    If the child is not married and under 21, then the category is F2A and it takes about 1-2 years.  

     

    Both categories take about the same time as for children and for unmarried son's and daughters (F1) of USC.  Actually, F2B is slightly faster than F1.

    Thank you for responding. So even if the USC petitions for the child, it would take a year? Is it possible for the USC to do a k3/k4 since the F2 takes a long time?

    P.S. Since he just moved to the US, his green card hasn't even arrived yet. I chckd his case status and it shows the day when we paid for his card which as April 1st, the day he entered the US. I asked him to leave so he's no longer living in my house, but he sure is beginning me to take him back. He now claims that he's only there because I am on facebook lol and how does he know if I'm not talking to men on FB. Mind you that my Fb profile is closed and you can only see my profile photo there, the rest are not for the public and I also ahd our mutual photos on Fb, so I don't se where the logic is in what he claims since I put up our family photos while his own FB doesn't have one single photo of us. 

    What can I do now because I rally don't want him to get his g.c....

     

    1) Should I go to court tomorrow and immediately try to get annulment and servie it to him?

    2) an I contact USCIS and tell them not to send his g.c. to my address and explain why?

    3) Should I not do anything right now, wait for his g.c. to arrive and not give it to him but rather print the datign site evidence, write a statement, and send the g.c. with the evidence back to whichever USCIS?

    4) Will his 2 month living with me hurt his g.c. in the long run even if he manages to get his g.c. if it arrives soon?

     

    What would be the best and most effective option for me? Again, after so many thousands of dollars lost, my 35-38 years wait time gone for thinking that I finally got married again, I really don't think he should be getting that card because I invested to much money and time into this relationship and helped him out with everything, and all I get is him on dating sites within two month...it could be even after he entered the US, but since I only discovered him a few days ago two month into our reunion as husband and wife, I am saying two month. Please help!!! 

    Aww, I’m so sorry. I would contact USCIS or contact an attorney to see your options. I don’t really have the best advice, as I’m in a similar situation. This is my second marriage, both I petitioned for.

    Withdrawing is easy, you can join him for the interview and hand your withdrawal letter to the IO or mail the letter and don't show up at the interview. I don't think you can withdraw it after it gets approved.

     

    Once you withdraw, his AOS will be denied and will have to leave the US or stay illegally unless he was maintaining the J1 status and never used AOS based EAD.

    Thank you. His J1 has already expired. Monday we have our GC interview to adjust status. So, if i don’t show up, he will have to go back home?

    I am a US citizen that’s petitioned for my husband. He came on a J1 and we have an interview on Monday for adjusting his status. The issue is, I want to withdraw my petition due to the marriage not working out. But, we have a business together and afraid that if I don’t go, he would have to go back home and that would stop the business. Do we have any options at this point, for him to stay legally without me petitioning for him?

    We filed the AOS packet in early June, and haven't heard anything since receiving the NOA in mid June. We're in Southern California.

    We are still waiting. We did receive an RFE and they received the response July 14th. I hope they hurry because my husband needs to work and his driver’s license expire in October

    I understand that, just saying what he told me. I’m in the same situation as she is, being attached to someone with the affidavit for someone that used me to get here

    if you read the information, the sponsor is self-employed. There is no employer letter or pay stubs. 
     

    For a self-employed person, the tax return is the only way to prove income. There is no employer letter or pay stubs, or promised monthly salary. The annual tax return is where the final profit or loss from a business is tallied up.  The amount he says he earns does not have to “match” to the penny, but it can’t be more than what the tax return Line 7b (Total Income) shows. If his tax return 7b says $48,999 then he can put $48,000 on his I-864 but he better not put $50,000 or it will be rejected as not proven even though he does earn a good enough salary. 

    I know that..I have my own business as well. I was just giving an example and what I had to do, that’s all.

    She sent in a new I-485 and all its supporting forms and documents (and paid for all over again) and just received an RFE

     

    Her husband is self employed and makes $75,000 annually. They submitted all the income tax forms and  submitted all the info he had from the accountant.  

     

    Now, the RFE even to me sounds really confusing. They are not really that specific on what they actually missed on the form. My thinking is it could be they didn't send the latest version of the form? My friend is currently checking.

    She is at her wits end and told me she submitted everything to them.

    My husband and I received the same letter. What happens was, I put that I made (I’m the US citizen) $48,000 for the year. There was nothing showing that I made that amount because I had just gotten a raise in January, and my taxes didn’t reflect that amount. I had my employer write a letter stating that is how much I currently make, and I was able to print out the pay raise info from my company’s intranet. It could be where he put that he makes $75,000 but his taxes don’t show that he does. They need proof for the amount he stated he makes

    I’m sorry this happened to you. I went through the same thing. My ex husband told me that he was going to say i was abusing him, in order for him to stay. I have so many text messages between him and the other woman planning for him to be with her. I divorced him, and he and the woman are excepting a baby. I even have conversations showing where he wanted to burn me up in my apartment and I sent it to USCIS....it was a mess. First thing is to protect yourself. Reach out to an attorney and seek advice. I spoke to one regarding the affidavit of support, and he was telling me that he hardly see it affect the US citizen.

    There are a few reports from a few months ago (during the early days of closures) who were able to get an EAD issued with the biometrics part of the card showing "Unavailable". It is unknown what prints they used to run the background checks (POE? Visa?).

    That said, I haven't seen recent reports of that happening, especially since ASCs are starting to open back up.

     

    The biggest issue right now is there is a massive backlog for printing green cards and EADs. USCIS was transitioning the printing of cards to an in-sourced process (it was contracted before), but funding - and now staffing - issues arose with COVID.

    Ignore the misleading title..."undocumented" here refers strictly to a lack of the physical documents, not "illegal".

    I just got off the phone with the officer and he stated the biometrics is still needed and may be 90 days before they can get appointments scheduled for certain areas. He did advise us to go the application center to see if we can do walk-in appointment 

  13. Hello, all. 

    A few weeks ago my husband and I filed for an expedite for his EAD and AP, because I’m out on medical leave and no income is coming in. We received an email last week, asking to fax in supporting docs which we did. We also received an email stating My husband would need to complete his biometrics first. We call USCIS this morning and the agent stated that we don’t need fingerprints for the EAD and she will have an officer call me. I always thought biometrics were needed for employment card. Is this good news that an officer will reach out to us? We have no money coming in right now, and I can’t go back to work until August 22nd.

    ”Current income” should be your current income backed up by employment verification letter/pay stubs.

    For tax years you can fill the ones you have (by now you probably have 2019 as well), using the “total income” line from the 1040.

    Then you’ll need to provide W2s etc again, as indicated.

     

    Maybe others can chime in, but that’s what I read from the letter.

     

    my response assumes that you do indeed qualify as sponsor. If not, a joint sponsor would be needed :)

    Thank you. Makes sense. I have received a raise since i filed my last tax return. I will just get a letter showing how much i make.

    I’m trying to take a photo but it’s saying the file is too large. I think i misread the part about that bank statements; i think that’s if we needed a joint sponsor they would need to send them in

    I'm not sure what questions you want to ask USCIS when calling. I believe the RFE is a one response thing, if I recall it correctly the letter states something along those lines (that one response with all evidence must be sent, multiple responses won't be considered) - but I'm not 100% sure.

    We just got the RFE today. I sent in tax returns from 2017 and 2018 and on the I-864 (whichever form) i put have not filed but will. The new filing date isn’t until July 15, so when we sent it, i hadn’t filed yet. I also sent 12 months of bank statements from both banks. Do i just need to reprint them all again? And the birth certificate we sent, one English version and one French. We sent in everything they are asking, except the taxes for 2019.

  17. My husband and I received an RFE for his I-485. It is asking for the birth certificate, 12 months of bank statements and my most recent tax info. We sent all of that in, except for my most recent taxes. I have not filed yet because of the Covid situation. Should we just send the same thing over again, or can we call uscis and ask more questions?

    This just happened to me as well. This will be my 3rd time sending this back. I reprinted all of the forms, and what i did this time was find videos on YouTube on how to fill out each form and i have gone line-by-line at least 5 times on each form to make sure everything was filled in and this time, i out N/A or NONE for items not applicable to me. The first two times, i left them blank. Maybe that could be your issue as well. 

  19. If any could give some advice. My husband and I are submitting our I-130 and i-485. I know with the I-944, he has to show he will be able to Sustain on his own. He owns a house in South Africa, but unfortunately we don’t have the copy of the deed or appraisal because it’s locked in a safe at the home, which he has a key for here in the US. Would it be beneficial to write a letter explaining that he owns a house, and once he is able to get his AP, we plan to go get it so we can have at the interview. Or, should i leave this out? I am over the 125% poverty limit, so not sure if this would make a difference or not.
