  1. Thanks for the responses, everyone. So, I have also spoken to a CPA for filing an amended tax return and she has told me that currently the processing times is at a minimum 4 months before the IRS responds. We have already been waiting well over a year just for the USCIS processing and I don't want to delay any further. I think the best course of action based on the responses is to submit the tax returns as is and at the same time file the amended return and if any issues arise, we can show them that the changes have been made and was just waiting for the processing from IRS.

I have spoken to CPA about filing an amendment and she has advised me that it would take at least 4 months if not longer to receive a response from the IRS and that would delay the visa process further. Thanks for the response. I guess nothing to worry about as long as current income is above the stated guidelines. Btw, should I also submit the tax returns for those years or just write the income on the I-864, and only submit current income proof and last year tax returns?
  3. Hi all, currently gathering the required documents for the NVC processing phase. My question is regarding the income requirements for the I-864 supporting documents. My current income is well above the minimum requirement listed. My last year (2021) tax return reported income is also over the minimum requirement. However, the previous 2 years before (2020 and 2019) are below the minimum requirement, will this in any way affect visa approval for my spouse? Also, on my last year tax return I had filed as single since my wife is not here and my employer suggested to leave it as single. Will this raise any red flags during the processing phase or later during the interview?
  4. I will talk to my attorney about seeing if we can do that. So far she has recommended I-130 as it is the best way of doing it.
  5. Thats what i'm wondering too. I have seen I-130 approved for some people that filed way later than I did at the same service center. It doesn't make sense that some cases are prioritized and others not.

  8. Hello All, So I have applied with USCIS for 1-30 and its almost a year on September 23 that we submitted our case but have yet to hear back. Is there a reason its taking so long for the case to process? I have seen several other people timeline and they got approved in months but ours is taking a very long time. The case status website says Case Is Being Actively Reviewed By USCIS as of February 15 of this year. Any advice on what we can do to expedite our case in any way. TIA
  9. I guess it doesn't make sense to apply for it since It would take longer to get the visitor visa than to wait for our petition to be approved. Thanks for all the help
  10. Hello everyone, Just wondering if anyone has tried or had success with get approval for visitor visa for spouse while waiting for USIC processing. The processing times have increased significantly and I wanted to bring my wife here for a few months while we are waiting for her petition to be approved. What are the chances that she will be granted a visitor visa if we were to apply and get a return ticket showing she has intention of going back. Thanks in advance.
