I don't think it's a matter of not having the returns, just that they do not paint a good picture. Correct? Either way, a copy of the most recent year's return will be required, and the information for the other 2 years is required on the I-864.

Keep in mind this comes into play at the NVC stage, not at the tie of filing the I-130.

I would note that current income is king. That's what you make now, not what you made in the past. The other items are factors, but do not warrant a denial on the public charge basis alone.

Yap! Exactly, because my husband had 3 years where his tax return were... A lot below poverty line especially the year when he moved to Italy with me.

Oh, well... I thought that the letters and paystubs would have been enough for the first part of this process...

He needs current proof of income, paid stubs, employer letter, bank statements... If he didn't file tax, he needs a sworn statement why he didn't file tax. If he doesn't have anything, find a joint sponsor.

He is going to have two jobs but we didn't want to wait a whole new year for starting the process... So this upcoming year he will be gucci, what worried me were the 3 previous negative tax returns because he earned less than 20k

  3. Hello everyone!

I am back, with other two questions! I am so sorry if I am bothering you, however I have few doubts out of the blue...

What is a good proof of income? I read that a formal letter from my husband employers would be fine... What could he need?

My husband didn't have enough money 3 years ago therefore his previous tax returns... Are bad...

Thank you so much for understanding my questions-

  4. Hello everyone! How are you feeling today?

So... My husband is getting ready to move back to the USA after nearly a year spent in Europe with me because we got married here.

Today I saw that there might be some issues with his return. He is going to stay in a hotel for a bit for saving up, he has a job offer and had his tax return... Plus he was born in the USA and has his birth certificate with him... Will he really have troubles to go back? What else does he need?

To note, unless the OP is a resident or citizen of Germany, they do not need a police certificate unless they lived there for 12+ months.

    No

    Thanks so much!

To prove my long residency in my country (I lived at my current address for 15+ years) can I use as proof the taxes that I paid?

On a side note, for the background check do they check just for bad behavior or other things like activities that I did? Because I have certifications of charity events and I wanted to put them in the folder as proof that I am a decent citizen.

    German address --- yes.

Make sure to list all addresses where you’ve physically lived since the age of 16, not only addresses you’ve used as an official permanent address. For example, if you continued to use your parents’ address as your permanent address when you were in college, even though you weren’t living there, you’ll need to include the addresses where you actually lived.

You'll also need a police certificate from Germany since you lived there for more than 6 months.

    Good luck!

Ty so much, I got confused because a lot of people told me that I didn't need to since I was going back and forth...and since I kept paying my taxes in my country without being registered there.

Could I do a complete European Good Conduct certification instead of a German one?

  7. Heya! I hope that you are all doing well and that you are safe and sound.

I am studying how to fill form Ds260 and I saw the question

    Previous addresses

I was in Germany for more than 6 months but I always kept paying my taxes in my own country, was always registered in my own country and most of all... I left Germany on a touchy note. (nothing illegal, just personal bad experiences)

Even though I wasn't registered as a German citizen with citizenship, do I have to put my German address as previous address?

    Thank you so much!

Current income is key for sponsoring you.  He will submit tax documents and proof of his income such as pay stubs, etc.  along with the I-864 at the NVC stage.  $30,000 current yearly income sounds sufficient.  You do not need to prove you are a translator to translate your documents.  Anyone who is fluent in both languages can do so.   Just attach the following statement to each translation:

Ty so much! You were really, really kind!

Below is the link to the VJ guide you can study.    The DS-260 is submitted electronically at the NVC stage.  Anyone who is fluent in both languages can translate documents.  Just include the required translation certification statement.  Tax returns are required....but they are not proof of current income unless your husband is self-employed.  Yes, your husband's income will be an issue.  You will need to find a joint sponsor.

Prepare for a 12 to 18 month journey.  Good Luck......

Once he will be back in America he will get a new job which brings him to have 30k,will that be enough? In the past he didn't make enough but now he will be fine... Will his previous tax return be an issue then?

Which document can I use as proof of being a translator, is my IELTS enough?

  10. Hello everyone! How are you feeling today? I hope that you are all safe and sound.

My husband (26 US citizen) and I (26 Italian citizen) decided to marry in Italy and once the Covid19's issue will be resolved he will move back to America to start the CR1 visa.

We did our lots of readings but now we have few questions...

    1) When do I have to send the DS260?
    2) where can I find the numbers asked for immigration? (Like the numbers of the stamp on the passport)
    3) I have a c2 certification in English and IELTS band 8, can I translate my own documents or do I need a translator?
    4) Where can I find a good step by step on the cr1?
    5) Is the tax return the only proof of income?

    6) My husband didn't meet the poverty line in the last 3 years, will this be an issue?

    Thanks so much for everything!
