  1. Work on getting married first, and settle yourself in adjust, and relax for awhile. My wife was bored at first, but I made it clear she wasn't going to work until we traveled, and started our family she thanked me for it later.

    Now after over a year we have a daughter she is just now going to her AOS interview she will be ready now to get a job, drivers license, and whatever she wants its a tough job market out there anyways. Its a huge adjustment to life in America. Good Luck!!

  2. Based on the info given she is still married if she participated in the ceremony with witnesses.

    When the US immigration ask the question was she previously married and if she says no and they find out otherwise, or someone from her husbands side finds out she remarried, and files a complaint down the road it could come back to haunt her even if she is already established here in the US.

    If she is caught in a lie during the immigration process she could be permanantly banned from ever coming to the US.

    My advise is to deal with the situation of getting the annulment now it is simply the right thing to do.

  3. Ok a few things that is a little troubling for me is you claim your fiancee backround could be a problem? Why?iIf you care to tell us. Second is he serious about his relationship with you because there is no way that a man that loves his wife or fiancee would sit by so long and not realize something is not right with the application.

    The reality is it his resposibility to follow up with the USCIS or to get an attorney to deal with the case if he was serious. You only know what he tells you

    and right now based off of the limited info that you have on your timeline at this point there are some issues.

Your timelines says you are a K-1 visa, anyways once you have an EAD card you can get a social security number which it says in your timeline you have already it will say however for work purposes only until AOS is approved, but you can use the number to file for married filing joint tax returns

    also bank accounts usually require a US ID EAD card, and or secondary ID like foreign passport, and proof of adress a bill or mail in your name with current adress. Hopefully that helps

Thats funny my wife used to do the same thing washing clothes by hand when I went to the Phils the first time I got her a nice new apartment in a gated subdivision in Bulacan I bought her a washing machine first thing it was nothing like ours here in the States but for her it was a big deal she loved it.

    My dad who is with my wifes aunt that is how we met is retired military and he is moving to Phils next month he is going to do 4-6 at a time there I am kind of jealous because the Phils is really a nice place if you live outside of the grind of the city. I told my father he might get bored a little but there is an exclusive golf course nearby I told him to start learning how to play.

    For some that have been hard hit by the economy here that would be a nice place to stay for awhile if you have cash saved up to move, and open a small business. You could live like a king.

Obviously this is a serious thing that was done I am not sure why this was done while still knowing you were married but you both need to get attorney advise because if you have a permanant ban for misrepresentation the only way you can be together is if he moves to the Philippines, and it would suck if you get married first only to find out that you can't get the K-3 at all. Remember its a long road and patience, as much as it hurts to be apart always is worth the wait. Hang in there and good luck.

I have researched the stimulus for 2008 a little and am no where near an expert but i did learn that they are allowing people that would have received a stimulus last year but for whatever reason didn't would have an opportunity to get last years stimulus on this years return. there is a problem with this for immigrant spouses, according to last years rules an immigrant would not qualify for the stimulus payment for 2007, due to the way the stimulus was written as well as the USC filing jointly. what is probably happening with using a tax preparer is there system doesn't consider this in preparing your return since your spouse now has a SS number for this years filing. I would recommend that you call IRS and ask about it so you dont receive a payment and then will have to pay it back later. Better to be safe than sorry.

    He has the right to file married filing jointly if he was married in 2008. Regardless if he married an immigrant or not all she needs is a valid social security number. That would also qualify him for additional stimulus in most cases .All of the tax software is designed to give him the additional funds if he qualifies.

If u r planning to visit ur gf in Philippines U can apply a fiance visa here in Philippines just go to the US embassy in manila ..in roxas boulevard....i think it would be easier I saw a lot of petitioner and their FIANCEE/FIANCE there applying i-129 F when i applied for the naturalization and US passport for my lil one...i think it would be alot easier and fastest way...or call the US embassy here in philippines to ask what papers r needed to applied...they r very nice

    You should apply for your fiancee only after you have met her first that way you can have evidence like photos. Also unless things have changed in the last couple of years. I thought you can only apply for fiancee here in the US not at the Embassy because your petition has to go to your local USCIS according to where you live to start the approval process.

  9. I have a question for anyone knowledgable in immigration, taxes and the stimulus package we received last year.

    Here is a little background to my situation.

    My wife did not arrive in the states until April or 2008. She got a SSN immediately. We got married in May and updated her SSN to reflect her new name.

    I tried to use HRBlock's online tax return calculator to calculate our 2008 taxes.

    Everything seemed to work ok until I ran into a snag. The error checker would not let me leave Charry's stimulus payment blank. It made me enter how much she got. When I entered $0 as the payment it gave us an extra $600 back on our taxes.

    It was my understanding that you only got this stimulus payment if you worked in 2007. Is this belief flawed?

    Curious if anyone else has already run into this and knows the answer. HRBlock wants me to pay them to ask the question and I ultimately can not use their site anyway cause Charry was a part year resident and the online forms do not cover this.

    Its true because you were married in 2008 depending on your original stimulus you could be eligible for additional if your maritial status changed in 2008 or you had a child they are giving an adjustment. So enjoy the extra cash.

    I am new here. Just want some help about my expired I-94 and SSN problem. I arrived in the US 22nd of Oct '08 and got married 22nd of Dec. When we were on the process of preparing the list of required docs for the AOS, I noticed that the immigration officer at the US airport where I arrived filled my citizenship incorrectly so we went to the local USCIS office to have it settled yet, a Custom and Border officer was not available and asked us to come the next week. When we got there again the CB officer noticed that my I-94 expired the day before though he wrote a note of correction to my citizenship. Then I realized that I-94 should be valid upon applying of AOS. I have read some discussion regarding this and hope this would not be a problem. However, my husband is now applying for his Income tax return with a married status and the IRS staff told him that I need an SSN for him to be able to do that. I just have read that with an expired I-94, I cannot be issued an SSN. Would it be possible for us to file a joint tax return prior to my acquiring of SSN? Thank you so much for whatever help you can provide regarding this concern...

In this situation, do not consider the expired I-94 when making a decision about alien status/work authorization; consider only the current immigration document (the EAD card).

    Read the first "Note" in bold

    Ok to clarify this SSN for filing taxes. The SSN will not be issued if you have a expired I-94 because your status is still in a gray area according to the Social Security Admin you are technically legal to be here because you completed the marriage before 90 day expiration. Now once you apply for the AOS you should apply for EAD, and or Advance Parole at the same time it cost no extra. Once you apply for the AOS you will be given a legal stay by the State department until you AOS is approved. Once you are issued a EAD card you can get a SSN that will be stamped for work purposes only. You can use that to file tax joint tax returns. AS for the Tax Id number you should ask a tax prof. for advice I would think that should be ok. It takes 2-3 months for EAD card.

    Please don't put your husband as a dependent He signed an affidavit of support to support you and that is a binding contract with the US government

    it ends if you work 40 financial quarters worked which is equal to ten years or if you become a US citizen. You should file just married and then put your child or children as dependents.

  12. Did you file married with a high amount of deductions or is your income very low?

    You should ask your employer why they are not taking fed taxes from your check once you fill out your W-4 employers are suppose to take out the proper deductions. Take another blank form home and have you and your husband fill it out correctly and submit new W-4 to employer.

    Next year when you have worked all year you will have a big tax burden if they don't take out federal taxes.

    Also as a comment to someone that does taxes married but filling seperately that only is a good thing if you have children maybe you could get a big portion of Earned Income Credit. But I would think in most cases you would get more deductions by filing married, and you could get an extra rebate stimul amount if you were married in 2008. Because your stimulus was based on your status filing in 2007 if that status changed in 2008 married or had a child you could get an additional portion. I am not a tax specialist, but work in Corp Management.

  13. It's VERY important to adjust status ASAP. If something negative should happen to the relationship or to the petitioner the beneficiary will have to leave the US.

    I agree that it is very important. I think they should do it as soon as possible.

    However, if they dont have the money and there is a choice between eating, paying the rent, buying medicine ect and spending the money for the adjustment of status I would put off the AOS and file as soon as my finances would allow it.

    Being unemployed is tough, sometimes hard choices need to be made and in my opinion providing for your family always comes first.

    I would think that if you have the 1010.00 to file saved up or to cash advance a low % credit card to do it. It would allow your fiancee to work with the EAD card if needed. But if you waited until you found a job because money is tight that is ok also. I waited a year until I filed for my wifes AOS and it hasn't been a big deal we traveled and I didn't want her to think about working so I took that option off the table by not filing. I think going to the interview without a job is not a good idea. Tough decision.

  14. Sally, they didn't name it the mis-information line for nothing. If you do not get the letters in the mail in the next couple of weeks I would suggest scheduling an infopass.

    lykatodd, you can get a SSN between 14 and 75 days after arrival on a K1 visa. Maybe the officer you spoke with was misinformed or not knowledgable in immigration. A few VJers have printed the information from the SSN website and taken it in to the SS office.

    Usually you can get a social security card once you get married after arriving on a K-1 visa up to 90 days of scheduled K-1 expiration after the 90 expires and you don't apply for the SSN you will only get a number issued during the Adjustment of Status process. If you apply and get approved for the EAD card you can apply for SSN but it will be stamped for work purposes only. Once your AOS is approved you can apply for SSN without that for work purposes only stamped on the card.

    Dual citizenship for an U.S. Citizen is not possible in the Philippines for the American Citizen but possible for the Filipino citizen.

    In a bad economy here in the States our dollar has started to be more valuable in the Philippines.

    Be careful American Citizens cannot own property in the Philippines only the Filipino spouse can own the

    property. The only way around this is to have a corporation in the Phils, :unsure: and put in the property in the name of the corp.

    U should consult a reputable attorney before you do this.

  16. Just wanted to say hello to everyone my Fiancee has been here one week now and its has been just great to have her next to me after seven months. Her POE was Detroit and everything went great even with 1hour 45 min connection to Hartfort, Conn. So Just wanted to say thank you to everyone here that posted information to help guide us through the long tough immigration process. Her smile is forever imprinted in my mind when I saw her get off the airplane.

    I was in Bulacan in March of this year. My fiancee is from Pasig Metro Manila I moved her out there in a nice subdivision

    into a brand new apartment man I almost went broke 120.00 a month. Just joking For what I pay in mortgage for my house in one month I could live there about 10 months. :wacko:

  18. So after my fiancee got approved and denied visa pick up I booked her a flight for OCT 16 POE Detroit.

    I failed the realize Columbus Day and another holiday on OCT 12 in the Philippines. The Embassey released her visa to Delbros on OCT 9th A week after the interview they said thiey would deliver to Bulacan on Thursday about 1 hour and 15 minutes from Manila. Well Thursday came around I called her at 10 am PHILS time and she hadn't received it so I told her to call to follow up and they told her that they wouldn't deliver it today they would deliver it maybe Sat OCT 13. Remember she still had to go to the CFO to get something done to the Visa on Monday her flight is on Tue at 655am.

    My fiancee called me back upset about it they said it was released by the Embassy but it was still at the Embassy their courier hadn't sent it yet. So she asked could she change the address to where here friend was staying at a hotel close to the embassy they told her yes I wasn't for it unless they delivered it that sameday the requested a letter to be faxed with the reason for the change of address and a photo copy of her ID. She drafted a letter letting them know her plane leaves Tue Oct 16, and there is a holiday tomorrow which was this past Friday and she still needed to go to the CFO.

    My fiancee took the course already but forgot my divorce document. So her friend that got put on AR allowed my finacee to use her room number and the address at her hotel so the courier could deliver that day to her. My fiancee called delbros every hour after she faxed the documents and talked to the same lady. The lady gave my fiancee her personal cell number to get in contact with her as assurance this would be delivered that day to the Hotel new address.

    My fiancee arrived at the Hotel and went to her friends room, Delbros lady gave my fiancee the delivery guys direct cell phone number to call him which she did. He said he would be over to deliver her passport shortly. My fiancee called him every 30 minutes until he arrived which was 1hr 30min after she originally spoke to him he said Mam my cell phone has low bat now because you called me so much. Meeting her new friend paid off huge they also went to the CFO class together 2 days after the interview. My fiancee friend along with her determination and a really great lady at delbros made it possible for my fiancee to make her flight on time. :) Also my fiancee and her friend discovered that me and her fiance have the same birthday.

    My advise is follow up about your Visa and remember they have special delivery if your flight is leaving the next day before there scheduled delivery time. A

  19. My Fiancee had her interview on OCT 2 at 7:30am. She Arrived at 4:30am to a line already. She started networking with some of the other fiancee there. They finally entered the lobby around 8:30am. She admitted being jealous about seeing some of the other fiancee women that had there fiance with them because they got to go ahead of everyone else first.

    All the other fiancee had big folders I sent her one folder with all the required documents needed for her interview she felt in seeing that others had big folders some had 2 that hers wasn't enough. I gave her specific instructions to only give the Pre Screener what they asked for nothing more. Note some fiancee wanted to give pre screeners extra things and Pre screeners said only give me what I asked for nothing more with an attitude.

    It was a long day she didn't get called until 3:00pm for the pre screener and she was talking to the CO at 3:30pm

    Let me back up for a minute she observed a few things. One girl was getting asked many questions about her relationship because she was like 25 and her fiancee was 66 the prescreener asked her did she want kids she said yes, and the prescreener acted shocked because of the age of her fiance. That same girl went to the CO for her interview and she was denied.

    My fiancee really bonded with one of the girls there after my fiancee had her interview and was approved her friend went in to have her interview she was requested after the interview to go into a different room for further questioning by NBI Agents they are equal to our FBI. They were very rude to her asked her alot of personal questions about her relationship

    Example: Did you sleep with your fiance the first time you met him over here? After that she had to return the next day with some other documents and after it was cleared up they put her on AR. They said they don't have a set time to have a decision made but she did pay the Delbros Delivery Fee.

    She felt if her fiance would have been there it would have made all the difference. He runs his own business and when he left his business for a month before to visit her his business almost went under so he was scared to risk it again.

    The CO that interviewed my fiancee ask her How did you meet? When was the last time you saw him? What does he do for work? Does he have kids? Would you like kids one day? How old is your fiance? She replied 34 and he said oh he is around my age. He made reference to he had to sign alot of papers and that it was late my fiancee said yes my fiance is waiting for me to call and he hasn't been sleep yet. He asked how for she lived and he said let me get you out of here you are approved. Welcome the the United States. She was denied Visa Pickup .He basically asked everyting the Prescreener asked. My fiancee said He was very kind to her and put her at ease.

    Definately if you can be there definately go to the interview if you can't make sure your fiancee knows alot about you even things you don't maybe want her to know. And Role Play the interview be very tough. And Network with other fiancee this paid off Huge in getting the Visa in hand. I will make a seperate post.
