  1. I dont want to be a party pooper....but had my interview in Atlanta as well on 7th Aug...Its aproved pending a fbi name check....same case as yours...

    I was not a single bit happy when the interviewer said the fbi check is not cleared yet....after going thru this forum and learning some people waited 3 years for their gc, I am already stressed. Wish you all the best for a speedy name check.

  2. yea, ur wrong. I already qualified for that. That is no consolation for me.

    Sorry I meant 24 months....not 48....yes its not a consolation but I am pretty sure someone had a post in this thread according to which you would not need to lift conditions. If you get one now it will be a 10 year green card.

    Also its been only 11 days since I had my interview pending this name check....I understand how you are feeling...Did you call the Washington DC number to check your name check status ?

    I am sure this topic has been covered before. Please excuse me if this is a repeat question.

    I would like to travel to India to see my mom for two weeks. My Green Card has been approved pending a fbi name check. The interview was successful. I would not get the card until fbi clears the background check.

    All I have right now is a valid EAD, a valid AP and a valid Indian Passport. Issue is it clearly says on the EAD "Not valid for Re-entry to the US"

    Also the Advance Parole document does not sound promising either.

    Is it safe to leave the country or should I wait till I receive the GC ?--- which may be from 2 months to years. Depends on the mercy of the fbi/dhs.

    I am currently unemployed --- thats another issue. Will they give me a hard time at the airports while entering US?

  4. All applicants going through the AOS process have their names submitted for an FBI Name Check - it has nothing to do with being randomly selected or being victimized or picked on or whatever. It is a mandatory requirement for anyone seeking an immigrant benefit, and a Green Card is considered a benefit.

    First of all thanks for the info. Fair enough. But the thing is does fbi "follow" this rule? I know they are supposed to do it for all candidates but do they do it? The reason I was saying this is because in India finding someones record is like finding a needle in a hay stack....More than a billion people with very little cooperation. Actually depends on which part of india as well. In such a situation when I see plenty of other Indians getting thru without this name check ####### it makes me wonder if this fbi is indeed doing their job or not.

    But anyways I wish all of us luck here and hope your patience will be rewarded :thumbs:

  5. They will not stop you from committing a crime, but if you do, you will be denied adjustment and be deported.

    Looks like going to jail in the US is a better option than returning back to home country :lol: ....

    Oh and by the way, it is an international check, so if you have a record with a 'friendly' nation, you will be denied and deported.

    thats exactly what my point was..Is it not better to not let someone enter US who has a criminal background in his home country than to let him enter and figure out later he has a criminal background and then deport him......Sounds like a bad a idea

  6. This really sucks !! Since I am already in the US how the heck are they gonna stop me from a commiting a crime even if I have a criminal background? Whats the purpose of this stupid name check since I am living here in the US already....These things in my opinion are just stuffs done by the fbi randomly to show that they are not sleeping in their office....Those unlucky ones getting selected have to pay the price

  7. Joining the list....Today we had our interview....Its approved with background check pending :( Atleast I am happy that it was approved and I already have an EAD....

    Can someone tell me whether this 2 year window starts from day of interview OR from the day the background check is done ?

    I mean my interview was today August 7th 2007 and was approved pending name check.....So when I will get my green card will it be expiring 2 years from today (Aug 7th ) or 2 years from when the fbi completes it ?

Thanks all for your reply...Little less worried now...this is a great forum....No there should be no issue about sponsoring as my wife makes a lot of money :D Wish the interview goes smoothly....I guess the best thing to do is answer whats asked.....Unless they ask about my work status I will keep quiet...If they do I will tell the truth....I am sure they are experienced people.

    I am new to this forum and thought about asking a question thats bothering me for a while:

    I am the intending immigrant here. I got married in Vegas on 11/11/2006 when I was staying and working in california. My wife has her house in Atlanta. We were pretty much frustrated with this traveling back and forth so I decided to quit my assignment on March 2007 and move to atlanta permanently. (note that I still have a valid H-1B visa with a consulting company--but not getting paid---last work day was 02/25/2007). Since then I am living with my wife.

    I was stupid and lazy not to file AOS sooner :crying: We filed it on April 27th 2007 and have a receipt notice date of May 9th 2007. I already received my EAD though.

    The thing is H-1B rules say I must get paid and there is no such thing as benching. Also if I quit workin I am out of status and technically deportable. But here is the thing: Its absolutely permissible to take an unpaid vacation due to family reasons which I did here and that would NOT put me out of status. i mean hey, lot of folks on H1 goes to their home country for months and dont get paid because they are on vacation. It should be fine from what I know.

    The question here is that my AOS interview is coming up soon and if the interviewer asks me about my work status whats the best thing to tell him ? I am worried about the IO giving me hard time for this. Whats the worst thing that could happen in case they find I was out of status. Me and my wife are really worried about this. Should we take a letter from my employer stating I am still employed with them or just suppress the topic at the interview ?.... I am looking forward to hear from you all especially Dr_Lha whom I figured is a pretty knowledgeable person.

Sorry to hear about your experience....But if that happened to me I would ask him to look at me and then I would tell him that he will get sued if he doesn't behave...These immigration officers are just a bunch of uneducated hobos...You have every right to show them what they are...Life's too short to get treated badly just for a damn green card.
