  1. Hello friends,

     

    Thank you so much for your help and your input. So when we went through Tijuana, all that the Mexican agent asked for was her b1/b2 visa. It was not swiped or anything through a computer, and the agent just confirmed that it was still "valid". We did give a call to the US Consulate in Manila, and we were told that the Visa was in fact active. Apparently the best place to call to see if your visa is active is to call the place that issued the visa. There was absolutely not issue going through the border. it was a lot of headache and stress for nothing.

    I'd take a guess that the Mexican authorities would go by seeing what appears to be a valid US visa foil in the Passport and let her in. But they could do record checks, I'm not too familiar with how Mexico handles these things given that I've only crossed into the country once from the US (and I was 16 at the time lol!)

     

    What I do know is that the information sharing between the US and Mexico is far less than that that goes on between the US and Canada.

     

    Honestly if it's not too much effort I would advise she gets a valid Mexican Tourist visa if required. Nothing to lose from that.

    The only problem is we recently found this out. And there are no appointments available between now and when we leave or we would have done so.

    They should have marked it if they did.

    There are no markings on the Visa. The Visa is on her old passport, for she got a new one recently because the other one. We sent them both in before she got her K1 and no marks to her B2

    It is a gray area on whether the B will be canceled in the system or not. A visa is valid until expiration unless canceled or revoked...but she can no longer claim to be a U.S. tourist after entering on a K-1 and filing AOS. Also, they are pretty far into the AOS process - already have EAD and AP. I think the odds of that tourist visa being viable has gone down considerably the longer she has been in the U.S. 

     

    @BigBen17 What is the expiration date on her tourist visa?

    Expiration isn't until 2026 not sure of month i think Oct. She's only been in the US since last year.

    Mexico and Canada have a lot of access to U.S. immigration info because of course, it is necessary for border countries to have this info.

    She can apply but we are leaving next week and did not know she needed a visa.

    My wife a filipino national had a tourist visa prior to our marriage. We filed for a K1 and got approved and is waiting for her green card here in the states. We did not file for AOS for her tourist Visa, but for her K1.

     

    When she got her K1 does that automatically cancel out her tourist visa or can she have two concurrent visas?

     

    Asking because we have a trip for a wedding in Mexico and did not know that Filipino Nationals needed a tourist visa for Mexico. She is legally able to be here in America and has her EAP card and her advance parole to re-enter the United States. I know she cannot enter Mexico with just a EAP card because it is not a permanent resident card.

     

    We tried calling the Mexican Consulate all over California to ask questions but we just talk to a robot and get hung up on before even talking to a person.

     

    I do know if she holds a US Visa (her tourist visa) that is not expired she can enter Mexico easily.

    I was unsure about if this was the correct place to ask this question.

     

    My wife just got her EAP nd her work visa and is currently waiting for her green card approval for well over a year. She is a Philippine National, but currently lives here in the states with me for well over a year now. We are travelling to Mexico in 2 weeks, but we just recently found out that Filipinos that are going to Mexico with a Filipino passport needs to apply for a tourist visa. We are only staying there for 4 days and 3 nights.

    1. Does this still apply for those who are in process of waiting for their Permanent Residence Card?

    2. Does she get a pass simply because she is flying from America into Mexico and not from the Philippines?

    3. Does anyone have any experience in this?

    They may not be fully open to the public. Every country is different. While there are people working inside doing other things. Certain things may be inaccessible to the public and/or some programs may be running on limited staff. While the consulate in Australia was open they were not doing non-immigrant visas (K1 included). When my Fiance finally got the notice she had to schedule nearly 1.5 months ahead of time (she was not able to schedule immediately roughly 2months after) and even the security officer said that the line is usually to the end of the block, but as of right now there were barely 7 people. As the pandemic changes everything on a daily basis different things are going to happen. Nonetheless there is still a job to do. Having everything ready for when they are ready is important to make things efficient. 

  9. I do not know if this will help you feel any better, but my fiancé was not asked this question. She did interview in Australia and was only asked what I did for work, and how we met. Their job is really to make sure none of this is a fraud. Given the current conditions it is safe to know that you do not have a guaranteed flight to America if booked today. If that question does come up I think the best answer is that you will be booking your flight to your fiancé after you guys know for sure she is approved and she gets her passport back.

     

    They do tell you not to book anything until you have your passport back, and some places are requiring to know your visa number ahead of time before finalizing your flight. They do not want you to fly there be denied and have to fly you back for free. Because in reality you do not know if everything is going to be okay. You might get rescheduled or need to provide more documents for the officer, which delays everything.

     

     

     

  10. You just wait. Multiple things can affect the time. Obviously the time it takes for it to be reviewed. The embassy may or may not be open, or may or may not have sufficient staff to process everything as efficiently as pre-covid. It is just a waiting game and you will get a message through email or the physical mail that they have received documents and will have instructions in what may be required, if an appointment is possible, and anything else. 

  11. So due to Covid reasons my Fiance and I are in a hard spot. We got our NOA2 on 4.27.2020. This is set to expire 8.26.2020. Had not for Covid she would be here already. This is obviously a difficult matter because our world hasn't experience anything like this.

     

    Her situation: She is from the Philippines, but is currently going to school in Australia. She was planning on doing the interview in Manila, but the country is in lock down. Even worse there is a chance she might not be able to get her interview in Manila for a while because of ECQ on her island. We want her to do the interview in Australia, but she no longer feels safe going to school (which has threaten to cancel her student visa). So she can't go back currently because the country is in lock down, and at the same time she wants to do her interview in Australia. 

     

    Question in mind: Does this count as a special circumstance to get an interview in Sydney asap?  Will she be able to do an interview if her visa is canceled but can't go back home? What other options are there for her to do?

     

    I can provide more information, but kind out of options in this. According to the NVC website we can schedule an appointment for emergency reasons.
