    For the tax return, just be sure that's a copy of the entire return. It may be...idk your specific tax circumstances if other forms and schedules exist in your filing.

     

    I think this is sufficient, but I'd really have to dig out the details to verify. The I-944 has a lot of "if x then provide y" type of things,a nd I don't recall all of them off-hand.

    If I had to make a guess based on what I have seen thus far, it sounds like the I-944 will be required again for all applicants except those living in Connecticut, New York, and Vermont. But USCIS is still reviewing the ruling and has not put out anything official yet.

     

    Technically, if somebody were to apply right this instant and it arrived before any changes, I believe it should be accepted w/o the I-944.

    But USCIS could post guidance an hour from now that it is required again (except for residents of those states). Or the lockbox workers could review it after it is required again and mistakenly reject it under the then-current rules.

     

    If it were me - and I had the ability to send a full packet with the I-944 right now - I would send the I-944 with it to be safe. If it's not needed, it won't be used.

    If I didn't have what I needed to submit the I-944 yet, I would hold off on submitting while I get that.

     

    My risk tolerance is fairly low, and the advantage of possibly getting in w/o the I-944 wouldn't outweigh the risk of a rejection for filing w/o it, or maybe getting an RFE for it later, depending on what USCIS decides to do.

    But note that my set of circumstances does not pose a particular risk of being inadmissible under either public charge rule. If I was a borderline case, I might feel differently about getting in without the I-944 on the chance they won't make it required later.

    No no no...you are not exempt from the inadmissibility (unless you meet the condition noted above or possibly if you are doing AOS not via family).

     

    Don't confuse the new public charge rule with the public charge inadmissibility. The former was newly implemented earlier this year. The latter is built into the INA from decades ago.

    Ok thanks alot for the clarification. I clicked no after two persons responded to my post about that question. But should the I-944 be filed since it's no longer on the USCIS website and reading about the lifted injunctions for some states? Between I am in Georgia

    I actually asked this same question some days ago because I was thinking that since we are no longer required to file I-944, then the answer to the above question would be "yes" . This is so confusing now

    Question

    1.    Form I-485, Item 61 (Declaration of Self Sufficiency) are you exempt from the public charge ground of inadmissibility? This relates to form I-944. Should I answer yes or no? no more i-944 form on the USCIS website but I already downloaded it before now but the i-485 instruction still states we should fill it.

    2.   Am I to send to Chicago Lock box address (I stay in Georgia)?

    3. Is it ok to staple some of the supporting documents?

    The only way he would have to list them is if they were dependent upon him financially (i.e. listed on his taxes), or if he was sponsoring them for a green card (although that would be on their own I-864s in this case anyway...not the mother's).

    On the form I-864, I saw that a copy or transcript of federal income tax return for the most recent year is needed. Please are there additional documents my sponsor is required to submit alongside Form I-864?

    We were going to use a lawyer before I found out about visa journey and the lawyer during consultation said that even if my husband lists us on I-864 and that since we are a family of 5 and my sponsor is a family of 2, when the sponsor is filling out form I-864, he will list my whole household of 5 and also his household of 2 making the sponsors household 7.

    Yeah my spouse has completed I-864 form and listed myself and kids making up family of 5.

     

    But please to be clear, are you saying when the joint sponsor is filling the I-864 form, his household will be himself (sponsor), sponsor's daughter and myself only?

     

    Is it because my kids are USC, that's why the sponsor is not required to list them amongst his household?

     

    Can my asset be added to make up for income requirement?

    As regards the income requirements, my spouse income is less than the required income for a family of 5. That's why we are getting a sponsor. So where does my USC kids come in please?

  12. We are a family of 5, my hubby (USC), myself (Beneficiary) and my 3 kids from previous marriage (3 kids are USC). We are getting a co-sponsor. Our co-sponsor is divorced, he has a daughter he is responsible for.

     

    1.) How will the household size be calculated when the sponsor is filling the I-864 form? Will my USC husband be added to the sponsor's household size or just my kids and I?

    2.) If I have an asset in my country, will i be required in the U.S. to pay tax on that asset even if the asset does not generate money for me?

    3.) What is the best USPS envelop or box to use, going by the volume of documents we are submitting? (I saw different USPS priority mail envelops and boxes online that i can order)

    Do you think it's enough to attach a screenshot to my I-944 that shows that I need a SSN for proving that I don't have a credit score? And maybe add an explanation stating that I can't get the score?

     

    This whole I-944 is very stressful for me cause I'm technically still a student and never had a job before, because I haven't received my degree yet. My first legit job is gonna be in the US, I really hope that's not gonna be a negative factor for USCIS.

    Just call trans union and explain to them that you do not have SSN and that you need a letter from them stating you do not have a credit score/report. They will take your details and send you a letter. I did this and got a letter 3 days after i made the call.

    Thanks for this info. Sent out a letter on monday to Equifax, it was delivered next day and I got a letter from them today confirming that I do not have a credit report

    I Also checked out ***removed*** (subuy), gave them a call and was quoted almost $600 to be paid annually. I saw their advert on visa journey. i am yet to pay though

    You think if it was a problem the visa officers renewing my visas 3 times wouldn't have seen that? Yes I had my 3 kids in the US, yes I paid all bills in full and yes after each birth, I renewed my visas without any issue, came into the US at every birth and also declared to the CBP officer at the POE my intentions, had my babies and left the US after each birth. You should be answering questions I asked if you can and not deviate. Thank you

    4) Only the I-130, I-485, I-765, and I-131 would use one. Some people provided a single form for all of them, and others provided one for each of those forms. Both tend to work. I did the latter (1 for each form)...less leeway for errors on their part IMO.

    5) What form(s) exactly? Some forms have 2D barcodes, and you don't want to mix electronically-completed forms with handwritten information....they'll likely scan the barcode and miss the handwritten information. Some forms do NOT have this barcode, and mixed hand-writing and typed on them is fine.

    6) I'll defer to others, but if she has not been in the US long enough to establish a credit history, I personally would just declare that she has none. Getting a letter of having no record is a mixed bag of success, and can take weeks.

    If she's been in the US 6, 12, or more months, then I would be mote inclined to get something documented as it is not unreasonable to have a credit score at that point.

    The way your questions read it sounds that you’ve been here for a considerable amount of time without legal status given you’ve given birth to 3 children in the US already without ever holding a green card?

    Thanks. Yes I am female. My current spouse is a USC. I entered on B2 last year December. I had my 3 kids in the US via B2 visas but I never stayed back after having my kids

  19. I came in on B2 visa and now AOS based on marriage. I read through the guide and USCIS website and the forms I am required to file are Forms I-130, I-130A, I-131, I-485, I-864, I-765, I-944. My questions are

    1)      In care of, should that be my name, the name of my spouse or should I leave it blank (we live together?

    2)      In Part 2 of I-485, talked about Form I-797 (receipt or approval notice for underlying petition). Please what does this mean as I do not have any underlying petition?

    3)      Form I-864; part 3, #1 we clicked yes (sponsoring the principal immigrant named in part 2), I also have 3 kids born in the US from previous marriage. Should I include their names in the family member section (i.e. #4 to #18)

    4)      Am I to attach form G-1145 to all the forms?

    5)      Some parts of the forms do not allow me type on or tick, can I use black ink pen on those areas after I print out?

    6)      I am still unable to get a credit report. My spouse added me as a user to his credit card but I still cannot generate any credit report. Please any other suggestions?

    7)      As regards up to date form, is it the edition date at the left down part or the expiration date at the upper right part one should consider?

    yes I have a US spouse too. Please how did you get the individual tax payer ID? I just got married
