy of our marriage certificate with her.

  6. Hi Everyone - 

     

    So I got married in March 2020 and as such changed my last name in my home country - my last name was changed on my drivers license but I haven't changed it on my Canadian passport. 

    In starting my GC process, I filed it using my maiden name - I am now going for my Biometrics appointment this month; My Canadian Passport has my Maiden last name and so does my application with USCIS for AOS

     

    My questions are: 1) I'd like to change my last name on my AOS application to my marriage last name  , can this be done at my Bio appointment? 

                                    2) Since my last name on my Canadian Passport is still my maiden name , how will this affect my travels at the Point of Entry; Different name on passport vs GC

    Finally received Biometric appointment letter today. :) Sooo Happy things are moving

    Appointment on Aug 31st but will try to just show up next week

    6/17: Text messages & email.

    6/24: Received I797 Receipt notice in the mail. 
    7/23: Biometrics letter in mail, appoint for August 13.

    I didn’t submit my I-693 yet but I’m surprised I didn’t get an I-693 deficiency notice before my biometrics appointment.

  9. Thanks a lot for your response ;  There is nothing else I can add to the story about my husbands application for FTJ ; It was a very straight forward application which his lawyers put together. After the denial they filed our appeal to the USCIS under "Erroneous denial" ; Honestly seems like an error on their part but it still makes me very nervous which is why I'm asking for what other routes to take.

     

    To your second point , then it seems like filing for I-130 via consular processing is our only option. 

     

     

  10. Hi Everyone ,

     

    Looking for some advice ...

     

    History :

    - Married my Husband in March 2020, He got his GC approved in April 2020 through work sponsorship, so we applied for me to follow to join his application in May 2020.

    - We got denied in Oct 2020; the reason USCIS provided was that he went through the AOS route and my application would be through consular processing. Our lawyers appealed in Nov 2020 and we are still waiting on a decision as at May 2021. 

     

    Currently: 

    - I am with him in the US on a B2 visa from Canada and I have 3 months left on it. We will be welcoming our first child in a few days.

     

    My question is what advice would you give us if our appeal is denied. Should we apply for the I-130 via AOS, concurrently filling for Advanced Parole and Work authorization ; If we do that will the advanced Parole come before my B2 visa expires??

     

    or

     

    Should we apply for I-130 via consular processing and I go back to Canada and wait out the approval of my application. Due to the times on the website, the processing times don't seem so bad?

     

    Any thoughts or feedback would be greatly appreciated
